REGULAR MEETING MARCH 12TH, 1951 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, March 12th, 1951, at 8::12 P.M., with all members present except Councilman Glass. President Niezgodski presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspecte the minutes of the previous meeting of the Council and found them correct. COMMUNICATION Common Council City of South Bend South Bend, Indiana Gentlemen: jCommittee Councilman Tellson seconded the motion. Motion March 12, 1951 Your memorandum to the Board of Public Works and Safety relative to the complaint received by you from Mr. Charles Anderson on bus service on the Corby Street bus line, please be advised that we informed the Northern Indiana Transit, Incorporated, of said complaint. A letter addressed to the Board of Public Works and Safety was presented to the Board at their regular meeting on this date in which Northern Indiana Transit, Inc., indicated that the same drivers have operated the Corby Street bus line for a considerable length of time and the only time they are late is when some condition beyond their control affects the operation. Relative to Mr. Anderson's complaint that proper signs were not placed on the busses, the bus company further indicated that they necessarily place a cardboard sign in the lower right- hand windshi*ld due to the rotation of busses caused by mechanical breakdowns and /or servicing. It would not be r feasible to add "Corb.y" t o all of their destination sign curtains. However, Northern Indiana Transit, Inc., will see that these cardboard signs are properly placed and maintained. Motion carried: f REGULAR MEETING MARCH 12TH, 1951 PETITION. TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND The undersigned respectfully petitions the Common Council of the City of South Bend to change the name of that portion of 24th Street extending from the North line of Jefferson Boulevard North to the South line of McKinley Avenue from its present name of 24th Street to the name of Tuxedo Drive, and in support thereof submits the following: 1. That the portion of 24th Street as described above now dead ends at Jefferson Boulevard on the South and McKinley Avenue on the North. Bishop John F. Noll, Bishop of the Fort Wayne Diocese of the Roman Catholic Church is the owner of the land lying on the South side of Jefferson Boulevard just South of that portion of 24th Street referred to in this petition and a new church has recently been built upon this land. The land to the North of McKinley Avenue is owned by Morris Park Country Club and is now unplatted. The name of 24th Street does not appear on any plat of real estate lying North of McKinley Avenue. 2. While there is a 24th Street lying South of the Grand Trunk Western Railway Company right -of -way, the street so named and there located lies considerably to the East of that portion of 24th Street referred to in this petition, and by reason of the intervening land owned by Bishop John F. Noll, hereinabove described, that portion of 24th Street referred to in this petition does not now form a part of and can never form a part of the 24th Street to the South. 3. There is now street lying North of Jefferson Boulevard and West of that portion of 24th Street referred to in this petition now carrying a numerical designation. 4.' The majority of the platted real estate bordering that portion of 24th Street herein referred to in this petition has long been known as the Tuxedo Park Addition, and the name of Tuxedo Drive would be better suited to the area and would be more appealing. 5. The undersigned presently owns or is purchasing under contract approximately two-thirds (2/3) of the land bordering upon that portion of 24th Street referred to in this petition, and believes that the name of Tuxedo Drive would be a more suitable name and would better foster the development of this area for residential purposes. 6. No dwelling houses or other improvements of any kind are at present constructed on that portion of 24th Street referred to in this petition, and a change of name would not as a consequence cause any inconvenience or require any change of address. The power to change street names being vested in the Common Council this petition is, for the reasons above noted, being respectfully submitted to you. C. HARRY SWANSON, INC. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance appropriating from the General Fund of the Civil City of South Bend, Indiana, the sum of Six Hundred ($600.00) Dollars, to the Public Health Clinic, Department of Health, and declaring an extraordinary emergency ". « Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. REPORT OF THE COMPJIITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance appropriating from the General Fund of the Civil City of South Bend, Indiana, the sum of Four Thousand Five Hundred ($4,500.00) 'Dollars, to the Office of the Board, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. Councilman Muszynski seconded the motion. Motion carried. REGULAR MEETING REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: MARCH 12TH, 1951 Petition of 0. J. and Mabel F. Hine for change of zoning of Lots No. 4, 5, and 6 in J. E. Walz Revised Addition from B residence and A height and area districts to C commercial district was given public hearing before the City Plan Commission March 1, 1951. The City Plan Commission recommends that this change be made to C commercial and E height and area districts. The petition omitted the height and area district appropriate for the C commercial classification and the City Plan Commission recommends the E height and area district to agree with that of nearby commercial territory. CITY PLAN COMMISSION These lots are on the west side of Michigan Street next south D. Moomaw, Secretary of Sherwood Street. Councilman Muszynski made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 OF THE ORDINANCES OF THE CITY OF SOUTH BEND, INDIANA. (Lots No. 4, 5 & 6 in J. E. Walz Revised Addition) The ordinance was given first reading by title and second reading in full. Councilman Erler made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried. Councilman Erler withdrew his motion for suspension of rules. Councilman Tellson withdrew his second. Councilman JErler made a motion that this ordinance be held in Council until next meeting on March 26th. Councilman Bestle seconded the motion. Motion carried. President Niezgodski appointed Councilmen Kemper and Korpal to investigate the above petition for rezoning and report back on their findings to the Council on March 26th. ORDINANCE AN ORDINANCE FIXING THE SALARIES OF CERTAIN CITY OFFICIALS AND EMPLOYEES OF THE CITY OF SOUTH BEND, INDIANA, EFFECTIVE JANUARY 1, 19529 AND REPEALING`ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for public hearing on March 26th. Councilman Bestle seconded the motion. Motion carried. ORD DAANC E . ''" AN ORDINANCE ORDERING AND PROVIDING FOR THE SALE OF THE FOLLOWING DESCRIBED REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, TO -WIT. Beginning at the Southwest corner of Lot Numbered G2 in Wenger and Krieghbaums Vistula Avenue Addition to the City of South Bend, Indiana, thence Northerly parallel wit# the East line of Lincoln Way East 136.7 feet; thence East 30 feet; thence North 50 feet; thence East to the St. Joseph River; thence Southwesterly to a point directly East of the place'of beginning; thence West to the place of beginning, subject to the right of the City of South Bend to construct an interceptor sewer across said land at the approximate location and depth as shown on the plans for the interceptor sewer in the Engineer's Office of said City. The ordinance was given first reading by title and second reading in full. Councilman Erler made a motion that the ordinance be referred to the Committee of the Whole. ORDINANCE NO. 3802 AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND, INDIANA, THE SUM OF FOUR THOUSAND FIVE HUNDRED ($4,500.00) DOLLARS, TO THE OFFICE OF THE BOARD, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance.was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Glass). 703 REGUTA R MEETING MARCH 12TH, 1951 ORDINANCE NO. 3803 ORDINANCE AMENDING ORDINANCE NO. 2336 OF THE ORDINANCES OF THE CITY OF SOUTH BEND, INDIANA, AND PROVIDING FOR A CHANGE OF NAME OF A PART OF 24TH STREET IN SAID CITY. The ordinance was given first reading by title and second reading in full. Councilman Kemper made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 1 absent (Glass). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Glass). ORDINANCE NO. 3804 AN ORDINANCE APPROVING A CONTRACT MADE AND ENTERED INTO ON BEHALF OF THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH THE BOARD OF PUBLIC WORKS AND SAFETY, AND THE.ENGLEWOOD ELECTRICAL SUPPLY COMPANY, INC., $7,331.28. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 1 absent (Glass). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Glass). OPINION OF CITY ATTORNEY RELATIVE TO PROPOSED SALARY CHANGES OF PARK DEPARTMENT Mr. Frederick K. Baer; City Attorney, advised the Council that increase in salary to employees of the Park Department cannot be made after the budget is approved. Councilman Erler made a motion that the attorney's opinion be accepted and a notation be placed in the minutes. Councilman Korpal seconded the motion. Motion carried. UNFINISHED BUSINESS Councilman Tellson made a motion that the Board of Works notify the Northern Indiana Transit, Incorporated, to place signs on the front and side of the Corby Street bus. Councilman Korpal seconded the motion. Motion carried. There being no further business, Councilman Muszynski made a motion to adjourn, which motion was seconded by Councilman Erler.
