HomeMy WebLinkAbout09-26-49 Council Meeting MinutesSEPTEMBER 26TH. 1949 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, September 26th, 19491, at 8:10 P.M. with all members present. President Erler presided at the meeting. REPORT OF COMITTEE ON MINUTES To the Common Council of the City of South Bends Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend that the same be approved. Minutes of August 29th and September 12th, 1949. Councilman Glass made a motion that the report be accepted. carried. Motion September 21, 1949 In view of the fact that a number of residents on Grace Street near the Oliver Corporation Gate have appeared at meetings of the Committee of the Whole of the South Bend Common Council, it has occurred to me that you, as chairman, as well as the other members of the Committee would be interested in the contents of the attached copy of my letter to Mr. Theodore Michalak, who has been spokesman at various times for that neighborhood. I watched with interest the development of the proposals of the Grace Street property owners and attempted to elicit the immediate cooperation of the Oliver Corporation officials at the South Bend plant. It seems that information regarding developments here were channeled through the Chicago office but efforts extended by you, City Engineer Andrysiak, and the.Six District Councilman were being ignored somewhere along the line. However, one week ago, Mr. George Lanphere assured me of his personal interest in the matter and that the Corporation would do everything in its power to cooperate. The results are explained in the accompanying letter. I now trust that you will no longer be besieged at your oommittee meetings and feel that you, as well as the other members, should be properly apprised of these developments% I remain GAS: em Most cordially, GEO. PETITION To the Honorable City Council of the. City of South Bend, Indiana Gentlemenx September 20th, 1949 We the undersigned owners in fee of Lots 1 -2 -3 in Mayr's LaPorte Ives Addition to the City of South Bend, Indiana, petition your Honorable Body to consider the following proposed !Amendment to Ordinance #2331 whereby Lots 1 -2 -3 in Mayr's LaPorte Ave. Addition to the City of South Bend, Indiana would be changed from "B" use and "A" height to "D" use and "E" height and area. PETITION To the Common Council of the City of South Bend for an Ordinance to Restrict the Use by Motor Vehicles of Grace Street,. East of Arnold Street, Public Streets in the City of South Bend. 1. The undersigned as Petitioners respectfully submit to the City Council of the City of South Bend, Indiana, that they, at the addresses opposite their names below given and affixed, are the owners, legal or equitable, of the real estate indicated at such address. 2. That recently Grace Street, east of Arnold Street, in South Bend, was paved by the City of South Bend. 3. That prior to such paving of said street, the Board of Public Works of South Bend had represented to the- undersigned that a type of pavement denominated "Class 'C'" would be laid and such property owners consented to such property assessment for such type of pavement on.the condition that trucks and trucking would be prohibited on said Grace Street east of Arnold Street. 4. That the Board of Public Works assented to said condition. 5. That thereafter, that is, after the laying of said pavement and immediately on the opening of the said Grace Street east of Arnold Street to motor vehicle traffic, the Oliver Corporation, altho it has other means of ingress and egress from its property, resorted to the use of said Grace Street east of Arnold Street for heavy trucking. 6. That as a result of such.u6s, the pavement recently laid as aforesaid has been cracked in numerous places, and that persistent further use of said pavement by heavy trucks will completely wreck the newly Said pavement In front of the property of the undersigned. 7. That the City Engineer of South Bend puts up birrioades and removes them at his pleasure and at the ,convenience of the Oliver Corporation but to the detriment of the property of the undersigned. 8. That further use of said pavement by heavy trucking will irreparably damage said pavement, all to the expense of the undersigned, who are assessed for the cost of the same. 9. That said Grace Street, east of Arnold Street, is a narrow and short street, and is not easily accessible to motor vehicles other than passenger vehicles, and that the turning radius available for turning into said Grace Street aforesaid from Arnold Street is match too short as to enable motor vehicles other than passenger vehicles of ordinary length to enter into--said Grace Street without difficulty. 10.. That recently, one of such motor vehicles in turning into said Grace Street did break an electric line pole, and that the same was replaced by the Indiana and Michigan Electric Company. 11. That the closing of said street to trucking will not impose hardship upon the- Oliver Corporation for the reason that the Oliver Corporation does have on its property other places of ingress and egress, which places are: more. readily accessible to trucks entering onto and departing from its property. WHEREFORE, in the interests of protecting the new pavement on Grace Street aforesaid against arty possibility of damage From trucking, and in the interests of &voiding expenses of repairing said pavement after the occurrence to it of damage from trucking, the cost of which payment -is now or will be assessed against the property of said owners, which property fronts on said Grace Street, aforesaid, the undersigned do respectfully pray of the City Council of South 13ond that it enact into law a prohibition of the use of Grace Street by motor vehicles other than passenger vehicles. Moore for change of zoning of Lot #41 in Kaley's Lincoln Highway Addition from "B" residence and "A" height. and area districts to "C" commercial and "D" height and area districts was considered by the City Plan Commission and this change is not recommended. Councilman Korpal. made a motion that the report he accepted. carried. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Members of the Common Council Council'Chambers, City Hall City of South Bend, Indiana Gentlemen: CITY PLAN COMMISSION D. Moomaw, Sebty, Councilman Glass seconded the motion. Motion September 24, 1949 Attached hereto p. , lease find copies of reports submitted by Mr. William Qualls, Electrical Superintendent, for street lights at the following locations: Eddy Street and Bissell Street, Indiana Avenue and Magnolia Street, Twyokenham Drive and Greenlawn Avenue; Olive and Delaware Streets, and a change from 1000 lumen to 4000 lumen light at Southwdod and Greenlawn Avenue, Kaley and Mourq% Streete, Mr. Qualls informed the Board that a light ordered in at Jefferson and Laurel Streets has been installed and is now in -so t oe. ORD AN ORDINANCE REDUCING CERTAIN ITEMS IA THE 1949 BOUTH:BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET IN SEVERAL DEPARTMENTS AND OFFICES THEREOF, AND APPROPRIATING SPECIFIC SUMS FROM THE GENERAL FUND, AND FROM THE GENERAL STREET AND TRAFFIC FUND, OF SAID CITY, TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1949 MUNICIPAL CIVIL CITY BUDGET OF SOUTH BEND, AND DECLARING AN EXTRAORDINARY EMERGENCY. 581 The ordinance was given first reading by title and second reading in full. Councilman Mussynski made a motion that the ordinance be referred to the Committee of the Whole for Public Hearing on October 10th, 1949. Councilman Tellson seconded the motion. Motion carried. ORDINANCE N0. 8719 AN ORDINANCE AUTHORIZING THE SALE OF CERTAIN INItELLING UNITS OItNED BY THE MUNICIPAL CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title and second reading in full. Councilmen Horpal made a motion for suspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes - O nays . The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. MOTION Councilman Tellson made a motion that when an ordinance is filed with the Clerk, sufficient copies must accompany the original for members of the Council, City Attorney, and the two newspaper reporters. Councilman Muszynski seconded the motion. Motion carried. There being no further business, Councilman Niezgodski. made a motion to adjourn, which motion was seconded by Councilman Tellson. Motion carried, and Council adjourned at 9:20 P.M. ATTEST:
