Council Chamber, Monday, December 12th, 1949, at 8:12 P.M. with all members present. President Erler presided.
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
Your Committee on the inspection and supervision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the - Council and found them correct. They therefore recommend
that the same be approved.

Councilman Tellson made a motion that the report be accepted. .Councilman Muszynski seconded the motion.

PETITION
TO: THE COMMON COUNCIL OF THE, CITY OF SOUTH BEND, INDIANA.
Comes now ANN DROUT, your Petitioner herein and respectfully shows to your Board that sheds the fee simple
owner of the following described real estate located in the City of South Bend, St, Joseph County, Indiana,
viz:
Lots # 89, 90, 91, 92, 93, 94, 95 and 96 as shown
on the Recorded Plat of Lincoln Manor 2nd Addition
to the City of South Bend.
That said'real estate has heretofore been classified and zoned as "B" Residential and "A" Height and Area
Di st ri ct. _
YOUR PETITIONER respectfully prays that said property be zoned by your Board as Commercial and "E" Height and
Area District.
YOUR PETITIONER further shows to this Board that said real estate fronts on the North side Westmoor Street and
lies between Goodland Avenue and North Bendix Drive.

PETITION FOR AMENDMENT TO THE ZONING ORDINANCE OF THE
CITY OF SOUTH BEND, INDIANA, WHICH SAID ORDINANCE IS
MORE PARTICULARLY KNOWN AS ORDINANCE NO. 37029 FOR THE
CHANGE OF ZONING FROM C COMMERCIAL USE DISTRICT AND D
HEIGHT AND AREA DISTRICT TO B RESIDENCE USE DISTRICT
AND A HEIGHT AND AREA DISTRICT.
TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA:
The undersigned, being more than fifty percent (50 *) of the owners of the following described real estate in
the City of South Bend, St. Joseph County, Indiana, to -wits
Lots Numbered 164, 165, 166, 168 and 169 as shown on the
recorded Plat of Realty Construction Company's Second
Addition to the City of South Bend; Lots Numbered 390,
391, 392, 418, 419 and 420 as shown on the Recorded Second
Plat of Summit Place Addition to the City of South Bend;
Lots Numbered 498 to 507 inclusive, 511 to 519 inclusive
and 656 to 661 inclusive as shown on the recorded Third
Plat of Summit Place Addition to the City of South Bend,
Indiana,
do hereby respectfully petition that the aforesaid Ordinance No. 3702 be emended in order that the zoning of
the above described realty be changed from C Commercial Use District and D Height and Area District to B
Residence Use District and A Height and.Area District so that the aforesaid real estate will be adaptable
for the uses permitted by and -under said B Residence Use District and A Height and Area 'District and subject
to the restrictions pertaining thereto.
The above described real estate includes all realty which is presently zoned as a C Commercial Use District
and D Height and area District along Ford Street from the West line of Phillipa Street to the East line of
Meade Street except the following described realty on which permanently are located grocery store buildings.
(1) Lot Number 167 as shown on the Recorded
Plat of Realty Congtru6tion Company's Second
Addition to the City of South Bend. (This
realty is presently owned by Genevieve DeVos
and Mary Oskard).
(2) Lot Numbered 508 as shown an the recorded
Third Plat of Summit Place Addition to the City
of South Bend. (This realty is presently owned
by Walter J. Kapalcnynski and Julia Kapalczynski).
(3) Lots Numbered 509 and 510 as shown on the
recorded Third Plat of Summit Place Addition to
the City of South Bend. (This realty is presently
owned by Eugene L. Rysdork and Zora Rysdork, husband
and wife).
It is the intent and desire of the undersigned that the realty described under sub - paragraphs numbered (1) to
(3) above be retained as C Commercial Use since grocery store buildings are presently located on said realty
and such use would be beneficial for the B Residence Use to which the undersigned desire that the present
zoning be changed.

Gentlemen:
December 2, 1949
A hearing was held December 1, 1949 on petition of Bend ix Local #9, UAW -CIO for change of zoning of lots X85,
86, 87, 88 in Lincoln Manor 2nd Addition from B residence and A height and area districts to C Commercial and
D height and area districts.
The_City Plan Commission recommends this change as petitioned for.

Gentlemen:
December 2, 1949
On December 1, 1949, the City Plan Commission held a hearing on petition of Wilbert G., Fred C. and Florence
C. Kops for change of zoning of property fronting on the south side of Mishawaka Ave. 2142 feet and to a depth
of 1016.4 feet. The northwest corner of this unplatted land is a point 230 feet East of the southeast corner
of Mishawaka Ave. and Greenlawn Ave.
The City Plan Commission recommends this change as petitioned for.

To the Common Council
City of South Bend, Indiana
Gentlemen:
December 2, 1949
A hearing was held on December 1, 1949,on petition of Irving Sklare for change of zoning of certain lots in
East Lawn Addition together with two par ".eels of unplatted land from the East line of said addition East to the
north and south center line of Section 8, Township 37 North, Range 3 East from A residence and A height and
area districts to B residence and B height and area districts.
The City Plan Commission recommends this change as petitioned for.
Attached hereto are ordinances prepared by petitioner embodying a change in the description of the areas
which were described in the original petition.

Gentlemen:
December 2, 1949
Petition of Albert E and Gladys Tellson for change of zoning of property at 1201 Diamond Ave. was given hearing
by City Plan Commission at their regular meeting December 1st1V 19499
Property owners in that vicinity were present to object to this change and offered a remonstrance to that
effect.
Petitioner withdrew his petition for this change and no action was taken by the City Plan Commission.

REPORT OF CITY PLAN COMMISSION
To the Common Council
City of South Bend, Indiana
Gentlemen:
December 2, 1949
At their regular meeting on December 1, 1949, the City Plan Commission gave further consideration to the
ordinance for change of zoning of Lot #262 in Vassar Park Addition as returned to them by the Council at their
November 14th meeting.
After considering the action of the Council and the reasons given therefor a motion was made and seconded that
the City Plan Commission reaffirm their previous action on this change and does not recommend the change.
Motion carried 8 to 0.
Attached hereto is a written remonstrance against this change containing the signatures of 238 residents and
property owners in that vicinity.

Councilman Niezgodski made a motion to dispense with the reading of the report and that it be accepted.
Councilman Korpal seconded the motion. Motion carried.

The ordinance was given third reading and passed by a roll call vote of 6 ayes - 2 nays (Eyler and Bestle).

for suspension of rules. Councilman Muszynski seconded the motion. Motion was lost on a roll call vote of
7 ayes - 1 nay ( Erler).

that the ordinance be referred to the Committee of the Whole on January 9th, 1950. Councilman Kemper seconded
the motion. Motion carried.

The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a
motion that the ordinance and petition be held in @council for further investigation. Councilman Muszynski
seconded the motion. Motion carried.
MOTION
Councilman Kemper made a motion for a five minute recess. Councilman Glass seconded the motion. Motion carried,
and Council recessed at 8:45 P.M.
After a five minute recess, the meeting continued.

REGULAR MEETING DECEMBER 12TH 1949
UNFINISHED BUSINESS
Councilman Tellson made a motion-that the'Mayor appoint a Citizen's Committee of community leaders to study
the problems of public housing. Councilman Muszynski seconded the motion. Motion carried.
There being no further business, Councilman Glass made a motion to adjourn, which motion was seconded by
Councilman Kemper. Motion carried, and Council adjourned at 9:45 P.M.
