President Erler presided. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Board of Public Works and Safety City of South Bend, Indiana Gentlemen: October 6, 1950 Your letter of October 5th, enclosing copy of a motion made at a meeting of the Common Council of the City of South Bend on September 23rd, relative to smoke from three New York Central switch engines, has been referred to the proper authorities for attention. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Members of the Common Council Council Chambers, City Hall City ,of South Bend, Indiana Gentlemen:`, September 29, 1950 The Board of Public Works and Safety has authorized the installation of street lights at the following locations, upon the- recommendation of Mr. Qualls: 11 - 4000 lumen lights in Belleville Unit A 10 - 4000 lumen lights in Garden Village lst Unit 8 - 4000 lumen lights in Replat of LaSalle Park 2nd The above lights were requested by the Colpaert Corporation for their new housing developments in the Western part of the city. REPORT OF BOARD OF PUBLIC WORKS-AND SAFETY Members of the Oommon Council `Council Chambers, City Hall September 29, 1950 City of South Bend, Indiana Gentlemen: The Board of Public Works and Safety has authorized the installation of street lights at the following locations: Thirty- fourth Street between Washington and Marshall Streets; Thirty - fourth and Marshall Streets; Olive and Keller Streets; Donald and Robinson Streets; Walnut Street between Colfax and Linden Avenue; Diamond Avenue between Lincoln Way West and Van Buren Street; Poplar'Street at the alley dead -end; McKinley and Eddy Streets; McKinley and Arthur Streets. Mr. Qualls informed the Board that the street lights on Lafayette Boulevard at the entrance of the Temple Beth E1 on Lafayette and the main entrance on Madison Street have been installed and are now in service. (Continued) REPORT OF BOARD OF PUBLIC WORKS AND SAFETY (Continued) Mr. Qualls also informed the Board that a street light at Washington and Huey Streets has been installed and is now in service; and, a street light on Talbot Street between South Bend Avenue and Howard Street has been changed from a 1000 lumen light to a 4000 lumen light. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1950 South Bend, Indiana, Municipal Civil City Budget; and a propriating from the General Fund of said City the sum of Eleven Thousand and Eighty -two Dollars ($11,082.00; and also appropriating from the General Street and Traffic Fund of said City the sum of Four Thousand Nine Hundred Dollars ($4,900.00), all to certain other budgetary items of the 1950 budget of the Municipal Civil City of South Bend, Indiana, and declaring an extraordinary emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. ORDINANCE NO. 3781 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1950 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF ELEVEN THOUSAND AND EIGHTY -TWO DOLLARS ($11,082.00); AND ALSO APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF SAID CITY THE SUM OF FOUR THOUSAND NINE HUNDRED DOLLARS ($4,900.00), ALL TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1950 BUDGET OF THE MUNICIPAL CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call.vote of 6 ayes - 2 absent (Kemper and Tellson). }REPORT OF THE CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana October 9th, 1950 Gentlemen: Petition of Louis Fischer for change of zoning of Lots No. 30 and 31 and 32 in Pleasant Home Addition from B residence and A height and area districts to C commercial and D height and area districts was given public hearing before the City Plan Commission on September 7, 1950, pLnd this change is recommended as petitioned for. These lots form the west half of the block between Lawndale Avenue and Sancome Avenue on the North side of LaPorte Avenue. Yours truly, D. ORDINANCE NO. 3782 AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH B &TD, INDIANA. (Lots No. 30, 31 & 32 in Pleasant Home Addition) The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 6 ayes - 2 absent (Kemper and Tellson). The ordinance was given third reading and passed by a roll call vote of 6 ayes - 2 absent (Kemper and Tellson). REPORT OF THE CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: October 9th, 1950 Petition of Bertha Friedman for change of zoning of Lot No. 3 in John F. Kirby's Addition from D light industrial and E height and area districts to C commercial and D height and area districts was given Public Hearing before the City Plan Commission and this change is not recommended. REGULAR MEETI NG OCTOBER 9TH, 1950 ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lot No. 3 in John F. Kirby's Addition) The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion for suspension of rules. Councilman Bestle seconded the motion. Motion carried by a roll call vote of B ayes - 0 nays - 2 absent (Kemper and Tellson). The ordinance was given third reading and lost by a roll call vote of 0 ayes - 6 nays - 2 absent (Kemper and Tellson). NEW . BUS INESS - A number of residents in the 800, 900 and 1000 blocks of West Dunham Street appeared before the Council relative to heavy drop hammers in use in the new forge shop of the Oliver Corporation, keeping residents awake and loosening the plaster from the walls of their homes and destroying their chimneys. Councilman Niezgodski made a motion that this be referred to the City Attorney to determine whether the city government, through the . Council, has a legal right to step into the situation and report back to the Council October 23rd. Councilman Muszynski seconded the motion. Motion carried. There being no further business, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Glass. Motion carried, and Council adjourned at 9:30 P.M.
