REGULAR MEETING SEPTEMBER 25TH, 1950 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, September 25th, at 8:20 P.M. with all members present. President Erler presided. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Motion September 21, 1950 I wish to P_xpress my appreciation for your consideration in granting the change of zoning on September 11, 1950 of Lots 269 27 and 28 Bartlett's First Addition to the City of South Bend, from "B" residential and "C " height and area district to 11C -11" commercial and "E" height and area district. Personally I was primarily interested in the rezoning of Lot 26 for the benefit of the Doctors purchasing this lot. However I am sure the Doctors, and the other property owners, join me in thanking you and your Honorable Board, for your consideration and approval of this change. I also wish to thank Mary Viski in Mayme DuMont's City Clerks Office for the attention and assistance given me in this office. Yours Respectfully, (Signed) Roy F. PETITION To the Members of the Common Council South Bend, Indiana rGentlemen September 20, 1950 We, the undersigned, owners of the fee' simple title to the following described real estate respectfully petition the Common Council to rezone the same from "B" use district and "B " height and area district to "C " use district and "F" height and area district: All of Lots Numbered Six (6) and Seven (7), including the alley between the same heretofore vacated, of Burrough's Sub - division to the City of ` South Bend, Indiana, excepting the south thirty -six (36) feet of both lots Six (6) and Seven (7) and that portion of the vacated alley between the same, which excepted portion is now zoned "C" use district and "F" height and area district. For your information, the above described real estate is a small parcel situated on the west side of Williams Street between the Welsheime# Funeral'Home and short Navarre Street. (Continued) Im MEET ING SEPTEMBER 25TH. 1950 (Continued) ii Upon the completion'of the extension of Williams Street froVM 940eet north to Navarre Street, all of the real estate on the west side of Williams Street from the alley south of Marion Street north to Navarre Street was, on the 28th day of July, 1926, by Ordinance No. 2569, zoned "C" use district and "F" height and area district. Subsequently thereto, for reasons wholly unknown to these petitioners, the real estate above described, was changed to "B" use district and "B" height and area district under Ordinance #3236, dated November, 1937. We are respectfully requesting that the above real estate be rezoned to conform to the original plan of the City aforesaid, and in conformity with all other real estate on that side of Williams Street. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Members of the Common Council Council Chambers,, City Hall City of South Bend, Indiana September 11, 1950 Gentlemen: The Board 'of Public Works and Safety has authorized the installation of street lights at the following locations: Catalpa and Cotter Streets; Catalpa and Leon Court; Kendall Street and Ewing Avenue; Calvert and Carroll Streets. Mr. Qualls informed the Board that the street lights at the following locations have been installed and are now in service: Twenty - eighth Street and Nursery Court; Frances and Napoleon Streets; Madison Street curve at entrance to Morris Golf Club; Calvert and Hoke Streets; Tweyckenham Drive at end of Miner Street. Mr. Qualls also informed the Board that the street light on Sample Street between Harris and Kosciusko Streets has been changed.to a 4000 lumen light. REPORT OF BOARD^POF PUBLIC WORKS AND SAFETY Members of the Common Council City Hall South Bend, Indiana September 25, 1950 Gent lemen: ` Y Upon receipt of your memo of September 13, 1950, relative to the obnoxious odor of gas from the Northern Indiana Public Service Company, east side plant, the Board of Public Works and Safety directed that the said Northern Indiana Public Service Company have a representative of their company appear before the Board at their meeting of September 25. Accordingly, Mr. Ralph Davenport, Superintendent of the plant and Mr. Dan Kreitzman, Division Manager, appeared before the Board on this date. Counciiman Walter Glass was also present at this meeting. The representatives of the gas company informed the Board that natural gas will be piped into South Bend in the not too distant future, which will eliminate the processing of gas that is presently being done in the local plant. Until such time as the natural gas can be piped in, however, they assured the Board they would do everything in their power to try to eliminate the objectionable odors. REPORT OF HEALTH DEPARTMENT Members of the Common Council City Hall South Bend, Indiana Gentlemen: September 25, 1950 Your memo relative to food discarded from lunch wagons in the vicinity of South Lafayette Boulevard and Garst Street, addressed to the Board of Public Works and Safety was referred to the Health for investigation and report. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: September 25, 1950 Your Committee of the Whole to whom was referred "An Ordinance reducing a certain item in the 1950 South Bend, Indiana, Municipal Civil City Budget, in the Police Department; and appropriating from the General Fund of said City the sum of Six Thousand Seven Hundred Dollars ($6,700.00), all to certain other budgetary items of the 1950 budget of the Municipal Civil City of South Bend, Indiana, and declaring an extraordinary emergency. Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE N0..3780 AN ORDINANCE REDUCING A CERTAIN ITEM IN THE 1950 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET, IN THE POLICE DEPARTMENT; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF SIX THOUSAND SEVEN HUNDRED DOLLARS ($6,700.00), ALL TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1950 BUDGET OF THE MUNICIPAL CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. . The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1950 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET; AND APPROPRIATING FROM THE GENERAL FUND OF SAID CITY THE SUM OF ELEVEN THOUSAND AND EIGHTY -TWO DOLLARS ($111082.00); AND ALSO APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF SAID CITY THE SUM OF FOUR THOUSAND NINE HUNDRED DOLLARS ($4,900.00), ALL TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1950 BUDGET OF THE MUNICIPAL CIVIL CITY OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion r _that the ordinance be referred -to the Committee of the Whole for public hearing on October 9th. Councilman Tellson seconded the motion. Motion carried. NEW BUSINESS President Erler reported on the activities of the.,Anti -Air Pollution Committee. Councilman Glass made a motion that the Committee continue to work along the line recommended by Mr. Lammers, Chairman of the National Coal Producers Committee for Smoke Abatement, and a copy of this report to be incorporated in the minutes. Councilman Tellson seconded the motion. Motion carried. REPORT OF ANTI -AIR POLLUTION COMMITTEE: Your Committee for anti -air pollution has studied the anti -air pollution problem for approximately one year. During this time considerable technical material on air pollution has been collected, including anti -air pollution ordinances passed by other- cities. With the cooperation of the Engineers Club, Mr. Harrington one of the outstanding combustion engineers in the country and technical adviser to Department of Smoke Inspection for the City of Chicago, addressed a meeting here. Mr. H. B. Lammers, Combustion Engineer, Chairman of the National Coal Producers Committee for smoke abatement addressed a public meeting in the Council Chambers on June 16, 1949. Mr. Lammers and his committee have written anti -smoke ordinances for approximately 65 cities including Toronto, Philadelphia, Columbus, Niagara Falls, and many others which have proved successful. This was done only after a survey was made of each city. They have agreed to do the same for South Bend, under the conditions set forth in the following letter. We have also been promised the cooperation of the Combustion Engineers of,South Bend. It has been estimated by Lammers that much of the coal burning equipment in South Bend is 25 to 30 years old. This has been the experience in many other cities. Progress the past winter in smoke abatement has been beset with some difficulties due to the coal strike. Indiana Statutes require Indiana coal be used in Public Buildings. Some of our public buildings of South Bend are the worst offenders, especially the school buildings. The City, therefore, has the responsibility of cleaning up its own smoke. Some progress has been made in isolated cases by the City appealing to individuals to clean up there own smoke. The Penn. Railroad which have been using three coal burning engines in their switch yards have replaced two with an oil burning engine and have promised to replace the others. The New York Central Railroad Co. is planning to replace all the coal burning engines with oil burners. W. C. Erler, Chairman Anti -Air Pollution Committee . REGULAR MEETING Mr. Walter C. Erler East Indiana Ave. South Bend, Indiana Dear Mr. Erler: SEPTEMBER 25TH. 1950 June 20, 1949 664 On the occasion of my visit to South Bend the other evening I promised I would send you a tentative program which you might use. It would be somewhat along this line: 1. Establish a Civic Committee on which are represented all walks of life. This would encompass organizations such as Chamber of Commerce, University, College, Real Estate, building owners and managers, women civic groups, retail merchants, civic organizations such as Kiwanis, Rotary and Lions, League of Women Voters, Parent - Teachers Association, Engineering Society, Planning Commission, hotel associations, N.A.P.E., church federations, rail- roads, etc. Note: This would give anyone desiring membership a voice in the civic program. 2. Set up a sub - committee of technical experts in heavy industry who known their specific problems to better advantage than would people on the above civic committee. 3. After the initial meeting of the above #1 committee have them go forth to the various organizations to enlist aid and assistance in your smoke program. 4. Have the committee call in representatives of industry, railroads, etc. to determine how much improvement can be secured on the basis of cooperation. 5. Naturally all of the above items should receive publicity through the medium of the newspapers and radio. 6. Call in people who are responsible for the operation of fuel burning plants and equipment such as found in schools, public buildings, city hospitals, etc. Explain the program to them and secure their cooperation. Note: One cannot over- emphasize the importance of placing the city's own house in order as an initial effort. 7. Determine definitely by means of a survey whether you have a problem, how serious it is and how dirty South Bend might be. With these facts before the civic committee they are in a position to determine just how much improvement they desire and is necessary together with the type of legislation which should be provided. 8. Continued education is necessary. We could conduct educational courses including illustrated lectures for various types of plant operators, including lectures before civic and engineering organizations. 9. We have available a series of articles on smoke abatement and combustion that is available for your newspapers. You may want to.use this series.- 10. The program should be kept as free from politics as much as possible. Remember this is an engineering job. Your city can be as clean as you,want it. However, the civic committee must determine whether there is real or , imaginary interest in air pollution and whether the city will support the plan it has outlined. I fee]6ertain that if all procedures outlined above have been employed the city will support any intelligent plan adopted. However, it does take a budget, a staff and continuous support to put this program over. After you have had an opportunity to get the above recommendations lined up and if and when you require assistance let us know. It was indeed a pleasure to meet you and the other Councilmen and I believe the method of approach you are employing i-tigurs well for the program. Very truly yours, (Signed) H. B. Lammers, Chairman NEW BUSINESS Councilman Muszynski made a motion that the Board of Public Works take up the matter with the New York Central regarding smoke from three switch engines No. 7352, 7426 and 9596, which are constantly throwing out heavy black smoke. These engines are in the vicinity of Ford and Koscuisko Street crossing. Councilman Niezgodski seconded the motion. Motion carried.
