President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Tellson seconded the motion. Motion carried. C OMMUIT ICAT I ON Mayor G. Schock City of South Bend, Indiana Dear Sir: March 25, 1951 313 North Johnson St. South Bend 19, Indiana This will inform you of T.V.I.L.S. (Television Interference Location Service) a television and radio service operated by me before being called to active duty with "the United States Army. , In an article in the South Bend Tribune today you stated a proposed ordinance that will delegate Mr. Herb Harrison Chief Electrical Inspector with finding Interference and to quote, "His department has the equipment for finding it" To the best of my knowledge this is false. I believe Mr. Harrison personally owns any such equipment and it is not the property of the City of South Bend. I would like a letter to that effect. I am now stationed at Camp Atterbury, Indiana. After my service is no longer required by tie U.S. Army I will continue the Television Interference Location Service. I wish this letter be read into the record at the Council Meeting on Monday night. I-do not think it fair that the City of South Bend is going into a Radio and Television b''usiness. As a graduate Television Technician I do not see how the city can expect to fine a person for interfering with a television program when that program is received in South Bend by a freak of nature. Evidently the Council does not know that South Bend is outside the range of a Television Station and whence all the interference results. Respectfully yours, Cpt. Joseph A. REGULAR MEETING MARCH 26TH, 1951 PETITION To the Common Council of South Bend South Bend, Indiana March 21, 1951 Gentlemen: We, the undersigned, being the owners of the real estate in South Bend known as Lots 9, 10, 11 and 12 in Rockstroh Bros. Addition to the City of South Bend, Indiana, do respectfully petition the Common Council to change the zoning of Lots 9, 10, 11 and 12 from C Height and Area to E Height and Area, and Lot 12 from B Residential to C Commercial. (4 Signers) Councilman Tellson made a motion that the petition be referred to the City Plan Commission. Councilman Korpal seconded the motion. Motion carried. PETITION To the City Council of the City of South Bend, Indiana Honorable Sirs: We, the undersigned, owners in fee of the herein following described real estate in Homeland Second Addition to the City of •South Bend respectfully request the changing of the City Zoning Ordinance as to the above described real estate from C use district and D height and area district regulation to B use district and A height and area 'district regulation. (13 Signers) Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Bestle seconded the motion. Motion carried. REPORT OF THE C OPfflMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance fixing the salaries of certain City Officials and Employees of the City of South Bend, Indiana, effective January 1, 1952, and repealing all ordinances and parts of ordinances in conflict therewith ". Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Erler made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. " REPORT OF THE COM�.RITTEE OF THE WHOLE. To the Common Council of the City of South bend: Your Committee of the Whole to whom was referred "An Ordinance ordering and providing for the sale of the following described real estate in the City of South Bend, St. Joseph County, Indiana, to -w.it: Beginning at the Southwest corner of Lot Numbered G2 in Wenger and Kreighbaums Vistula Avenue Addition to the City of South Bend, Indiana, thence Northerly parallel with the East line of Lincoln Way East 136.7 feet; thence East 30 feet; thence North 50 feet; thence East to the St. Joseph River; thence Southwesterly to a point directly Fast of the place of beginning; thence West to the place of beginning, subject to the right of the City of South Bend to construct an interceptor sewer across said land at the approximate location and depth as shown on the plans for the interceptor sewer in the Engineer's Office of said city. Respectfully report that they have examined the matter and that in their opinion this ordinance go to the Council as favorable. STANLEY C. REPORT OF COMMITTEE To the President and Members of the City Council: We examined the conditions relative to the re- zoning of the block south of Sherwood Street to Chippewa Avenue on South Michigan Street, and we recommend that the zoning not be changed at this time, as the only commercial property in that vicinity is the Vialz Garage at 3423 South Michigan Street. Councilman Erler made a motion that Attorney John Montgomery's request for the withdrawal of his petition be granted, and that the ordinance be stricken from the file. Councilman Tellson seconded the motion. Motion carried. REGULAR MEETING REPORT OF CITY PLAN COIDAISSION To the Common Council City of South Bend, Indiana Gentlemen: MARCH 26TH, 1951 Petition of Bela and Mary Keresztes for change of zoning of Lot #2 in Citizens Homes Co. Replat of Lots No. 1, 2, 3, 4, 21 and 22 in Walnut 4th Addition from C commercial and D height and area district to B residence and A height and area district has been given public hearing by the City Plan Commission. This change is recommended as petitioned for. This lot is on North side of Prairie Avenue East of Jackson Street. This lot is near the lots petitioned for change by Alex Kovacsics et. al. and the change is the same so all of these can be included in the same ordinance. CITY PLAN COMMISSION By: D. Moomaw, Secretary Councilman Korpal made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Alex Kovacsics et. al. for change of zoning of Lots #49 and 52 in Whiteman's First Addition and Lots #59, 60, 85, 88 and 89 in Prairie Avenue Heights Addition from C commercial and D height and area districts to B residence and A height and area districts has been given public hearing by the City Plan Commission. This change is recommended as petitioned for. These lots are in the 1900 and 2000 block Prairie Avenue. They are not continuous along the street but the City Plan Commission is studying the zoning in that area with the idea cf changing other lots on those blocks residential. CITY PLAN COMMISSION By: D. Moomaw, Secretary Councilman Korpal made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. ORDMANCE NO. 3805 " AN ORDINANCE FIXING THE SALARIES OF CERTAIN CITY OFFICIALS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, EFFECTIVE JANUARY 1, 1952, AND REFE ALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3806 AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF THE FOLLOWING DESCRIBED REAL RESTATE IN THE CITY OF SOUTH BEND, ST. AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lot on the North side of Prairie Avenue East of Jackson Street) The ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. 7 0'7 ORDINANCE NO. 3808 AN ORDINANCE AMEY DING ORDINANCE NO. 3702 OF THE ORDINANCES OF THE CITY OF SOUTH BEND, INDIANA. (Lots are in the 1900 and 2000 block Prairie Avenue) MARCH 26TH, 1951 The ordinance was given first reading by title and second reading in full. Councilman Kemper made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1951 SOUTH BEND, INDIANA, CIVIL CITY BUDGET; AND APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF SAID CITY THE SUM OF ONE THOUSAND FOUR HUNDRED ($1,400.00) DOLLARS, TO CERTAIN OTHER BUDGETARY ITEM OF THE 1951 BUDGET OF THE CIVIL CITY OF SOUTH BEND, IN- DIANA, AND DECLARING AN EXTRAORDINARY MERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal Tn de a motion that the ordinance be referred to the Committee of the Whole for public hearing on April 9th. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REGULATING THE INSTALLATION, UTILIZATION AND MAINTENANCE OF OUTSIDE ANTENNA FOR TELEVISION RECEIVING APPARATUS OR EQUIPIvENT, REQUIRING PERMITS AND CERTIFICATES OF APPROVAL AND PROVIDING FOR THE MANNER AND FEES FOR OBTAINING SAME; AND PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE. The ordinance was given first reading by title and second reading in full. Councilman Erler made a motion that the ordinance be referred to the Committee of the Whole for public hearing on April 9th. Councilman Tel.lson seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REGULATING THE USE OF EQUIPMENT, APPLIANCES, DEVICES OR APPARATUS WHICH INTERFERE WITH THE TRANSMISSION, RECEPTION OR COMMUNICATION BY RADIO OR TELEVISION, AND PROVIDING A PENALTY FOR THE VIOLATION OF THE SAME. The ordinance,was given first reading by.title and second reading in full. Councilman Erler made a motion that the ordinance-rbe referred. to. the Committee of the Whole for public hearing on April 9th. Councilman Bestle seconded the motion. Motion carried. There being no further business, Councilman Erler made a motion to adjourn, which motion was seconded by Councilman Tellson. Motion carried, and Council adjourned at 9:00 P.M.
