HomeMy WebLinkAbout09-10-51 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, September 10th, 1951, at 8:10 P.M., with all members present. President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of August 27th, 1951. CLEM NIEZGODSKI A. KEMPER Committee STANLEY C. KORPAL ) CHESTER MUSZYNSKI Councilman Muszynski made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. PETITION To: The South Bend City Council Gentlemen: We, the undersigned, owners in fee simple of more than fifty (50%) per cent of the following described property: Homeland Addition, lots numbered four (4) through thirty -two (32); Homeland Addition 2nd Addition lots numbered one hundred forty (140) through two hundred fifty -five (255) inclusive; and Homeland 3rd Addition lots numbered two hundred fifty -six (256) through three hundred seventy -one (371) inclusive, petition the Council of the City of South Bend to re -zone the described property. This district is presently zoned as Class "E" Heavy Industrial. There are no heavy industrial or commercial establishments within the above described district, but there are 25 single family dwellings. VVEEREFORE, the undersigned request and petition that the zone of said district be changed from Class "E" Heavy Industrial to Class "A" Residence and "A" Height and Area District. (196 Signers) Councilman Tellson made a motion that the petition be referred to the City Plan Commission. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen:.' Petition of Alex Buziak, et, ale for-change of zoning on West Ford Street between Meade Street and Kaley Street is found to be inadequate and the petitioners will file a new petition. Yours truly, D. Moomaw, Secretary Councilman Kemper made a motion that the report be accepted. and placed on file. Councilman Musty nski seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of St. Joseph Undertaking and Cemetery Association for change of zoning of Lot No. 64 of Commissioners Subdivision of Bank Out Lots No. 85 and 86 from B residence and A height and area districts to C commercial and D height and area districts has been given public hearing by the City Plan Commission and this change is recommended. Yours truly, D. Moomaw, Secretary Councilman Korpal made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend Gentlemen: Petition of Floyd L. Cook for change of zoning of Lot No. 1 in Major's Addition from B residence and A height and area district to C commercial and E height and area district has been given public hearing by the City Plan Commission. This change is recommended. Attached to the petition is a remonstrance filed by property owners in the vicinity. Yours truly, This lot is on north side of L.W.E. at Caroline Street. D. Moomaw, Secretary Councilman Tellson made a motion to have roll call to accept the report of the City Plan Commission. Motion carried by a roll call vote of 6 ayes - 2 nays. REGULAR MEETING 'ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,.INDIANA. (Lot on the north side of Lineolnway East at Caroline St.) SEPTEMBER 10TH. 1951 746 The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion lost by a roll call vote of 5 ayes - (Niezgodski, Korpal, Tellson, Glass and Muszynski) - 3 nays (Beetle, Kemper and Erler). Councilman Muszynski made a motion that the ordinance be referred to the Committee.of the Whole on September 24th, 1951. Councilman Tellson seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF FIVE THOUSAND FIVE HUNDRED ( #5,500.00) DOLLARS, TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1951 BUDGET OF SAID CITY, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on September 24th, 1951, Councilman Bestle seconded the motion. Motion carried. ORDINANCE NO. 3843 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lot immediately to the rear of the property at 1233 Western Avenue) The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. a� There being no further business before the Council, Councilman Tellson made a motion to adjourn, which motion was seconded by Councilman Muszynski.
