HomeMy WebLinkAbout07-09-51 Council Meeting MinutesREGULAR MEETING JULY 9TH, 1951 Be it remembered -that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, July 9th, 1951, at 8 :20 P.M., with all members present. President Niezgodski presided. REPORT- OF COMMITTEE ON MZNiUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. CLEM NIEZGODSKI ) A. KEMPER ) Committee STANLEY C. KORPAL ) CHESTER MUSZYNSKI ) Meeting of June 25th, 1951. Councilman Glass made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion �� carried. COMMUNICATION Communication from Mr. William J. Muth, Vice - President of National Conference of Councilmen and Aldermen, to members, of Council to attend annual convention in Cleveland, Ohio; on July 18, 19, 20 and 21, 1951. Councilman Korpal made a motion that the communication be accepted. Councilman Kemper seconded the motion. Motion carried. PETITION To the Common Council of the City of South Bend, Indiana: The undersigned citizens respectfully request the installation of a street light at the corner of Oak Ridge Drive and Scottswood Drive, in this city. 5 Signers Councilman Tellson made a motion to refer the petition to the Board of Public Works. Councilman Korpal seconded the motion. Motion carried. PETITION Members of the Common Council City of South Bend Gentlemen: �. The Board of Public Works and Safety is in receipt of the attached petition to change the name of Crumstown Avenue to Ardmore Trail. They are referrirg this matter to you for your attention. Councilman Glass seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1951 Municipal Civil City Budget of the City of South Bend, Indiana; and appropriating from the General Fund of said City the sum of One Thousand Seven Hundred ($1,700.00) Dollars to certain other budgetary items of the 1951 budget of said city, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. REPORT OF CITY PLAN COMdISSION To the Common Council City of South Bend, Ind. Gentlemen: Petition of Bob Rans Wholesale Co. and Pittsburgh Plate Glass Co. for change of zoning of property on west side of S. Franklin Ste between Calvert Ste and Dubail Ave. from E height and area district to F height and area district was given public hearing before the City Plan Commission on July 5, 19519 This change is recommended as petitioned for. ORDINANCE NO. 3826 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 MUNICIPAL CIVIL CITY BUDGET OF THE CITY OF SOUTH BEND, INDIANA; AND APPROPRIATING FROM THE GENERAL'FUND OF SAID CITY THE SUM OF ONE THOUSAND SEVEN HUNDRED ($1,700.00) DOLLARS TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1951 BUDGET OF SAID CITY, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed.by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3827 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 3702 Property on est side of FraMin St. between Calvert St. and Dubail Ave.) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and patsed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE FIXING THE ANNUAL SALARY OF THE SOUTH BEND, INDIANA, CITY COURT PROBATION OFFICER; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF THREE HUNDRED NINETY -EIGHT DOLLARS AND FIFTY CENTS ($398.50) TO THE 1951 BUDGETARY ITEM, SERVICES PERSONAL, IN THE OFFICE OF CITY JUDGE; REPEALING ANY AND ALL CONFLICTING ORDINANCES, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on July 23rd. Councilman Bestle seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REDUCING A CERTAIN ITEM IN THE 1951 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET, AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF FIVE HUNDRED TWENTY - FIVE ($525.00) DOLLARS, TO A CERTAIN OTHER BUDGETARY ITEM OF THE 1951 BUDGET OF SAID CITY, .AND DELCARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on July 23rd, Councilman Glass seconded the motion. The ordinance was given first reading by title and second reading in full. ORDINANCE s AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY AND THE NEW JERSEY, INDIANA AND ILLINOIS RAILROAD COMPANY TO PROVIDE AND MAINTAIN AUTOMATIC FLASH LIGHT SIGNALS AND SHORT -ARM GATES AT THE GRADE CROSSING OF THE TRACKS OF SAID RAILROAD COMPANIES 'WHERE THE SAME INTERSECT WITH WESTERN AVENUE FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole on July 23rd. ORDINANCE AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY TO PROVIDE AND MAINTAIN AUTOMATIC FLASH LIGHT SIGNALS AT THE GRADE CROSSING OF THE TRACKS OF SAID RAILROAD WHERE THE SAME INTERSECT WITH WASHINGTON STREET FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREOF. 732 The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that that ordinance be referred to the Committee of the Whole on July 23rd. Councilman Korpal seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY, THE NEW JERSEY, INDIANA AND ILLINOIS RAILROAD COMPANY AND THE INDIANA NORTHERN RAILROAD COMPANY TO PROVIDE AND MAINTAIN FLASH LIGHT SIGNALS AND SHORT ARM GATES AT THE GRADE CROSSING OF THE TRACKS OF SAID RAILROADS WHERE THE SAME INTERSECT WITH SOUTH W!ILNUT STREET FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that the ordinance be referred to the Committee of the Whole on July 23rd. Councilman Korpal seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REQUIRING THE NEW YORK CENTRAL RAILROAD COMPANY, THE PENNSYLVANIA RAILROAD COMPANY AND THE NEW JERSEY, INDIANA AND ILLINOIS RAILROAD COMPANY TO PROVIDE AND MAINTAIN AUTOMATIC FLASH LIGHT SIGNALS AND SHORT -ARM GATES AT THE GRADE CROSSINGS AT THE TRACKS OF SAID RAIL- ROADS WHERE THE SAME INTERSECT'WITH KEMBLE AVENUE AND WITH PRAIRIE AVENUE FOR THE PROTECTION OF HUMAN LIFE, PROVIDING FOR PENALTIES FOR THE VIOLATION THEREOF, AND REPEALING ALL ORIDINANCES IN CONFLICT HEREWITH. The ordinance was 'given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance bee referred to the Committee of the Whole on July 23rd. Councilman Bestle seconded the motion. Motion carried. UNFINISHED BUSINESS Councilman Glass made a motion that the Clerk notify Mr. John M. Bowman, Superintendent of Power Plant of the Studebaker Corporation, to appear at next meeting of the Council to give a report on what has been done about the escaping steam from the power house on Sample St. Councilman Muszynski seconded the motion. Motion carried. NM BUSINESS Councilman Korpal made a motion to have Mr. Ernest Miller, Traffic Engineer, appear at the next meeting of the Council relative to the city's legal right to require lower speed for trucks in the 1900 and 2000 block of West Indiana Avenue. Councilman Muszynski seconded the motion. Motion carried. There being no further business, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Muszynski.
