COMMITTEE OF THE WHOLE MEETING Ps 13TH, 1949
Be•it remembered that the Common Council met in the Committee of the Whole meeting in the Council Chambers of
the City Hall, Monday evening, June 13th,,1949, at the hour of 8 :10 P.M. All members were present. Councilman
Korpal presided.
ORDINANCE NO. 3700
An ordinance amending Ordinance No. 2331 commonly known as the zoning ordinance of the City of South Bend,
Indiana.
Councilman Erler moved that the said ordinance go to the Council as favorable. Councilman Beetle seconded
the motion. Motion carried.
ORDINANCE NO, 3701
An ordinance appropriating from the General Street and Traffic Fund of the City of South Bend, Indiana, the
sum of Seventy -seven ($77,000.00) dollars to the following accounts of the 1949 budget: Street Department,
S- 251 -0, Repairs and Improvements to Streets, $57,000.009 also to Account S -711, Buildings, $20,000.00, and
declaring an extraordinary emergency.
Councilman Tellson moved that the said ordinance go to the Council as favorable. Councilman Glass seconded the
motion. Motion carried.
ORDINANCE NO. 3702
An ordinance to regulate and restrict the location of trades, callings, industries, commercial enterprises,
and the location of buildings designed for specified uses; to regulate and limit the height of buildings
hereafter erected or altered; to regulate and determine the area of yards and other open spaces about buildings;
to regulate and determine the density of use of la,nctt areas, and for said purposes to divide the city into
districts and prescribe penalties for the violation of its provisions and to provide for its enforcement and
a Board' of Zoning Appeals.
Councilman Tellson reported to the Committee of the Whole that the new prolosed zoning ordinance was fully
discussed at meeting of all Counoilmen on May 27th, 1949, and no amendments or changes were recommended.
Councilman Kemper moved that the new proposed zoning ordinance be referred to the Council as unfavorable.
Councilman Beetle seconded the motion, and upon a roll call the motion was defeated by 2 ayes - 6 nays
(Erler, Korpal, Tellson, Niezgodski, Glass and Muszynski). Thereupon Councilman Niezgodski moved that the
new proposed zoning ordinance go to the Council as favorable from the Committee of the Whole. Said motion
was seconded by Councilman Glass and carried by a roll �JOO of 6 ayes - 2 nays (Nestle and Kemper).
There being no further business, the Committee of the Whole adjourned at 9:40:P *Mo
