HomeMy WebLinkAbout10-10-49 Council Meeting MinutesREGULAR MEETING OCTOBER 10TH,�194_9 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, Monday, October 10th, 1949, at 8:25 P.M. with all members present except Councilman Kemper. President Erler presided at the meeting. REPORT OF COMMITTEE ON MINUTES To the Common Council of the City of South Bends October 10, 1949 Your Committee on the inspection and supervision of the minutes„ would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. ALBERT TELLSON Councilman - Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bends October 10, 1949 Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1949 South Bend, Indiana, Municipal Civil City Budget in several departments and offices thereof, and appropriating specific sums from the General Fund, and from the General Street and Traffic Fund, of said city, to certain other budgetary items of the 1949 Municipal Civil City Budget of South Bend, and declaring an extraordinary emergency". Respectfully report that they have examined the mutter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Niezgodski made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF CITY PAN COMMISSION s To the Common Council City of South Bend, Indiana October 8, 1949 Gentlemens The City Plan Commission has held a public hearing on the petition of Clarence A. Hertel and Leo Stebner for changing the sonIng of the quarter block at the N.E. corner of E. Colfax Ave. and Notre Dame Ave. This change is not recommended. CITY PLAN COMMISSION D. Moomaw, Seo'y. Councilman Tellson made a motion that the report be accepted, Councilman Korpal seconded the motion. Motion carried. REPORT OF CITY PLAID COMISSION To theCommon Council City of South Bend, 'Indiana► October 8, 1949 Gentlemen: The accompanying ordinance for amending Ordinance No. 3702 was initiated by the City Plan Commission and is intended to correct alt irregularity in the pattern of zoning for which there does not :seem to be any reason. These additions are between East. Colfax Ave. and McKinley Ave. East. of. Eddy St.': The City Plan Commission recommends this change. Councilman Tellson made a motion that the report be accepted. carried. CITY PLAN COMMISSION D. Moomaw, Seely. Councilman destle seconded the motion. Motion REPORT OF CITY PLAN COMMISSION To the Common Council City of south Bend, Indiana Gentlemen: October 8, 1949 1949 583 The 'City Plan Commission has held a public hearing on the petition of Wm. S. Reed, et al for change of zoning of the northeasterly side of Portage Ave. from Golden Ave. to Angela Ave. and the southwesterly side of Portage Ave. from the easterly side of Lot 3 in Bull& and Patton's Addition from "A" residence district to "A -1" residence district. This change is recommended. CITY PLAN COMMISSION D. Moomaw, Sooty* Councilman Niezgodski made a motion that the report be accepted. Councilman Rostle seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of south Bend, Indiana Gentlemen: October 8, 1949 On October 6th, 1949, the City Plan Commission held a public hearing on an Ordinance to change the zoning of Lots No. 50 60 70 8, 9, 10, 11, 12, 13 in Morris Park Addition and Lots 117, 1180 1190 187, 188, 189 in Northwest Second Plat from B residence and A height and area districts to C commercial and D height and area districts. The accompanying remonstrance was filed by property owners in that vicinity against this change* The City Plan Commission recommends this change. These lots are on Portage Ave. between Bulla Sto, on the westerly side and Kinyon St* including two lots North of Kinyon Ste and on the easterly side between Queen St. and Kinyon St. CITY PLAN COMMISSION D. Moomaw, Sooty* Councilman Niezgodski made a motion that the ordinance be held up for two weeks for further study. Councilman Korpal seconded the motion. Motion carried by a roll call vote of 5 ayes - 2 nays (Bootle & Glass) 1 absent (Kemper). REPORT OF MAYOR SCHOCK'S RAILROAD COMMITTEE Mayor $chock's Railroad Committee reported on improvements to date on the various railroads. Councilman Niezgodski made a motion that the Railroad Committee's report be accepted. Councilman sestle seconded the motion. Motion carried. Councilman Korpal made a motion that the Council be furbished with a copy of the Railroad Committee's report. Councilman Tel -loon seconded the motion. Motion carried. Councilman Niezgodski made a motion that ,the City Attorney draft an ordinance to compel railroad companies to fulfill their safety improvements with the City or provide a penalty for undue delays. Councilman Glass seconded the motion. Motion carried. COMPLAINT Mr. Albert Tellsons, September 24, 1949 We wish to file a complaint on Indiana Ave. 1900 block. The street is narrow and bumpy. We have trucks with heavy loads of steel morning and night. It causes damage to our street in front of our homes. We had four water breaks all- ready. The whole house shakes which means we have large repair bills every, year. Motion carried. ORDINANCE NO. 3718 AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1949 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET IN SEVERAL MEPARTMENTS AND. OFFICES.THEBEOF, AND APPROPRIATING SPECIFIC SUMS FROM THE GENERAL FUND, AND FROM THE GENERAL STREET AND TRAFFIC FUND, OF SAID CITY, TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1949 MUNICIPAL CIVIL CITY BUDGET OF SOUTH BEND, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 7 ayes • 1 absent (Kemper). ORDINANCE NO. 3719 AN ORDINANCE AMENDING ORDINANCE N0. 3702 AS PASSED BY THE COMMON COUNCIL JUNE 13, 1949 AND COMMONLY KNOWN AS THE ZONING ORDINANCE OF THIS SOUTH BEND, INDIANA. Councilman Tellson seconded the motion. Motion carried by a roll call vote of 7 ayes VAbsent (Kemper). 584 I� REGULAR MEETING OCTOBER 10TH, 1949 ORDINANCE NO. 3720 AN ORDINANCE TO AMEND ORDINANCE N0. 3702, AS AMENDED, WHICH ORDINANCE -IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. (Northeasterly side of Portage Ave. from Golden Ave. to Angela and the Southwesterly side of Portage Ave. from the easterly side of Lot 3 in Bulla & Pattonta Add.) The ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 7 ayes - 1 absent (Kemper). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 absent (Kemper). ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 3702, COMMONLY KNOWN AS THE ZONING CR DINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Lot No. 262, Vassar Park Addition to the City of So. Bend, Ind.) The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the -City Plan Commission. Councilman Tellson seconded the motion. Motion carried. RESOLUTION BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, which has jurisdiction over the ares in which Project Me TVD. V -12223 of South Bend Veterans Project is located, that the waiver of the removal requirements of Section 313 of the Lanham Act (Public Law 849, 76th Congress, as amended) with respect to said Project is hereby specifically approved in accordance with the Independent Offices Appropriation Act, 1950. CLOYD BESTLE Member of the Common 'Council Councilman Niesgodski made a motion that the resolution be adopted. Councilman Tellson seconded the motion. Motion carried. There being no further business before the Council, Councilman Niezgodski made a motion to adjourn, which motion was seconded by Councilman Tellson.
