HomeMy WebLinkAbout02-14-49 Council Meeting MinutesFEBRUARY 14Th, 1949 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, February 14th, 1949, at 8:23 P.M. with all members present. President Erler presided. The reading of the minutes of the previous meeting was waived. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana February 4, 1949 Gentlemen: Petition of Leo A. and Bertha Lippman for change of zoning in Pinhook Manor ,Addition excepting Lots 1 and 22 inclusive from "Af1 residence to "B" residence district was heard by the City Plan Commission at their regular meeting February 3rd, 19499 The City Plan Commission recommends that this change be made as petitioned for. Councilman Niezgodski made a motion that the report be accepted. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: D. MOOMAW, Secretary Councilman Kemper seconded the motion. February 4, 1949 Petition of Post No, 1167, Veterans of Foreign bars Inc. for change of zoning of a portion of an unplatted area adjoining North Side Boulevard near TRyckenham Drive from "B" residence district to Commercial has been heard by the City-Plan Coaeaiesion. This change is not recommended. D. MOOMAW, Secretary Councilman Tellson made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried by a roll call vote of 5 ayes - 3 nays (Bestle, Niezgodski and Kemper). REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: February 4, 1949 Petition of Edward Olczak for change of zoning of Lots #632 and 633 in Summit Place 3rd Addition from Commercial to Light Industrial district was heard by the City Plan Commission at their regular meeting February 3, 1949. The City P1an.Commission recommends that this change be made as petitioned for. D. MOOMAW, Secretary Councilman Korpal made a motion that the report be accepted. :Councilman Tellson seconded the motion. Motion carried. REPORT OF THE CITY CLERK FOR THE YEAR 1948 The reading of the report of the City Dlerk for the year 1948 was waived. Councilman Glass made a motion that the report be accepted. Councilman Bestle seconded the motion. Motion carried. REPORT OF THE BUILDING DEPARTMENT FOR THE YEAR 1948 The reading of the report of the Building Department for the year 1948 was waived. Councilman Glass made a motion that the report be accepted. Councilman Tellson seconded the motion. Motion carried. REGULAR MEETING FEBRUARY 14TH, 1949 ORDINANCE ORDINAMT E AMENDING ORDINANCE # 2331 (AS AMENDED) COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (ALL OF PINHOOK MANOR, EXCEPTING LOTS NUMBERED 1 TO 22 INCLUSIVE) The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion that the ordinance be referred to the Committee of the Whole on February 28th, 1949, at 8:00 P.M. 'Councilman Glass seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE # 2331 COMMONLY KNOWN AS THE ZOMING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (LOTS 632 & 633 IN SUMMIT PLACE THIRD ADDITION) The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be held up in Council until further information ban be obtained from the owner regarding the reason for change in zoning. Councilman Muszynski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIANA, THE SUM OF EIGHT HUNDRED FIFTY DOLLARS ($850.00) TO THE FOLLOWING ACCOUNT OF THE 1949 BUDGET: STREET DEPARTMENT, S -51, ' INSURANCE, AND DECL.i.RING AN EXTRAORDINARY EMERGENCY- The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for Public Hearing on February 28th, 1949, at 8:00 P -M. Councilman Kemper seconded the motion. Motion carried* ORDINANCE AN ORDINANCE TO AMEND PARAGRAPH2 OF SECTION 2 OF ORDINANTCE NO. 1749 ENTITLED "AN ORDINANCE ADOPTING CERTAIN RULES AND REGULATIONS FOR THE GOVERNMENT OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AND ITS MEMBERS ", ADOPTED N07FMBER 9, 1914, AS A MENDED BY ORDINANCE NO. 3630, ADOPTED BY THE COMMON COUNCIL ON MARCH 8, 1948. The ordinance was given third reading- Councilman Tellson Made a motion that the ordinance be tabled Indefinitely, Councilman Glass seconded the motion. Motion carried by a roll call vote of 6 ayes - 2 not voting (Niezgodski and Kemper)- RESOLUTION TYMREAS, there -4s now before the State Legislature Bill No. 138 proposing an increase in the size and weight of trucks permitted for use on the highways of our state and cities., And WHEREAS, it is necessary for tracks to traverse South Bend streets to connect with highways leading into the city, and WHEREAS, to increase the weight and size of trucks traversing our city streets would further break down our street pavements, and WHEREAS, the burden of repair and paving our city streets is now a heavy financial burden for our tax - payers, and WHEREAS, the state government has not given South Bend sufficient financial aid to properly maintain such city streets. NOW THEREFORE BE IT RESOLVED by the South Bend City Council that we are opposed to the passage of any weight increase for trucks in Bill No. 138, and that if such bill is passed which would provide for an increase of weight for trucks, we would find it necessary to seriously consider the enactment of an ordinance prohibiting the use of such increased weight of trucks on our city streets. (Signed) MEMBERS OF THE COMMON COUNCIL Councilman Niezgodski made a motion to adopt this amended resolution. Councilman Muszynski seconded the motion. Motion carried* RESOLUTION A Resolution by the Common Council for the City of South Bend, Indiana, urging the passage of House Bill Number 17- WHEREAS, there has been introduced and there is now pending in the House of Representatives in the General Assembly of the State of Indiana, House Bill Number 17, which, if passed, would make a more equitable distribution of costs for separation of grades on public thoroughfares and railroads in the State of Indiana, and WHEREAS, there are other cities in the State of Indiana that are desirous of securing separation of grades and in the interests of safety of the people using highways in the State, a more equitable distribution costs of grade separations should be provided, and WHEREAS, the Common Council of the City of South Bend is of the opinion that House Bill Number 17 should be enacted into law, and WHEREAS, the said Common Zouncil of the City of South Bend stands ready and willing to expend all its available effort in seeking the passage of said bill. (CONTINUED ON RTEXT PAGE) 543 NOW, THEREFORE, be it resolved by the Common Council of the City of South Bend that it urge members from St. Joseph County and all other members of the General Assembly of the State of Indiana, to exert all force and influence necessary for the passage'of House Bill Number 17; said Common Council further respectfully request that the Mayor and President of the Council be notified of all publie hearings to be held on said Bill in sufficient time that members of said administration may attend such hearings and be heard on the efficacy of this problem and further respectfully request that the Council be kept informed on the progress of said Bill. IT IS FURTHER RESOLVED that the City Clerk be instructed to forward copies of this Resolution to each member of the General Assembly in the State of Indiana from St. Joseph County and also to send a copy to Honorable Henry J. B ranning, Jr., Mayor of the City of Fort Mayne and to Mr. Lee Ninde, President of the Citizens' League at Fort Wayne, Indiana. (Signed) MEMBERS OF THE COMMON COUNCIL Councilman Tellson made a motion to adopt the resolution, and that the instructions forthwith be carried out. Councilman Glass seconded the motion. Motion carried. MOTIONS Councilman Rorpal :Wade e, motion that a committee be appointed to study ways and means of either widening Western Avenue or seeking state help in a by -pass route for trucks. Councilman Muszynski secohded.the motion. Motion carried. :President Erler appointed the Transportation Committee with Councilman glass as Chairman to investigate the above condition. a Councilman Muszynski made a motion�to seek ways anda?R nstaf correcting a smoke situation involving the burning of 8,000 bushels of corn cobs -daily in an incinerator by the South Bend Elevator Company, 901 So. Olive Street. Councilman Tellson seconded the motion. Motion carried. "President Erler appointed the Miscellaneous Business committee with Councilman Muszynski as Chairman to investigate the above condition.
