After reviewing the bids Mr. Jason Durr, Engineering, recommends that the Board award the contract to the lowest responsive and responsible bidder, Ziolkowski Construction, Inc., in the amount of$131,900.00, which is the base bid and alternate. Therefore, Mr. Gilot made a motion that the recommendation be accepted and the bid be awarded as outlined above. Mr. Littrell seconded the motion which carried. APPROVAL OF RECOMMENDATION - TO CLOSE STREET - PARK LANE BETWEEN LAFAYETTE AND MAIN - ANNUAL ICE CREAM SOCIAL Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting,Police Department and the City Attorney's office, in reference to a request as submitted by Rebecca Amy Stickler,832 North Lafayette Boulevard,South Bend,Indiana,to conduct the above referred to block party on May 21, 2004, from 9 a.m. to 8 p.m. Upon a motion made by Mr. Inks, seconded by Mr. Littrell and carried, the recommendation was approved. ACKNOWLEDGMENT OF REQUEST - TO CONDUCT PICKET Mr. Gilot stated that the Board of Public 'Forks has acknowledged a request to conduct a picket, as submitted by Ms. Mary Cherry, 438 South Meade, South Bend, Indiana, May 24 to May 28, 2004 at 2201 Lincolnway West. The Board noted that the Board does not approve nor deny such requests; citizens have the right for a peaceful demonstration on the public right-of-way; a permit is not necessary. However, the Board asks that all citizens not impede pedestrian traffic or vehicular traffic, and that they do not obstruct the entrance to any businesses. Upon a motion made by Mr. Gilot, seconded by Mr. Inks and carried, the request was acknowledged. The Clerk was instructed to post the agenda and notify the media and other persons who have requested notice of the meeting agenda. No other business came before the Board. After reviewing those bids, Mr. Dillon recommends that the Board award the contract to the lowest responsible and responsive bidder, Best Equipment Company Inc., 2804 Catherwood Avenue, Indianapolis, Indiana, in the amount of$195,810.00. Therefore, upon a motion by Mr. Gilot, seconded by Mr. Littrell, and carried, the request to advertise for the receipt of bids was approved. REQUEST TO ADVERTISE FOR THE RECEIPT OF PROPOSALS - DEBT COLLECTIONS FOR 2004 - SOUTH BEND FIRE DEPARTMENT AMBULANCE PAST DUE ACCOUNTS In a memorandum to the Board, Chief Robert Quinn, Fire Department, requested permission to advertise for the receipt of proposals for past due ambulance accounts. Mr. Gilot noted that other departments are in need of this service and should be involved in the collections process. Mr. Gilot suggested an umbrella policy for all departments in need of collection services. Therefore, upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the request to advertise for the receipt ofproposals was approved,pending the involvement of Code Enforcement and Water Works. APPROVE FINAL CHANGE ORDER -PARKING STRUCTURE NO. i - PHASE I - KASER SPRAKER CONSTRUCTION - PROJECT NO. 103-038 FUND 305 Mr. Gilot advised that Mr. Toy Villa, Public Construction Manager, has submitted Change Order No. I (Final) on behalf of Kaser Spraker Construction, 2587 West State Road 2, South Bend, Indiana,with an increase of$716.00 and the contract sum including this Change Order in the amount of$373,656.00. APPROVAL OF RECOMMENDATION-TO CLOSE STREET-SOUTH STREET FROM MAIN TO LAFAYETTE-FIRE TRUCK MUSTER/COMMUNITY CELEBRATION - STUDEBAKER MUSEUM Mr. Gilot stated that favorable recommendations have been received by Traffic and Lighting,Police Department and the City Attorney's office, in reference to a request as submitted by Ms. Rebecca Bonham, 525 South Main Street, South Bend, Indiana, to conduct the above referred to event on June 26, 2004, from 7:00 a.m. to 5:00 p.m. Upon a motion made by Mr. Gilot, seconded by Mr. Littrell and carried, the recommendation was approved. FAVORABLE RECOMMENDATION-REQUEST TO VACATE AN ALLEY-NEAR 922 EAST INDIANA AVENUE Mr. Gilot indicated that Mr. Willis Collins, 922 East Indiana Avenue, South Bend, Indiana, has submitted a request to vacate the above referred to alley. Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. Economic Development stated that the vacation would prevent the properties on Dale Avenue from having access to the alley and building a fence does not seem to be a good reason to vacate. In addition, if this right-of-way is vacated, it be done so subject to any utility easements that are necessary. FAVORABLE RECOMMENDATION -_ REQUEST TO VACATE VARIOUS STREETS - ANGELA BOULEVARD FROM NOTRE DAME TO EDDY STREET AND EDDY STREET FROM ANGELA BOULEVARD SOUTH TO PROPOSED EDISON ROAD Mr. Gilot indicated that The University of Notre Dame, Notre Dame, Indiana, has submitted a request to vacate the above referred to streets. Mr. Gilot advised that the Board is in receipt of favorable recommendations concerning this Vacation. Petition from the Area Plan Commission, Police Department, Fire Department, Sanitation, Department of Economic Development and the Department of Public Works. The Area Plan Commission stated that the vacation would hinder the growth or orderly development of the unit or neighborhood in which it is located,would make access to the lands of the aggrieved person by means of public way difficult or inconvenient, and would hinder the use of a public way by the neighborhood in which it is located. The Board of Public Works gave a favorable recommendation for this street vacation subject to a delayed effect based on resolution from the City Council and the Mayor concurrent with similar actions from St. Joseph County. In addition, if these rights-of-way are vacated, they be done so subject to any utility easements that are necessary.
