REGULAR MEETING AUGUST 22ND, 1949
Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the
Council Chamber, August 22nd, 1949, at 7:40 P.M. Central Standard Time with all members present* President
Erler presided at the meeting.

PETITION TO RE -ZONE
Comes norr�Joseph Igaz and Ethel Igaz and respectfully petition the City Planning Commission to re -zone Lots
16`and 19 in Homeland Addition to the City of South BBend, Indiana, from "Ee ndustrial District and
Height and Area District to "B" 8tsidential District and "Be Height and AreaDistrict.

Petitioners further show to said Commission that the area surrounding said above described real estate-is
being largely developed into a residential district, and that the residents of said area urgently request
that.the vacant lots now in said Homeland Addition be re -zoned from the present Heavy Industrial District
to a Residential District.
Petitioners further shoat that they purchased the above lots in good faith on the belief that they were able
to erect dwellings thereon• That on one of said lots the basement has been dug and cesspool and dry well
installed. The Commission is earnestly requested to expedite this matter as quickly as possible so that
the plans of petitioners for the erection of dwellings may be completed.

Councilman Glass made a motion that the petition be referred to the City Plan Commission. Councilman Korpal
seconded the lotion. Motion carried.

The undersigned owners of more than 60% of the property herein described respectfully petition your honorable
body to amend.,.Ordinance # 3702 as it applies to the property with frontage on the north easterly side of
Portage Avenue from Golden Avenue to Angela Avenue and the property having frontage on the south westerly
side of Portage Ave. from the south easterly side of lot #3 in Bulla and Pattons Addition to the East line
of Blaine Avenue,, changing the same from "A" residence district to "A -1" residence district.

Councilman Glass made a motion that the petition be referred to the City Plan Commission. Councilman Beetle
seconded the motion. Motion carried..
REPORT OF COMMITTEE ON MINUTES
To the Common Council of the City of South Bend:
August 22nd, 1949
Your Committee on the inspection and sups mision of the minutes, would respectfully report that they have
inspected the minutes of the previous meeting of the Council and found them correct. They therefore recommend
that the same be approved.

Councilman Niezgodski made a motion that the report be accepted. Councilman Glass seconded the motion.

REPORT OF THE COMMITTEE OF -THE WHOLE
To the Common Council of the City of South Bend:
August 22, 1949
Your Committee of the Whole to whom was referred "An Ordinance supplementing Ordinance No. 3702 adopted
June 13, 1949, and commonly known as the Zoning Ordinance of the City of South Bende.
Respect report that they have examined the mutter and that in their opinion this ordinance should go to the
Council as favorable.

Councilman Kemper made a motion that the report be accepted. Councilman Beetle seconded the motion.
Motion carried.
ORDINANCE NO. 3714
AN ORDINANCE SUPPLEMENTING ORDINANCE N0. 3702 ADOPTED
JUNE 13, 1949, AND COMMONLY KNWN AS THE ZONING ORDINANCE
OF THE CITY OF SOUTH BEND.
The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays.
RESOLUTION.
VMREAS,.ordimneas and petitions for change of zoning are addressed to the Common Council and filed with
the..City Clerk, and
WHEREAS, these petitions are received by the Common Council and referred to the City Plan Commission on the
second and fourth Mondays of the month, and
WHEREAS, the regular meetings of the City Plan Commission are on the first Thursday of the month,
NON THEREFORE BE IT RESOLVED by the Common Council of the City of South Bend that the City Clerk be authorized
to receive such ordinances and petitions and after filing them transmit them to the Office of the City Plan
Commission in order to save time in getting such matters before the Council for their action.

Councilman Muszynski made a motion that all petitions filed for zoning come before the Council with the
recommendation that they be referred to the City Plan Commission. Councilman Niezgodski seconded the
motion. Motion carried by a roll call vote of 7 ayes - 1 nay (Eyler).
MOTIONS
Residents froth the East side appeared before the Council relative to the South Bend Avenue dump. Councilman
Kemper made a motion that thi-South Bend Avenue dump be closed for a month and the Board of Public Works
directed to solve the problem. Councilman Musty nski seconded the motion. Motion carried.
Mr. Andrysiak was unable to attend the meeting, therefore Mr. Baer reported on condition of the dump.
Residents from the infest side appeared before the Council relative to the conditions in the pavement of
Albert Avenue and near -by streets. Councilman Niezgodski made a motion that the conditions in the pavement
of Albert Avenue and near by streets be referred to the Board of Public Works to make a study of what can be
done about the'pavement and report back to the Council at its next regular meeting September*12th. Councilman
Mus Wnski made an amendment to the motion that a special committee be appointed, including the City Engineer
and Street Commissioner to join the Board of Public Works in their study as to what could be done. The chair
appointed Councilmen Muszynski, Glass and Korpal to work in conjunction with the Board of Public Works, the
City Engineer, and the Street Commissioner. Councilman Glass seconded the motion. Motion oarried.
There being no further business, Councilman Tellson made a motion to adjourn, which motion was seconded by
Councilman Niezgodski. Motion carried, and Council adjourned at 8:35 P.M. Central Standard Time.
