President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. COMMUNICATION City Council City Hall South Bend, Indiana July 18th, 1951 Gentlemen; The Holy Name Society of Holy Cross Parish lends its whole...hearted support to The Catholic War Veterans of South Bend in asking civic support for protests against objectionable motion pi-etures and literature. For the welfare of our community, we feel The City Council should give this matter serious consideration and if it be deemed advisable, an ordinance be passed to cover the situation, so that proper enforcement can be insisted upon. Councilman Korpal seconded the motion. Motion carried. PETITION TO: THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA. Petitioners, MORB4S Be HOFFMAN and REUBEN HOFFMAN, by their attorneys, Voor, Jackson, Grant & McMichael, respectfully petition that Ordinance No. 3702, adopted by the Common Council on the 13th day of June, 1949, and commonly known as the Zoning Ordinance, be amended as follows, to -wit: That the property situate in the City of South Bend, Indiana, and described as follows, to wit: Lot Numbered 20 as shown on the recorded Plat of Sommers Addition to the City of South Bend, be changed from B Residence and A Height and Area District to C Commercial and E Height and Area District. Petitioners further state that they are the owners of all of the above - described property. Petitioners further state that they have attached hereto a form of ordinance for the convenience, use and approval of the Common Council of the City of South Bend. WHEREFORE, petitioners respectfully request that the Common Council of the City of South Bend, Indiana, accept and act favorably upon their said petition and that the property herein described be, by proper ordinance, duly passed and legally published, changed from B Residence and A Height and Area District to C Commercial and E Height and Area District. McMichael Councilman Tellson made a motion that the petition be referred to the City Plan Commission. Councilman Erler seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION 1. To the Common Council City of South Bend, Indiana Gentlemen: July 23, 1951 The City Plan Commission has considered the petition of the First Bank and Trust Company for annexation of a tract of land 192 acres in area which is East of Miami Street and North of Ireland Road. The City Plan Commission approves and recommends the annexation as petitioned for. Yours, truly, D. Moomaw, Secretary Councilman Erler made a motion that the report be accepted. REGULAR MEETING JULY 23RD, 1951 REPORT OF ORDINANCE COMMITTEE The Ordinance Committee met on July 16, 1951, at 8:00 P.M. in the Council Chambers at the City Hall, South Bend, Indiana. Present in person were Stanley Korpal, Chairman; Al Kemper and Chester Muszynski, members; the City Attorney, Frederick K. Baer, and representatives of the theaters of South Bend, Indiana. The meeting was opened by the Chairman and the persons present were informed of the proceedings which had taken place to date which led to the meeting and the consideration of an ordinance for the censorhip of movies. The theater owners or their representatives were given an opportunity to state their case. The committee was informed by them that all the movies reaching South Bend came from Chicago where they were first subjected to a Boaf-d of Review and anyfhing which was deemed to be unfit or improper to be presented on local screens was either deleted or the entire film was cancelled. The said representatives advised the members of the committee that for years past they had been extremely careful in the selection of movies for South Bend, and that whenever any organized group had voiced any opposition to any movie which was objectionable, whether on religious or moral grounds, such movie was immediately removed from showing. The operators further pledged to the committee that they would continue to do the following: 1. Impose a voluntary censorship on all movies to be brought into South Bend. 2. That the cashiers and ticket takers of each movie theater would be instructed to use extreme care and caution in the admission of persons to movies who were not adults, when such movies are advertised for "adults only". On the basis of the discussion and on the information presented, your committee makes the following recommendation to the Common Council; 1. That the theaters of the City of South Bend be given an opportunity to impose their own censorship on movies to be shown locally. It is the opinion of the committee that -the exhibitors are in the best position to fulfill this responsibility. 2. That such voluntary censorship be given a reasonable trial period. That during such period the committee will carefully observe the movies shown in the city, and thereafter, report its.findings to the Council. 3. That no censorship ordinance be considered or enacted until adequate showing is made that the above program has failed to achieve the desired results. Submitted to the Common `Council of the City of South Bend, this 23rd day of July, 1951. COMMITTEE ON ORDINANCES Stanley C. Korpal Alvin P. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance fixing the annual salary of the South Bend, Indiana, City Court Probation Officer; and appropriating from the General Fund of said city the sum of Three Hundred Ninety- eight Dollars and Fifty Cents ($398.50) to the 1951 budgetary item, Services Personal, in the Office of City Judge; repealing any and all conflicting ordinances, and declaring an extraordinary emergency ". Respectfully -report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing a certain item in the 1951 South Bend, Indiana, Municipal Civil Cit Budget, and appropriating from the General Fund of said City the sum of Five Hundred Twenty -five ($525.00� Dollars, to a certain other budgetary item of the 1951 budget of said city, and declaring an extraordinary emergency'% Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1951 South Bend, Indiana, Municipal Civil City Budget, and appropriating from the General Fund of said city the sum of Twenty -Four Thousand Three Hundred ($24,300.00) Dollars, to certain other budgetary items of the 1951 budget of said city, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. REGULAR MEETING REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: JULY 23RD. 1951 736 Your Committee of the Whole to whom was referred "An Ordinance requiring the New York Central Railroad Company and the New Jersey, Indiana and Illinois Railroad Company to provide and maintain automatic flash light signals and short -arm gates at the grade crossing of the tracks of said railroad companies where the same intersect with Western Avenue for the protection of human life, providing for penalties for the violation thereof, and repealing all ordinances in conflict herewith ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance requiring the New York Central Railroad Company to provide and maintain automatic flash light signals at the grade crossing of the tracks of said railroad where the same intersect with Washington Street for the protection of human life, providing for penalties for the violation thereof, and repealing all ordinances in conflict hereof ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance requiring the New York Central Railroad Company, the New Jersey, Indiana and Illinois Railroad Company and the Indiana Northern Railroad Company to provide and maintain flash light signals and short -arm gates at the grade crossing of the tracks of said railroads where the same intersect with South Walnut Street for the protection of human life, providing for penalties for the violation thereof, and repealing all ordinances in conflict herewith ". Respectfully report,that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance requiring the New York Central Railroad Company, the Pennsylvania Railroad Company and the New Jersey, Indiana and Illinois Railroad Company to provide and maintain automatic flash light signals and short -arm gates at the grade crossings of the tracks of said railroads where the same intersect with Kemble Avenue and with Prairie Avenue for the protection of human life, providing for penalties for the violation thereof, and repealing all ordinances in conflict herewith% Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. ORDINANCE NO. 3828 AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA. (190 Acres East of Miami St. and North of Ireland Rd.) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3834 AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY, THE NEW JERSEY, INDIANA AND ILLINOIS RAILROAD COMPANY AND THE INDIANA Y_ NORTHERN RAILROAD COMPANY TO PROVIDE AND MAINTAIN FLASH LIGHT SIGNALS AND SHORT -ARM GATES AT THE GRADE CROSSING OF THE TRACKS OF SAID RAIL- ROADS WHERE THE SAME INTERSECT WITH SOUTH WALNUT STREET FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 383.5 AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY, THE PENNSYLVANIA RAILROAD COMPANY AND THE NEW JERSEY, INDIANA AND ILLINOIS RAILROAD COMPANY TO PROVIDE AND MAINTAIN AUTOMATIC FLASH LIGHT SIGNALS AND SHORT -ARM GATES AT THE GRADE CROSSINGS AT THE TRACKS OF SAID RAIL- ROADS WHERE THE SAME INTERSECT WITH KEMBLE AVENUE AND WITH PRAIRIE AVENUE FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. UNFINISHED BUSINESS Councilman Tellson, Chairman of the Street and Alley Committee, reported to the Council that the committee recommendsthe change of Crumstown Avenue to Ardmore Trail. Councilman Tellson made a motion that the City Attorney be instructed to draw up an ordinance to change the name of Crumstown Avenue to Ardmore Trail. Councilman Kemper seconded the motion. Motion carried. Councilman Korpal made a motion that the Traffic Engineer work out a solution, similar to that on Meade Street, to slow up the speeding of truuks in the 1900 block of West Indiana Avenue. Councilman Muszynski seconded the motion. Motion carried. There being no further business, Councilman Glass made a motion to adjourn, which motion was seconded by Counci Korpal.
