HomeMy WebLinkAbout08-13-51 Council Meeting Minutes740 REGULAR Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, August 13th, 1951, at 8:15 P.M., with all members present except Councilman Erler. President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of July 23rd, 1951. CLEM NIEZGODSKI ) CHESTER MUSZYNSKI ) Committee A. P. KEMPER ) STANLEY C. KORPAL ) Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of, South Bend, Indiana Gentlemen: Petition of William S. and Vera M. Phillips for change of zoning of a part of lot P in Wenger and Kreighbaum's Vistula Avenue Addition has been given public hearing by the City Plan Commission. This change is not recommended. Yours truly, D. MOOMAW, Secretary Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Rozo Rokop Toth, et. al. for change of zoning of lots 13, 14, 15, 16, 17 and 18 in Swygart's 3rd Re 1. Lots 1 and 2 in Sumption.Prairie Avenue Addition and lot 32 in Swygart's 5th Addition from C use and D height and area districts to B use and A height and area districts has been given public hearing by the City Plan Commission. The City Plan Commission recommends that lots 13, 14,'15, 16, 17 and 18 in Swygarts 3rd Replat together with lots 1 and 2 in Sumption Prairie Avenue Addition be changed from C use and D height and area district to B use and A height and area district. It will be noted that lot 32 in Swygart's 5th Addition is not recommended for change at this time. Yours truly, D. MOOMAW, Secretary Councilman Glass made a motion that the report be accepted. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Crown Development Company for zoning of the property annexed to the City of South Bend by Ordinance No. 3821, known as McKinley Terrace, has been given public hearing by the City Plan Commission. The petition asks that the entire area be zoned A residence and A height and area districts. The City Plan Commission recommends to the Council that all lots in McKinley Terrace Addition except lots 132, 133, 134 and 135 be zoned A residence district and that said lots 132, 133, 134 and 135 be zoned C -1 commercial district and D height and area district. 'Councilman Glass seconded the motion. Motion carried. ORDINANCE NO. 3836 AN ORDINANCE AMENDING ORDINANCE NO. 3702 OF THE ORDINANCES OF THE CITY OF SOUTH BEND, INDIANA. (Lots are in the 1900 block of Prairie Avenue) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent ( Erler). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent ( Erler). ORDINANCE NO. 3837 AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702. (70 acre tract North of McKinley Ave. and East of Morris Park Country Club) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent ( Erler). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent ( Erler). ORDINANCE NO. 3838 AN ORDINANCE TO CHANGE THE NAME OF CRUMSTOWN AVENUE TO ARDMORE TRAIL. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent ( Eyler);. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Erie r). ORDINANCE NO. 3839 AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF THE FOLLOWING DESCRIBED REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, TO -WIT: Lots "G -2 ", "F -2" and "E -2" as shown on the recorded Plat of Wenger and Krieghbaum's Vistula Avenue Addition, more fully described as beginning on the west edge of the St. Joseph River on the line between lots "G -2" and "H -2" as shown on the recorded Plat of Wenger and Krieghbaum's Vistula Avenue Addition, thence Southwest on the line between said lots "G -2" and 11H -2% to Lincoln Way East, thence Northwest on the Easterly line of Lincoln Way East 136.7 feet, thence Northeast parallel to the line between said Lots "G -2" and "H -2" 30 feet; thence Northwest parallel to Lincoln Way East 50 feet; thence Northeast parallel to the line between said Lots "G -2" and "H -2 ", to the St. Joseph River, thence Southeast along said River, to the place of beginning, subject to the right of the City of South Bend to construct an interceptor sewer across said land at the approximate location and depth as shown on the plans for the interceptor sewer in the Engineer's Office of said City. The ordinance was given first reading by title and second reading in full. Councilman GlasOnade a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent ( Erler). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Eyler). 742 ORDINANCE NO. 3840 AN ORDINANCE RATIFYING AND CONFIRMING TWO AGREEMENTS ENTERED INTO ON THE 4TH DAY OF AUGUST, 19519 BY THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, FOR THE PURCHASE OF TWO TRACTS IN THE SOUTHWESTERN SECTION OF THE CITY OF SOUTH BEND IN THE VICINITY OF PRAIRIE AND EKING AVENUES FOR THE SUM OF FIVE THOUSAND ($5,000.00) DOLLARS. AUGUST 13TH. 1951 The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent ( Erler). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Eyler). UNFINISHED BUSINESS Councilman Muszynski made a motion to refer the truck complaint in the 1900 block of W. Indiana Avenue to the Transportation Committee for further study. Councilman Tellson seconded the motion. Motion carried. The Clerk was instructed to contact the Fire Inspector to investigate the condition of weeds along the property of the Brodbeck Trucking Company and Stevens Oil Company near the 1900 block of W. Indiana Avenue. There being no further business, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Tellson. Motion carried, and Council adjourned at 9:.00 P.M.
