JOSEPH) SS: CALL FOR SPECIAL MEETING CITY OF SOUTH BEND ) To the President, and Members of the Common Council of the City of South Bend, Indiana: Gentlemen: You are hereby notified that under and by virtue of the authority vested in me by law as Mayor of the City of South Bend, in the State of Indiana, a Special Meeting of the Common Council of said City is hereby called to meet in the Council Chamber, in the City Hall at the hour of 8:00 o'clock P.M., Central Standard Time, on Tuesday, February 13th, 1951, for the purpose of considering and taking action upon the following ordinances, petitions and reports, to -wit: "An Ordinance appropriating from the General Fund of the Civil City of South Bend, Indiana, the sum of Four Thousand Five Hundred ($4,500.00) Dollars, to the Office of the Board, and declaring an extraordinary emergency ", ALSO "An Ordinance approving contracts made and entered into on behalf of the City of South Bend, Indiana, by and through the Board of Public Works and Safety, and Maxim Motor Company, $17,997.73; Englewood Electric Company, $9,579.60; Reid - Holcomb Co., Inc., $9,800.00; Ben Medow, Inc., $13,085.08; and Fabric Fire Hose Company, $4,648.00 ", ALSO "An Ordinance approving contracts made and entered into on behalf of the Water Works Department of the City of South Bend, Indiana, by and through the Board of Water Works Commissioners, and the Burroughs Adding Machine Company, $4,888.80 ", ALSO "Three (3) Ordinances amending Ordinance No. 3702, commonly known as the Zoning Ordinance ", ALSO "Petition and Ordinance of Crown Development Co., for annexation of land ", ALSO �r "Petition for Rezoning of Lot 2, Citizens Home Company Replat of .Lots No. 1, 2, '3, 4, 21 and 22 of-Walnut 4th Addition ", ALSO "Four (4) Financial Reports of City Controller for 1950 ", ALSO "Annual Report of City Clerk for 1950 ". The Chief of Police or any member of the Police Force is hereby directed to forthwith serve a copy of this notice on each and every member of the Common Council and make due return of such service of said Special Meeting. SPECIAL MEETING REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: FEBRUARY 13TH. 1951 Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. PETITION To the Common Council of the City of South Bend; Indiana Gentlemen: We, the undersigned, Bela Keresztes and Mary Keresztes, owners of Lot No. 2, Citizens Home Company Replat of Lots No. 1, 2, 3, 4, 21 and 22 of Walnut 4th Addition to the City of South Bend, Indiana, respectfully petition your Honorable Body to amend Ordinance No. 3702, commonly known as the Zoning Ordinance of the City of South Bend, Indiana, from "C" commercial and "D" Height and Area District to "B" Residence and "A" Height and Area District. PETITION- Members of the Common Council of the City of South Bend, South Bend, Indiana. Gentlemen : As,the agent and attorney for the Crown Development Company, Inc., an Indiana corporation, and the owner of all the land described in the enclosed Ordinance, you are hereby respectfully petitioned to adopt an Ordinance annexing the land described in the enclosed Ordinance. As stated above, I am enclosing herewith twelve (12) copies of said requested Ordinance. Respectfully yours, (Signed) Joseph A. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: The accompanying Ordinance for change of zoning of Lots 112, 113, 114, 115, 116, 119, 120, 121, 122, 151, 152, 153'; 154, 157, 158, 159, 160, 161 and 162 in Linden Place Addition from C con-nercial district to B residence district was given public hearing before the City Plan Commission on February 1, 1951. The proceedings for this change originated in the City Plan Commission who now recommend that this change be made as indicated in the ordinance attached hereto. Respectfully yours, D. Moomaw, Secretary These lots are on Sibley Avenue between College and Brookfield Streets Lot 111 Linden Place Addition which is also in this group was changed to residential classification by Ordinance No. 3792. Councilman Erler made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. ORDINANCE NO. 3796 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lots No. 1129 113, 114, 115, 116, 119, 120, 121, 122, 151, 152, 153, 154, 157, 158, 159, 160, 161 and 162 in Linden Place Addition) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent (Beetle). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent ( Beetle). SPECIAL MEETING FEBRUARY 13TH, 1951 REPORT OF CITY PLAN CCWAISSION To the Common Council City of South Bend Gentlemen: Petition of Edgar Anderson and Leo Jasinski for change of zoning of Lots No. 1241 and 1242 in Summit Place 3rd Addition from C commercial and D height and area districts to B residence and A height and area districts was given public hearing before the City Plan Commission February 1, 1951. This change is recommended as petitioned for. Respectfully yours, D. Moomaw, Secretary These lots are at the southeast corner of Ford and Liberty Streets and adjacent to the lots changed to residential classification by Ordinance No. 3762. Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. ORDINANCE NO. 3797 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lots No. 1241 & 1242 in Summit Place 3rd Addition) The ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Kemper seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent (Bestle). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Bestle). REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Louis and Florence Stoll for change of honing of Lots No. 1 and 2 in Mayr's Michigan Avenue Addition from,B resident and A height and area districts to C commercial and D height and area districts (later amended to E height and area district) was given public hearing before the City Plan Commission. This change is not recommended. Respectfully, D. Moomaw, Secretary These lots. are on the north. side of Lincolnway West between Johnson and O'Brien Streets. The attached remonstrance shows the objections raised by the owners of property in the vicinity of these lots. Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. ORT?TNANCR. AN ORDINANCE AMENDING ORDINANCE NO. 37020 ADOPTED JUNE 139 1949, AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (Lots 1 & 2 in Mayr's Michigan Avenue Addition) The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Erler seconded the motion. Motion carried by a roll call vote of 7 ayes 1 absent (Bestle). The ordinance was given third reading and lost by a roll call vote of 0 ayes - 7 nays - 1 absent (Bestle). REPORT OF THE CITY CLERK OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1950. The reading of the report of the City Clerk for the year 1950 was waived. Councilman Muszynski made a motion that the report be accepted. Councilman Korpal seconded the motion. Motion carried. Councilman Glass seconded the motion. Motion carried. ORDDINANCE NO. 3798 AN ORDINANCE APPROVING CONTRACTS MADE AND ENTERED INTO ON BEHALF OF THE WATER WORKS DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH THE BOARD OF WATER WORKS COMMISSIONERS, AND THE BURROUGHS ADDING MACHINE COMPANY, $4,888.50. The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent (Bestle). The ordinance was-given third reading and passed by a roll call vote of 7 ayes - 1 absent (Bestle). ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND, INDIANA, THE SUM OF FOUR THOUSAND FIVE HUNDRED ($4,500.00) DOLLARS, TO THE OFFICE OF THE BOARD, AND DECLARING AN EXTRAORDINARY EMERGENCY. The,.- ordinance was-?given first-reading by title and second reading in full. Councilman Erler made a motion that the ordinance be referred to the Committee of the Whole for public hearing on February 26th, at 8:00 P.M. Councilman Glass seconded the motion. Motion carried. NEW BUSINESS Councilman Korpal made a motion that the bus company be notified to continue service in Edison Park until a permanent answer to the problem can be found. Councilman Muszynski seconded the motion. Motion. carried. The.Chair appointed Councilman Muszynski, Chairman of the Transportation Committee, to attend the meeting with Board of Public Works and bus company next Monday, February 19th. Councilman Glass made a motion that the Clerk notify the Power Engineer of the 'Studebaker Corporation to appear before the next meeting of the Council relative to escaping steam which destroys vision of motorists driving along Sample Street. Councilman Muszynski seconded the motion. Motion carried. There being no further business, Councilman Erler made a motion to adjourn, which motion was seconded by Councilman Tellson.
