OCTOBER 23RD. 1950
Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the
Council Chamber, Monday, October 23rd, 1950, at 8:10 P.M. with all members present. President Erler presided.
REPORT OF COPIMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Councilman Niezgodski made a motion that the report be accepted. Councilman Kemper seconded the motion.
Motion carried.
PETITION
To the Common Council
City of South Bend, Indiana
The undersigned, owners of more than 50 per cent of the property herein described, respectfully petition your
honorable body to amend Ordinance No. 3702, commonly known as the Zoning Ordinance of the City of South Bend,
Indiana, as it applies to the height and area district classification of Lots No. 5, 6, 7 and 8 in Rockstroh
Bros. Addition, changing the same from C height and area district to E height and area district.

Councilman Tellson made a motion that the petition be referred to the City Plan Commission. Councilman Korpal
-secondo'd'the motion. Motion carried.
PETITION
IN THE MATTER OF THE REZONING OF LAND LYING
NORTH OF SAMPLE STREET BETWEEN KENMORE AVENUE AND
GLADSTONE AVENUE.
Petitioners allege:
1. Colpaert Realty Corporation is the owner in fee simple of the following described real estate, to -wit:
Lots numbered 376, 3779 485, 486, 4879 488, 489, 490, 594, 598, 5009, 600, 601, 602,
7099 710, 711, -712, 713 and 714 as shown on the Recorded Plat of Belleville third Unit,
an Addition to the City -of South Bend.
Portage Really Corporation is the owner in fee simple of the following described real estate, to -wit:
Section G as shown on the recorded Plat of Belle Village, an Addition to the City of South Bend.
3. Belleville Investment Company is the owner in fee simple of the following described real estate, to -wit:
Section H as shown on the recorded Plat of Belle Village, an Addition to the City of South Bend.
4. Colpaert Realty Corporation is the owner in fee simple of the following described real estate, to -wit:
Lots numbered 210 and 211 as shown on the recorded Plat of Belle Village, an Addition to the
City of South Bend;
and Belleville Investment Company is the owner in fee simple of the following described real estate, to -wit:
Lot numbered 212 as shown on the recorded Plat of Belle Village, an Addition to the City of
South Bend.
5. All of said real estate is presently zoned "D ". Light Industrial and "E" Height and Area.
6. Lots numbered 488, 489, 490, 597, 598, 599, 600, 601, 602, 709, 710, 711, 712, 713 and 714 as shown on the
recorded Plat of Belleville Third Unit and Lots numbered 210, 211 and 212 as shown on the recorded Plat of
Belle Village all have been improved with residences and should be rezoned to "B" Residence and "A" Height
and Area.
7. Lots numbered 376, 377, 378, 485, 486 and 487 as shown on the recorded Plat of Belleville Third Unit and
Section G and Section H as shown on the recorded Plat of Belle Village should consistently therewith be
rezoned "Ci" Commercial and "E" Height and Area.
8. Petitioners attach hereto and file herewith a sketch of said real estate shaded to show the changes sought
to be effected by this petition.
WHEREFORE, petitioners pray that the Plan Commission take appropriate action to effect said zoning changes and
file herewith a proposed form of ordinance for submission to the Common Council.

Councilman Korpal made a motion that the petition,be referred to the City Plan Commission. Councilman Muszynski
seconded the motion. Motion carried.

REPORT FROM CITY ATTORNEY
With respect to the Oliver Corporation drop hammer, Mr. Baer advised the Council that inasmuch as the corporatic
property is legally zoned heavy industrial and has been for many years, the corporation is within its rights to
operate heavy industrial machinery on its premises and the Council cannot act against it either under state Jaws
or city ordinances. Mr. Baer also states that if any action can be taken it must be on the initiative of
individuality aggrieved persons who must file suits against the corporation on the grounds that the noise
constitutes a private nuisance injurious to them separately or severally.
NEW BUSINESS
Residents from the 1000 and 1100 blocks of South Main Street, South Lafayette Boulevard and South Franklin
Street appeared before the Council to stop Studebaker Corporation employees from parking in frontof their homes.
Councilman Glass rra de a motion that this situation be referred to the Traffic and Transportation Committee to
make a thorough study to see what can be done. Councilman Bestle seconded the motion. Motion carried.
There being no further business, Councilman Niezgodski made a motion to adjourn, which motion was seconded by
Councilman Bestle. Motion carried, and Council adjourned at 9:55 P.M.
