President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Meeting of May 28th, 1951. Councilman Muszynski made a motion that the report be accepted. Motion carried. PETITION To the City Planning Commission South Bend, Indiana CLEM NIEZGODSKI ) STANLEY C. KORPAL ) Committee A. P. KEMPER ) CHESTER MUSZYNSKI ) Councilman Tellson seconded the motion. The undersigned, St. Joseph Cemetery & Undertaking Association, hereby requests that the following described real estate located in the City of South Bend, St. Joseph County, State of Indiana, to wit: Lot Numbered Sixty -four (64) Commissioner's Subdivision of Bank Out Lots Eighty -five (85) and Eighty -six (86) which real estate is situated immediately to the rear of the property now occupied by this petitioner at 1233 Western Avenue in the City of South Bend, Indiana, be changed from "B" residential, "A" height and area`to "C" commercial, "D" height and area. That said tracts of land are adjacent to each other and comprise approximately three- quarters of a full city block in the City of South Bend and which said realty extends north from Calvert Street in the City of South Bend on the West side of Franklin Street and is now occupied by the said corporations, and is zone as Light Industrial and as E Height and Area District. 4. That your petitioners are desirous of changing the classification in said area from E Height and Area District to F Height and Area ' District but do not desire to change the zoning classification of Light Industrial. 5. That your petitioners believe that a change of the said Height and Area classification from E to F of said real estate in the area, not only will not injure in valuation the surrounding properties but will enhance the value thereof and permit your petitioners fuller and freer use of their property to the best advantages 6. PETITION HONORABLE COMMON COUNCIL OF THE CITY OF SOUTH BEND CITY HALL May 16, 1951 SOUTH BEND, INDIANA IN THE MATTER OF APPROPRIATION NO. E -11 (SERVICES PERSONAL) PROBATION DEPARTMENT Honorable Dear Sirs: Councilman Korpal Request is herewith made for an additional appropriation of Nine Hundred Twenty -three ($923.50) Dollars under Appropriation Number E -11 (Services Personal) to become effective on and after July 1, 1951. This request is based on Sections four (4) and seven (7) of House Enrolled Act Number 180 passed by the Eighty - Seventh Session of the General Assembly of the State of Indiana and signed by the Honorable Henry F. Sehricker, Governor, on March 89 1951; a copy of such act being attached hereto, made a part hereof and marked "Exhibit A". Such request is also supported by the petition of twenty - freeholders of St. Joseph County, Indiana, in accordance with the provisions of Section three (3) of said Act, such petition being attached hereto and made apart hereof and marked "Exhibit B" for the information and guidance of this honorable council. Since the Adult Probation Officer of the City Court of South Bend has had no direct increase under statutory regulation since 1925 and since the work of this Probation Officer has been constantly on the increase without benefit of any assistants, it is felt that the compensation of such officer has for several years last past been entirely inadequate considering the duties, decisions and responsibilities incumbent upon him and would, there- fore, merit favorable consideration. REPORT OF THE BOARD OF PUBLIC WORKS AND SAFETY TO MEMBERS OF THE COMMON COUNCIL: Gentlemen: May 31, 1951 The Board of Public 'Works and Safety is in receipt of a letter from the New York Central System, relative to complaints lodged against them by the Board. In this letter, dated May 22, 1951, they state that their Engineering Department has, for the past several days, been actively engaged in repairing grade crossings in South Bend, although they have been somewhat handicapped by bad weather. They further state, that they have issued instructions to their switching crews to avoid blocking of crossings so as not to interfere with traffic, particularly during the hours when people are going to and from work. Councilman Bestle seconded the motion. Motion carried. Councilman Glass made a motion that representatives of the New York Central Railroad appear at the next Council meeting on June 25th. Councilman Muszynski seconded the motion. Motion carried. 726 REGULAR MEETING JUNE 11TH, 1951 REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: June llth, 1951 Your Committee of the Whole to whom was referred "An Ordinance appropriating from the General Fund of the Civil City of South Bend, Indiana, the sum of Nine Hundred ($'900.00) Dollars, to the Engineering Department, and declaring an extraordinary emergeney't. Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. ORDINANCE NO. 3824 AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND, INDIANA, THE SUM OF NINE HUNDRED ($900.00) DOLLARS, TO THE ENGINEERING DEPARTMENT, AND DECLARING AT EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Eyler). ORDINANCE AN ORDINANCE FIXING THE ANNUAL SALARY OF THE SOUTH BEND, INDIANA, CITY COURT PROBATION OFFICER; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF NINE HUNDRED TVIENTY -THREE DOLLARS AND FIFTY CENTS ($923.50) OF THE 1951 BUDGETARY ITEM, SERVICES PERSONAL, IN THE OFFICE OF CITY JUDGE; REPEALING ANY AND ALL CONFLICTING ORDINANCES, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on June 25th. Councilman bestle seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 MUNICIPAL CIVIL CITY BUDGET OF THE CITY OF SOUTH BEND, INDIANA; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF ONE THOUSAND SIX HUNDRED ($1,600.00) DOLLARS, TO CERTAIN _. OTHER BUDGETARY ITEMS OF THE 1951 BUDGET OF SAID CITY, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Bestle made a motion that the ordinance be referred to the Committee of the Whole for public hearing on June 25th. Councilman Korpal seconded the motion. Motion carried. There being no further business, Councilman Glass made a motion to adjourn, which motion was seconded by Councilman Korpal. Motion carried, and Council adjourned at 8:50 P.M. ATTEST: APPROVED:
