REGUTA R MEETING APRIL 24TH, 1950 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, April 24th, 1950, at 8:26 P.M. with all members present. President Erler presided. REPORT OF C{iVIMITTEE ON MI1gUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. Councilman Korpal seconded the motion. Motion carried. REPORT.OF THE COMMITTEE OF THE WHOLE To the..Common Council of the City of the South Bend:. April 24, 1950 Your Committee of the Whole to whom was referred "An Ordinance of the City of South Bend, Indiana, appropria the sum of One Million Dollars ($1,000,000.00) to be applied on the cost of construction and improvement of sewers, and expenses incurred in connection therewith ". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bends April 24, 1950 Your Committee of the Whole to whom was referred "An Ordinance providing for the establishment of a bureau of fire prevention, providing officers therefor and defining their powers and duties, prescribing regulations for fire prevention and life safety, and prescribing penalties for the violation of its provisions ". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council favorable as amended. STANLEY C. KOWAL, Chairman Councilman Niezgodski made a motion that the report be accepted. Councilman Muszynski seconded the motion. Councilman Muszyr_ski seconded the motion. Motion carried. ORDINANCE N0. 3741 AN ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING THE SUM OF ONE MILLION DOLLARS ($100000000.00) TO BE APPLIED ON THE COST OF CONSTRUCTION AND IMP20VEMENT OF SEWERS, AND EXPENSES INCURRED IN CONNECTION THEREWITH. The City Clerk presented to the Council proofs of publication and posting of the notice of the public hearing on the appropriation proposed to be made for the purpose of paying the cost of construction and improvement of sewers in the City of South Bend, referred to in Ordinance No. 3741 which the Council did consider on first and second readings on the 10th day of April, 1950, showing that said notice had been published and posted at least ten days prior to this date. On motion duly made, seconded and unanimously carried, said proofs of publication and posting were approved. The Committee of the Whole reported on Ordinance No. 3741 entitled "An Ordinance of the City of South Bend, Indiana, appropriating the sum of One Million Dollars ($1,000,000.00) to be applied on the cost of construction and improvement of sewers and expenses incurred in connection therewith ", and recommended that said ordinance be amassed as" introduced. ,Y The presiding'"officer then announced that the Council was ready to hear all taxpayers interested on the question of the necessity-for the appropriation provided for in said ordinance. After hearing all taxpayers desiring to be heard on said ordinance Councilman Albert Tellson moved that Ordinance No. 3741 be read a third time in full and placed upon its final passage. This motion was seconded by Councilman Clem Niezgodski and unanimously carried. The Clerk then read Ordinance No. 3741 in full and Councilman Walter Glass moved that the ordinance be adopted as read. This motion was seconded by Councilman Stanley Korpal and on call of the roll was passed on the following votes: Ayes: Walter C. Erler, Stanley Korpal, Albert Tellson, Cloyd Bestle, Clem Niezgodski, Walter Glass, Alvin Kemper and Chester Muszynski. Nays' None The presiding officer declared said ordinance to have been duly passed and adopted. ORDINANCE NO. 3742 AN ORDDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lots B and C in :Davis Plat to the City of South Bend) The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE N0. 3743 AN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF A BUREAU OF FIRE PREVENTION, PROVIDING OFFICERS THEREFOR AND DEFINING THEIR POWERS AND DUTIES, PRESCRIBING REGULATIONS FOR FIRE PREVENTION AND LIFE SAFETY, AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ITS PROVISIONS. The ordinance was given third reading and passed by a roll wall vote of 8 ayes - 0 nays. 630 11 REGULAR MEETING APRIL 24TH, 1950 ORDINANCE N0. 3744 AN ORDINANCE APPROVING CONTRACTS 11ADE AND ENTERED INTO ON BEHALF F OF THE NEATER -WORKS UTILITY OF THE CITY OF SOUTH BEND, INDIANA, BY ITS BOARD OF WATER WONKS COMMISSIONERS, FOR THE FOLLOWING: CONTRACT DESCRIBED AS CONTRACT "NO. 1 -Bo WITH CAI, J. REINKE & SONS, OF SOUTH BEND, INDIANA, FOR THE Ct1TSTRUCTION OF ONE (1) WELL HOUSE, INCLUDING ALL APPURTENANCES, FOR THE SUM OF FIVE THOUSAND EIGHT HUNDRED FIFTY ($5,850.00) DOLLARS; AND�CONTRACTS DESCRIBED AS CONTPACTS "N0. 1 -A" AND "NO. 1 -C ", WITH LAYNE- NORTHERN COMPANY, INC., OF MISHAWAKA, IND., FOR THE CONSTRUCTION OF ONE (1) GRAVEL WALL TYPE WELL, INCLUDING ALL APPURTENANCES, FOR THE SUM OF TWELVE THOUSAND SIX HUNDRED TEN (12,610.00) DOLLARS; AND FOR INSTALLING ONE (1) DEEP WELL TURBINE PUMP, INCLUDING ALL ACCESSORIES AND APPURTENANCES, FOR THE SUM OF THREE THOUSAND NINE HUNDRED NINETY ($3,990.00) DOLLARS. The ordinance was given first reading by title and second-reading in full. Councilman Muszynski made a motion for suspension of rules. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE PROHIBITING THE SALE, LENDING, GIVING AWAY, OR POSSESSION OF OBSCENE, LEWD, INDECENT OR LASCIVIOUS PHONOGW. H RECORDS, SOUND TRANSCRIPTIONS, WIRE RECORDINGS OR SIMILAR DEVICE OR ARTICLES, AND PROVIDING PENALTIES FOR VIOLATION THEREOF. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance -be referred to the Committee of the Whole for public hearing on May 8th, 1950. Councilman Glass seconded the motion. Motion carried. There being no further business, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Tellson. Motion carried, and Council adjourned at 8x47 P.M.
