HomeMy WebLinkAbout04-23-51 Council Meeting MinutesREGULAR MEETING APRIL 23RD, 1951 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, April 23rd, 1951, at 8:17 P.M., with all members present. President Niezgodski presided. REPORT OF COMMITTE9 ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspect the minutes of the previous meeting of the Council and found them correct. KEMM Councilman Muszynski made a motion that the report be accepted. Councilman Kemper seconded the motion. Motion carried. PETITION.,,, Petition for rezoning lots from commercial to A residential district from Meade Street West to Kaley Street on West Ford Street. We the undersigned hereby favor this petition. (8 Signers) Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Erler seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE 'WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance of the City of South Bend, Indiana, authorizing the issuance and sale of bonds of said City for the purpose of providing funds to be applied on the cost of construction and improvement of streets, and expenses incurred in connection therewith". Respectfully report- that they have examined the matter and that in their opinion this ordinance go to the Council r as favorable.' STANLEY C. KORPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. MEETING REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1951 South Bend, Indiana, Civil City Budget; and appropriating from the General Street and Traffic Fund of said city the sum of one thousand four hundred ($1,400.00) Dollars, to certain other budgetary item of the 1951 budget of the Civil City of South Bend, Indiana, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Niezgodski seconded the motion. Motion carried. Councilman Tellson seconded the motion. Motion carried. ORDINANCE AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF FIVE HUNDRED THOUSAND DOLLARS ($500,000.00) TO BE APPLIED ON THE COST OF CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on May 14th. Councilman Bestle second the motion. Motion carried. ORDINANCE AN ORDINANCE REDUCING A CERTAIN ITEM IN THE 1951 SOUTH BEND, INDIANA:, CIVIL CITY BUDGET: AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF ONE THOUSAND ($1,000.00) DOLLARS TO,A CERTAIN OTHER BUDGETARY ITEM OF THE 1951 BUDGET OF THE CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that the ordinance be referred to the Committee of the Whole for public hearing on May 14th. Councilman Tellson seconded the motion. Motion carried. ORDINANCE NO. 3812 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF SAID CITY FOR THE PURPOSE OF PROVIDING FUNDS TO BE APPLIED ON THE COST OF CONSTRUCTION AND IMPROVEMENT OF STREETS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The City Clerk presented to the Council proof of publication and posting of notice of the public hearing on the ordinance proposed to be passed and authorizing the issuance and sale of bonds of said City for the purpose of providing funds to be applied on the cost of construction and improvement of streets and expenses incurred in connection therewith. On motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved. The presiding officer then announced that the Council was ready to hear all taxpayers interested in the said ordinance. After hearing all taxpayers desiring to be heard on said ordinance, Councilman Albert Tellson moved that Ordinance No. 3812 be read a third time in full and placed upon its final passage. This motion was seconded by Councilman Stanley Korpal and unanimously carried. The Clerk then read Ordinance No. 3812 in full and Councilman Cloyd Bestle moved that the ordinance be adopted as read. This motion was seconded by Councilman Walter Erler and on call of the roll was passed on the following vote: Ayes: Councilmen Clem Niezgodski, Stanley Korpal, Albert Tellson, Cloyd Bestle, Walter Glass, Alvin Kemper, Walter Erler and Chester Muszynski. Nays: None The presiding officer declared said ordinance to have been duly passed and adopted. Councilman Stanley Korpal thereupon introduced Ordinance No. 3816 entitled "An Ordinance of the City of South Bend, Indiana, appropriating the sum of Five Hundred Thousand Dollars ($500,000.00) to be applied on the cost of construction and improvement of streets, and expenses incurred in connection therewith ", and moved that the Clerk be instructed to read said ordinance in full. This motion was seconded by Councilman Walter Erler and carried. The Clerk then read said ordinance in full. 715 Y' REGULAR MEETING APRIL 23RD, 1951 Councilman Chester Muszynski then moved that Ordinance No. 3816 be read a second time by title, and that an opportunity be given for the offering of• amendments, which motion was seconded by Councilman Cloyd Bestle and carried. The Clerk then read Ordinance No. 3816 the second time by title and no amendments were offered thereto. Councilman Stanley Korpal then moved that said ordinance be carried over for further consideration until a meeting of the Council to be held on the 14 day of May, 1951, and that a public hearing be held on said ordinance at that meeting; that the City Clerk be instructed to publish a notice to taxpayers of such public hearing once each week for two weeks in the South Bend Tribune and South Bend Record, the same being newspapers published in the City of South Bend and representing the two leading political parties, and to post said notice in three public places in said City, the first publication and posting to be at least ten (10) days prior to said date. This motion was seconded by Councilman Cloyd Bestle and on call of the roll was adopted by the following vote: Ayes: Councilmen Clem Niezgodski, Stanley Korpal, Albert Tellson, Cloyd Bestle, Walter Glass, Alvin Kemper, Walter Erler and Chester Muszynski. Nays: None The presiding officer declared said motion carried and instructed the City Clerk to publish and post notice of said public hearing as provided in the foregoing motion. ORDINANCE NO. 3813 AN ORDINANCE APPROVING A CONTRACT DATED APRIL 2, 1951, BETWEEN THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, AND THE DEPENDABLE DISPOSAL COMPANY, INC. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3814 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 SOUTH BEND, INDIANA, CIVIL CITY BUDGET; AND APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF SAID CITY THE SUM OF ONE THOUSAND FOUR HUNDRED ($1,400.00) DOLLARS, TO CERTAIN OTHER BUDGETARY ITEM OF THE 1951 BUDGET OF THE CIVIL CITY OF SOUTH BEAD, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3815 The ordinance was for suspension of 8 ayes - 0 nays. The ordinance was AN ORDINANCE APPROVING A CONTRACT DATED APRIL 16, 1951, BETWEEN THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH ITS BOARD OF PUBLIC WORKS AND SAFETY, AND REITH -RILEY CONSTRUCTION COMPANY. given first reading.by title and second reading in full. Councilman Muszynski made a motion rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of given third reading and passed by a roll call vote of 8 ayes - 0 nays. UNFINISHED BUSINESS Councilman Korpa% made a motion that the Board of Works endeavor to bring about repairs of rough crossings at the Calvert Street, Indiana Avenue, Ewing Avenue of the Pennsylvania Railroad, Olive and Sample Street of the New York Central system, and remedy traffic snarls caused by switching operations. Councilman Glass made a motion to reactivate the railroad committee. Councilman Muszynski seconded the motion. Motion carried. Councilman Muszynski made a motion that the Board of Public Works notify the Police Department to station an officer to enforce the speed law on West Indiana Avenue between Walnut and Olive Streets. Councilman Korpal seconded the motion. Motion carried. There being no further business, Councilman Tellson made a motion to adjourn, which motion was seconded by Councilman Korpal.
