Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the
Council Chamber, Monday, January 9th, 1950 at 8s25 P.M. with all members present. President Erler presided.

Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Vie, the petitioners requesting the re- zoning of the lots in Lincoln Manor for the purpose of building a
Union Hall,. wish at this time to with -draw our request for the rezoning of our lots.

Dear Sirs:
The St. Joseph County Industrial Union Council demands that the busses stop at each corner. Also we wish to
know when the waiting roosts that were promised the bus riders some time ago will be furnished.
Your sincere consideration of the bus riders in these matters will be greatly appreciated.

Comes now Joseph J. Kopinski and Yaleria Koppinski, husband and wife, residents of the City of South Bend,
Indiana, and petition the Honorable Common Council of the City of South Bend to amend the Zoning Ordinance
of the City of South Bend, Number 3702, adopted June 13, 1949, by changing the zoning of Lots Numbered One
Hundred Forty -eight (148) and One Hundred Forty -nine (149) of Swygert "s Second Addition, from "B" and "A"
Height and Area Districts to "C" and "E" Height and Area Districts. The petitioners herein are owners of
said lots.

Respectfully report that they have examined the natter and that in their opinion this ordinance be referred
back to the City Plan Commission for the reason that people on Mishawaka Avenue do not want that type of
building across from Pottawatomie Park.

Attached hereto please find copies of reports submitted by Mr. X lliam Qualls, Electrical Superintendent.
Mr. Qualls informed the Board that lights ordered in at Ironwood Drive and Rockne :Drive; Ironwood Drive and
Corby Street; Corby and Eisenhower Streets; Flag Street and Eisenhower Street; Indiana Avenue and Magnolia
Street; Cushing Street and Bryan Street; Huron Street and Kenmore Street; Prairie Avenue and Morris Street;
Morris Street and Ewing Avenue; and a change from 1040 lumen light to 4000 lumen light at Donald and Morris
Street have been installed and are now in service*

Attached hereto please 'find copies of reports submitted by Mrs William Qualls, Electrical Superintendent for
street lights at the following locations: Chapin and Bruce Streets; Tasher and Jennings Streets; Alt geld and
Carroll Streets, Sherman Avenue and Culver Streets; at an alley intersection between-Howard and.Corby Street
running from Hill to Lawrence Street; Stover 'Court between Jefferson and Bayne Street; Bryan and Cushings
Streets; Studebaker and Fassnaeht Street; Elmer and Humboldt Streets; Carlisle and Linden Avenue; Huey and Prast
Boulevard.
Mr. Qualls informed the Board that lights ordered in at Olive and Bull& Streets; Lebanon Street between Indiana
Avenue and Broadway and 28th Street; 30th Street; 31st,Street; 32nd Street between Pleasant Street and North
Side Boulevard; and at the intersection of 29th Street and North Side Boulevard and 29th Street and Pleasant

MOTION
Councilman Glass made a motion that the regular order of business be suspended so that reports from City Plan
Commission pertaining to ordinances be read and immediately following the ordinance be given reading.
Councilman Niezgodski seconded the motion. Motion carried unanimously.
REPORT OF CITY PLAN COMV ISSION
To the Common Council
City of South Bend, Indiana
Gentlemens
January 6, 1950
The City Plan Commission has held.publie hearing on petition of The Light Co. Inc, for change of zoning of
an unplatted tract of land 192 x 160 on the south side of McKinley Ave. one half mile East of Ironwood Drive.
Petition asks for change of the present zoning as A residence and A height and area districts to C -1 commercial
and D height and area districts.
The City Plan Ommission recommends this change as petitioned for.
In the original zoning of the city a commercial area was made at this location but in the location of
McKinley Ave. to avoid low ground no part of the commercial area was left on the south side of the street.
This change will provide a small commercial area where it was originally intended to be.

`Councilman Tellson made a motion that the report be accepted. Councilman Muszynski seconded the motion. Motion
Councilman Tellson made a motion for a five minute recess. 'Councilman korpal- seconded the motion. Motion
carried.
ORDINANCE
AN ORDINANCE TO AMEND ORDINANCE N0. 3702, AS.AMENDED, WHICH
ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY
OF SOUTH BEND. (South side of McKinley Ave. ore half mile East
of Ironwood Drive)
The ordinance was given first reading by title and second reading in full. Councilman Kemper made a motion
that the petition be held up for further investigation. Councilman Bestle seconded the motion. Motion carried.

To the Common Council -
City of South Bend, Indiana January 6, 1950
Gentlemen-
A hearing has held on January 5, 1950 on petition of Frank A. Slaby, et al for change of zoning of Lots No.
1640 165, 166, 168 and 169 in Realty Construction Ca. -2nd Addition, Lots 390, 391, 392, 418, 419 and 420 in
2nd Plat of Summit Place, Lots 498 to 507 inclusive, 511 to 519 inclusive, 656 to 661 inclusive in the third
Plat of Summit Place.
This petition asks to change these lots from C commercial and D height and area districts to B residence and
A height and area districts.
These lots'frorb on Phillipa, Olive and Ford Streets between Phillipa St. and Meade St. and are now occupied
by residence buildings or are vacant.
This change is recommended as petitioned for. This change is one of many that should be made to place property
In the zoning classification that conforms with the nature of its occupancy. It is an up- grading of
classification for the protection of residence property.

The ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion
for suspension of rules, Councilman Niezgodski seconded the motion. Motion carried by a roll call vote of
8 ayes - 0 nays.
The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays.

AN ORDINANCE TO AMEND ORDINANCE NO. 3702, AS AMENDED, WHICH ORDINANCE

(Property fronting on the south side of Mishawaka Ave. 2141 feet and a depth
of 1016.4)
The ordinance was given third reading and lost by a roll call vote of 2 ayes - 5 nays (Eyler, Bestle,
Niezgodski, Glass, Kemper ) 1 Not Voting, Muszynski.
REASONS:
Councilman Glass made a motion that the ordinance be referred back to the City Plan Commission for the reason
that the people do not want that type of building across from Pottawanamie Park. Councilman Kemper seconded
the motion. Motion carried.

AN ORDINANCE AMENDING ORDINANCE N0. 3702 COMMONLY KNOWN AS THE

The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a
mot 9p._that the ordinance be referred to the Committee of the Whole for Public gearing on January 23rd, 1950'
Councilman Muszynski seconded the motion. Motion carried.

that the ordinance be referred to the Committee of the Whole for Public Hearing on January 23rd, 1950.
Councilman Kemper seconded the motion. Motion carried.
