President Erler presided. Councilman Niezgodski made a motion to suspend the regular order of business. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. REPORT OF CCMMITTES ON MINUTES To the Common Council of the City of South Bend:: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meetings of the Council and found them correct. They therefore recommend that the same be approved. Meetings of January 23rd and February 27th, 1950- WALTER C. COMMUNICATION City Council South Bend, Indiana Gentlemen:_ January 27, 1950 This is to certify that we strongly object to the installation of parking meters on East 'Myne Street and South Carroll Street* We have, six employees who drive to work, and it is impossible for them to find a parking place within six blocks of -their work. COMMUNICATION Councilman Chester Muszynski c% City Hall North Main Street South Bend, Indiana Dear Councilman Muszynski: - t the last meeting of this organization, a motion was made and carried to protest the ineffectual snow :removal on Western Avenue, .particularly between Maple Street and Laurel Street. In clearing this one - horse, but main arterial highway, the snow plows deposited high banks of snow along the curbs, thereby causing a den gerous condition, not only for pedestrians crossing the street, but also to vehicle traffic, making parking along the curb a virtual impossibility. This letter to`�you, our councilman, was authorized in the hope that reoccurrence of such conditions will be eliminated on this narrow but important thoroughfare. COMMUNICATION Dear Councilman: The overwhelming defeat of socialized political housing as exhibited by the thorough, impartial and intensive public opinion poll recently conducted by the Tribune certainly merits the attention of and action from the City Council. This is a mandate from the people that cannot be ignored. Home owners and Taxpayers in every walk of life, from every political party and from every -corner of our city have expressed themselves in no uncertain terms. Elections have never been won or lost by such a majority as this crushing 3 -2 decision. This overwhelming expression of an aroused citizenry as expressed in this poll, as expressed by 6000 remonstrances signed by hote owners and filed with the council, and expressed by the ass Baling of the largest crowd of tax payers and home owners ever to converge on the Council Chambers two weeks ago should amply con- vince this council that South Bend wants no more of this socialistic experiment and demands that an immediate stop be put to the reckless spending by politicians which results in unbearable taxation. In light of the above facts the committee against Public Housing requests the Council to abrogate the contract it now has with the housing authority to construct socialized political housing on the so called "Kemble Avenue" and "Maggies Court" Sites. The city has the legal right to cancel such contract and should do so immediately if for no other reason than this contract only calls for 3f of the income in lieu of taxes. In other words a $15,000 public house on Kemble Avenue would pay $10.80 taxes yearly against $196 for a similar dwelling privately owned. The tax odds are 18 to 1 against the home owner. The Mayor has already promised the hundreds of citizens from the Southwest part of the City who stormed the City Hall in objection to the "Kemble Avenue" deal that he would stop the proposes? project. The Mayor has also stated that it is very questionable if it would be wise to bdild houses on "Maggies Court" in light of the widening of Western Avenue which is to start this year. The disgraceful $1marea of "Maggies Court" that the housing authority has owned for many years, and continued to rent after taking it off the tax rolls should be torn down. The remaining ground left after the widening of Western Avenue could be very advantageously used as a small park and playground dedicated to our veterans. We also propose that Kemble Avenue be made into a desirable park and playground dedicated to our veterans. If this does not meet with public approval then the site should be sold to citizens who will build their own homes which will be placed on the tax rolls thus making it another desirable community that pays its own way. SUNDAY'S Tribune specifically located the sites and builders of over 2000 new homes to be built this season in South Bend, of which over 300 are for rent. These new homes will take 2000 families from existing dwellings and will make their homes available to the less than 100 families now in "Maggies Court ". One builder is constructing 100 homes for colored that can be bought with small down payments. We believe it is the duty of the council to carry out the will of the people as set forth by their recent vote. We request you take immediate action on this proposal. We would not care to be in the politicians shoes that choses to ignore or evade the mandate of the aroused home owners and citizens of South Bend since they comprise over 70% of the voters. CITIZENS COMMITTEE AGAINST PUBLIC HOUSING By Joseph Wentland, Chairman Councilman Glass made a motion that the communication be referred to the committee on Public Improvements. Councilman Bestle seconded the motion. Motion carried. PETITION We, the property holders in the 2600 block Lincoln Way West, North side of street, hereby petition the Common Council to rezone the 260.0 block Lincoln Way West for commercial use. 9 Signers Councilman Niezgodski made a motion that the petition be referred to the City Plan Commission. Councilman Kemper seconded the motion. Motion carried. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Members of. the Common Council Council Chambers, City Hall City of South Bend, Indiana Gentlemen: February 10, 1950 The Board of Public Works and Safety has authorized the installation of three (3) street lights on Jefferson Boulevard, between Ironwood Drive and 26th Street in the vicinity of the new St. Anthony's Church. Mr. Qualls, Electrical Superintendent, has informed the Board that lights ordered in at Walnut and Poland Streets; Ford and Harris Streets; on West Poland at Trade Court and the Railroad Yards; St. Joseph and Oaksi de Streets; St. Joseph and Woodside Streets; and on Belmont Avenue East of Twyekenham Drive have all been install and are now in service. Councilman Bestle seconded the motion. Motion carried. REPORT OF BUILDING "DEPARTMENT FOR THE YEAR 1949 The reading of the report for the Building lepartment for the year 1949 was waived. REPORT OF TRAFFIC ENGINEER REGARDING RAILROADS AND BUS STOPS Honorable Common Council City of South Bend South Bend, Indiana Gentleman: February 17, 1950 The Board of Public Works and Safety asked that I make a progress report on.the following projects: RAILROAD: Short -arm gates, as agreed to in 1949, will be installed this year at the Logan Street and Grand Trunk Western Railroad and at the 26th Street and Grand Trunk Western Railroad Crossings. Large 18" x 42" reflectors are being made and will be installed on the center abutments of all railroad viaducts in the city. These reflectors should be ready for installation around February 23, 1950. In the meantime all present reflectors have been thoroughly cleaned for improved visibility. The New York Central System has promised to paint all their viaducts in the City of South Bend as soon as weather permits. The underside of these structures will be painted a light color for improved visibility at night. No definite commitment has been received from the Grand Trunk Western Railroad in regard to the painting of their viaducts. BUS STOPS: A poll of bus riders was conducted January 25 & 26, 1950 to determine if bus riders favor buses stopping at every block or every other block as at present. The survey was made by six persons who rode buses on all lines, a total of 96 hours. They interviewed 1,140 regular and -part time riders, or approximately two percent of the daily bus riders in both South Bend and Mishawaka$ The results showed that 78,7% or nearly 4 to 1 favored the "Skip Stop" or present system of bu"s stops. January 30, 1950 The attached summaries give results of the bus stop survey conducted January 25 and 26, 1950, to determine if bus riders favor buses stopping at every block or every other block as at present. The survey was made by six persons who rode buses on all lines, a total of 96 hours, and interviewed two per- cent of the daily bus riders. The results are summarized as to occupation of bus riders, part time and regular riders, as well as to various bus lines. In each case there is a destination made between South Bend and Mishawaka. The survey covered a total of 1,140 regular and part time riders in both South Bend and Mishawaka and showed that 78.7% or nearly 4 to 1 favor the "Skip Stop" or "present system of bus stops. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana March 3, 1950 Gentlemen: Petition of Ann Drout for change of zoning of Lots #89, 90, 91, 92, 939 940 95 and 96 in Lincoln Manor 2nd Addition from B residence and A height and area districts to C -1, limited commercial and D height and area districts was given public hearing by City Plan Commission on March 2, 1950. As this petition was originally filed it was for C commercial district. No action was taken and the petition was amended to change to C -1, limited commercial and D height and area districts. On the basis of the amended petition, the City Plan Commission, by a majority vote, recommends that the change be made. CITY PLAN COMMISSION These lots are on the north side of Westmore St. west By D. Moomaw, Seely. from Goodland'Avenue. Councilman Niezgodski made a motion that the report be accepted. Councilman Glass seconded the motion* Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lots 89, 909 91, 920 93, 94, 95 & 96 as shown on the Recorded Plat of Lincoln Manor 2nd Addition) The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion for suspension of rules. Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and lost by a roll call vote of 2 ayes - 6 nays (Korpal, Tellson, Bestle, Niezgodski, Kemper and Muszynski). REASON FOR DISAPPROVING SAID ZONING "The playground across the street,.is claimed to be hazardousjand that automobile traffic due to commercial area would be hazardous to children on the playground ". REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: February 3, 1950 Petition of Harlan E. Orr and Forest G. Hay for change of zoning of lots in Leepers 2nd Addition was given public hearing February 2, 19509 A minor change has been made in the details of the change to be made so that it may conform with actual conditions and without conflicting with the intent of the original petition. Lots 23, 240 25, 27, 28, 29, 30 and 31 in Leeper's 2nd Addition from A residence and A height and area districts to B residence and B height and area districts; Lot 26 in same addition, from C commercial and A height and area districts to B residence and B height and area districts. Motion carried. .615 REGULAR MEETING MARCH 13TH, 1950 NEW BUSINESS Councilman Glass made a motion that the Board of Public Works contact the officials of the bus company and see what can be done about additional busses and show cause why some of its equipment should not be replaced by more modern busses. Councilman Bestle seconded the motion. Motion carried. There being no further business, Councilman Korpal made a motion to adjourn, which motion was seconded by Councilman Glass.
