President Erler presided. REPORT OF CCUMITTEE ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: Petition of Jacob Wild and Vincent K. Kaniewski for change of zoning of Lot 19 and Ej of Lot 20 in Evans Sub- division of B.O.L. 88 together with the property on the south side of West Washington ,avenue for a distance of 173.85 feet east from the alley on the east side of the aforesaid Lot 19, from B residence and B height and area districts to C commercial and E height and area districts has gone.through Public Hearing on August 3, 19509 before the City Plan Commission and this change is recommended to the Council as requested in the petition. This property is on the south side of !test Washington Avenue in the 1000 block and includes the Public Natatorium. DM;ag Yours truly, D. ORDINANCE NO. 3774 AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Property on the south side of West Washington Ave. in the r 1000 _block and includes the Public Natatorium) The ordinance was given-first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays• The ordinance was given third reading and passed by'a roll call vote of 8 ayes - 0 nays. REGULAR MEETING AUGUST 28TH, 1950 REPORT OF CITY_.PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen:: At the August 3, 1950 meeting of the City Plan Commission, after public hearing, it was unanimously recommended that the Zoning Ordinance of South Bend, Ordinance No. 3702 be amended to admit all buildings or uses which are publicly owned and involving public health, welfare or safety to all use districts of the city. The City Attorney has been asked to prepare such an ordinance. Yours truly D. Moomaw,ecretary Councilman Glass made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TO AMEND SECTION 3, SECTION 4 -A, OF ORDINANCE NO..3702, ADOPTED BY THE COMMON COUNCIL. ON -JUNE 13, 1949, C3MON1,Y_KN0 X.AS THE ZONING ORDINANCE, AND ADDING THERETO SECTION 17 -A. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be referred to the next Council meeting on September 11th. Councilman Tellson seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: August 28th, 1950 Your Committee of the Whole to whom was referred "An Ordinance appropriating moneys for the purpose of defraying the expenses of all budget - operated departments of the "Civil City of South Bend, Indiana, for the fiscal year beginning January 1, 1951, and ending December 31, 1951, including departments, funds and commissions for which money is appropriated, in whole or in part, from funds other than the general funds of said city, to wit: Street, Traffic and Park. Departments, Firemen's Pension and Policemen's Pension Funds, and the City Plan Commission: providing that such appropriations shall include all outstanding claims and obligations: fixing the salaries of all City Officials and Employees: repealing all ordinances and parts of ordinances.in conflict herewith: providing a- time when the same shall take effect ". Respectfully report that they have examined the matter and that in their opinion the item in the Police Department the number of patrolmen in Account No. P -11 should be amended to read 109 in the total sum of $387,386.00; and the following items in the Park Department, to -wit: Account No. 43, Drives and lklks, be amended to read 42,000.00 and Account No. 711, Building and Fixed Equipment,.be amended to read.16,810.00; and Account No. 726, Other Equipment, be amended to read $2,591.00; and that so amended the ordinance be reported to the Council favorable. ORDINANCE NO. 3775 (AS AMENDED) AN ORDINANCE APPROPRIATING MONEYS FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF ALL BUDGET - OPERATED DEPARTMENTS OF THE CIVIL CITY OF SOUTH BEND, ..INDIANA, FOIL. 'THE FISCAL YEAR- BEGINNING.JANUARY 1,.1951, AND.ENDING.DECEMBER 31, 1951, INCLUDING DEPARTMENTS, FUNDS AND COMMISSIONS: " FOR WHICH MONEY IS.APPROPRIATED, IN WHOLE 0R.IN PART, FROM FUNDS OTHER THAN THE GENERAL FUNDS OF SAID CITY, TO WIT: STREET, TRAFFIC AND PARK DEPARTMENTS, FIREMEN'S PENSION AND POLICEMEN'S PENSION FUNDS, AND THE CITY PLAN COMMISSION: PROVIDING THAT SUCH APPROPRIATIONS SHALL INCLUDE ALL OUT- STANDING CLAIMS AND OBLIGATIONS: FIXING THE SALARIES OF ALL CITY OFFICIALS.AND.ENPLOYEES: REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT HEREWITH: PROVIDING A TIME WHEN- THE.SAME SHALL TAKE EFFECT. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: August 28th, 1950 Your Committee of the Whole to whom was referred "An Ordinance fixing the Tax Levy for the year 1951 for the Municipal Civil City of South Bend, Indiana". Respectfully report that they have examined the matter and that in their opinion the tax levy be amended as follows:: General Fund to read $.973; Street and Traffic Fund to read .021; Park Maintenance Fund to read .135; Firemen's Pension Fund to read .07; Police Pension Fund to read .038; Total of levy to read 1.488, and that the ordinance as amended be reported to the Council favorably. ORDINANCE NO. 3776 (AS AMENDED) AN ORDINANCE FIXING THE TAX LEVY FOR THE YEAR 1951 FOR THE MUNICIVIPL CIVIL CITY OF SOUTH BEND, INDIANA. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. REGULAR MEETING ORDINANCE NO. 3777 AUGUST 28TH. 1950 AN ORDINANCE APFR OVING CONTRACTS MADE AND ENTERED INTO ON BEHALF OF THE CITY OF SOUTH BEND, INDIANA, BY AND THROUGH THE BOARD OF PUBLIC WORKS AND SAFETY, AND THOMAS L. HICKEY, INC., $22,449.00; AND VICTOR TRIPPEL, $4,582.00; AND H. G. CHRISTMAN CONSTRUCTION CO., $27,423.00; AND 0. J. SHOEMAKER, INC., $5,731.00; AND PETER SHOUMAKER & SONS, INC., $5,326.00; AND CARL J. REINKE & SONS, CONTRACTORS, 43,324.00. The ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. 'There being no further business, Councilman Tellson made a motion to adjourn, which motion was seconded by Councilman Niezgodski. Motion carried, and Council adjourned at 10:20 P.M.
