President Erler presided at the meeting. The reading of the minutes of the previous meeting was waived. REPORT OF THE COMMIT TEE OF THE WHOLE To the Common Council of the City of South Bend: July 11th, 1949 Your Committee of the Whole to whom was referred "An Ordinance transferring the sum of $1,000.00 from Account No. Q -11, Salaries, Fire Department; to Account No. Q -262, Medical, Dental & Surgical Service, also the sum of $50900 from Account No. Q -11, Salaries, Fire Department, to lecount No. Q -322, Oil, Fire Depart- ment; also the sum of $35,000.00 from Account No. Q -11, Salaries, Fire Department, to Account No. Q -712, Buildings, Fire Department, and declaring an extraordinary emergency ". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY Co KORPAL, Chairman Councilman Kemper made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF • CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: June 20, 1949 Petition of Harry and Florence Verkler for change of zoning of Lot #39 in A.H. Cushing Addition as referred to the City Plan Commission has been modified by Clarence M. and Elizabeth Pierce joining with the aforesaid petitioners asking that Lot #40 in said addition be included in this change. These lots comprise the west half of the block on the north side of Lincoln Way West between Lawndale Ave. and Sancome Ave. Hearing on the petition thus amended was held at a special meeting of the City Plan Commission on June 16th and the change of zoning of these two lots is recommended as petitioned for. CITY PLAN COMMISSION D. Moomaw, Seely. Councilman Korpal made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. ORDINANCE N0, 3708 JULY 11TH. 1949 AN ORDINANCE AUTHORIZING THE SALE OF LOT NUMBERED THIRTY -FIVE (35) AS SHOWN ON THE RECORDED PLAT OF NORTH SHORE TERRACE, AN ADDITION TO THE CITY OF SOUTH BEND, ST, JOSEPH COUNTY, INDIANA, OWNED BY THE MUNICIPAL CITY OF SOUTH BEND. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3709 AN ORDINANCE ADOPTING A MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion for suspension of rules. Councilman Muszynski seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE AN ORDINANCE :TO AiMM ORDINANCE NO. 2331 AS AMENDED, WHICH ORDINANCE IS COMMONLY CALLED THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND. The ordinance was given first reading by title and second reading in full. Councilman Kemper made a motion that the ordinance be referred to the next Council meeting. Councilman Bestle seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE CITY OF SOUTH BEND PARK MAINTENANCE FUND THE SUM OF $125.00 TO ACCOUNT NO. 381, SPRAYING MATERIAL AND FERTILIZER, PARK DEPARTMENT; ALSO TRANSFERRING THE SUM OF $10 §75000 FROM ACCOUNT NO. 430 DRIVES AND WALKS, PARK DEPARTMENT, TO THE FOLLOWING ACCOUNTS IN.THE AMOUNT INDICATED: ACCOUNT NO. 11, LABOR, SERVICES TEMPORARY, $1,500.00; ACCOUNT NO. 261, OTHER CONTRACTUAL SERVICES, $400.00; ACCOUNT NO. 332, OIL, $100.00; ACCOUNT NO. 442, PARK MAINTENANCE, $400.000-_ACCOUNT NO. 711, BUILDINGS AND FIXED EQUIPMENT, $7,575.00; AND AECOUNT N0. 7269 OTHER EQUIPMENT, $700.00, ALL IN PARK DEPARTMENT, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full.~ Councilman Korpal made a motion that the ordinance be referred to the Committee of the 'Whole for public hearing on July 25th. Councilman Muszynski seconded the motion. Motion carried. JORDINANCE AN ORDINANCE APPROVING A CONTRACT BETWEEN THE CITY OF SOUTH BEND, INDIANA, AND INDIANA & MICHIGAN ELECTRIC COMPANY. 565 The ordinance was given first reading by title and second reading in full. Councilman Tellson made a motion for suspension of rules. Councilman Glass seconded the motion*' Roll call on suspension of rules - 7 ayes, Erle r, Korpal, Tellson, Bestle; Niezgodski, Glass and Muszynski - 1 nay, Kemper. Motion loett Councilman Kemper made a motion that the ordinance be referred to the Committee of the Whole for public hearing on July 25th. Councilman Bestle seconded the motion. Motion carried. City Engineer Raymond S. Andrysiak reported to the Council that excavating dirt from two East side paving projects was being used to cover the dumping area south of the Bercliff Estates. There being no further business, Councilman Tellson made a motion to adjourn, Councilman Glass seconded the motion. Motion carried. Council adjourned at 9 :30 P.M.
