HomeMy WebLinkAbout12-11-50 Council Meeting MinutesING DECEMBER 11TH, 1950 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, December 11th, 1950, at 8:12 P.M. with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. KORPAL ) Councilman Tellson made a motion that the report be accepted as read. Councilman Kemper seconded the motion. Motion carried. PETITION STATE OF INDIANA ) SS: COUNTY OF ST. JOSEPH ) To the City Plan Commission of the City of South Bend: The undersigned Louis Stoll and Florence Stoll, husband and wife, hereby petition for the change of zoning classification of the following described real estate situated in the City of South Bend, St. Joseph County, State of Indiana, to -wit: Lots Numbered One (1) and Two (2) in Mayr's Michigan Avenue Addition to the City .of South Bend, from "B" use District and "A" Height and Area District, to "C" Commercial use District and "D" Height and Area District, and in support of said petition respectfully show to your Honorable Body that they are the owners in fee simple of said above described real estate, that said lots are situated in the middle of the block on the north side of the 2100 block of Lincoln Way West between North Johnson Street on the east, and North O'Brien Street on the west; that said lots are improved with a house and garage at this time; that the real estate on Lincoln Way West in the block immediately east of said property is zoned commercial; that many of the lots in the vicinity of the subject real estate are now used for commercial purposes. WHEREFORE, petitioners pray that the City Plan Commission take appropriate action to effect said zoning changes and file herein a proposed form of ordinance for submission to the Common Council. PETITION Common Council''of the City of South Bend South Bend, Indiana Gentlemen: The South Bend Brewing Company respectfully asks that a change be made in the Zoning Ordinance No. 3702, by rezoning the following property, that at present is zoned "B" residence and "A" height and area district, to -wit: Lots 1, 2 and 3,in Rupel's Addition to the City of South Bend, to "C" commercial and "E" height and area district, and respectfully shows that said property is located at the southwest corner of the intersection of College Street and Lincolnway West, in the City of South Bend, is vacant at the present time and unfit for a residence district, due to the fact that it is across the street from a brewery building and immediately across the alley north of the bottling house; that the property south of it and west of it is now zoned "C" commercial, and the property across the street to the north is "C" commercial. REPORT OF CITY PLAN COMMISSION To the Common Council City.of South Bend Gentlemen: December 11, 1950 The accompanying ordinance is for making certain changes in the Zoning Ordinance of South Bend. The City Plan Commission has had public hearing on this ordinance and its passage is recommended. D. Moomaw, Secy. Councilman Kemper made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. (Continued) ..681 I I REGULAR MEETING DECEMBER 11TH, 1950 ORDINANCE NO. 3790 AN ORDINANCE AMENDING ORDINANCE NO. 3702 PASSED BY THE COMMON COUNCIL JULIE 13, 1949 AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. RESOLUTION A RESOLUTION REQUESTING CONVEYANCE OF WAR HOUSING PROJECTS FOR LOW RENT USE TO THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND WHEREAS, the United States of America, acting through the Housing and Home Finance Agency, Public Housing Administration, owns permanent war housing now known as PHA Project No. 12021 consisting of 55 dwelling units, and PHA Projects Nos. 12183 and 12188 consisting of 150 dwelling units located in the City of South BeAd, State of Indiana; and WHEREAS, such housing is no longer needed for purposes of war; and WHEREAS`; there exists in said City a need for such housing to be operated as low -rent public housing at rents within the.means of low- income families, especially families of living or deceased veterans and servicemen -, whit need is not being met by private enterprise, and WHEREAS, such a condition constitutes a menace to the health, safety, morals, and welfare of the inhabitants of the City, and WHEREAS, the Congress of the United States has authorized by Public Law 475, approved by the President April 20, 1950, the conveyance to a public housing agency of such housing to provide housing for families of low income and, the Housing Authority of The City of South Bend proposes to acquire such housing and to operate it as low - rent housing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section.l. That it is the determination, finding, and declaration of the City Council of the City of South Bend, Indiana, that it will be in the best interests of the community to make such housing available as low - rent housing for families of low income. Section 2. That the City Council of the City of South Bend, Indiana does hereby request the conveyance of such housing to the Housing Authority of The City of South Bend to be administered as low -rent housing for families of low income. Section 3. This resolution shall be in.full force and effect from and after its passage. Councilman Kemper made a motion that the resolution be tabled. Councilman Bestle seconded the motion. Motion lost by a r611 call vote of 4 ayes (Erler, Bestle, Glass and Kemper); 4 nays (Korpal, Tellson, Niezgodski and Mus zynski) . Councilman Niezgodski made a motion that the resolution be held in Council for further study. Councilman Muszynski seconded the motion. Motion - carried b a roll call vote of 7 ayes (Erler, Korpal, Tellson, Bestle, Niezgodski, Glass and Muszynski) - 1 nay (Kemper- There being no further business, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Tellson.
