JANUARY 24TH, 1949 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chamber, January 24th, 1949, at 8x07 P.I., with all members present except Councilman Bestle. President Erler presided at the meeting. Councilman Niezgodski made a motion to dispense with the reading of the minutes of the previous meeting. Councilman Kemper seconded the motion. Lotion carried. PETITION To the Common Council of the City of South Bend, Indiana January 19, 1949 The undersigned, owners of the property know as Pinhook Manor,a recorded plat in the City of South.Bend, respectfully petition your honorable body to amend ordinance No. 2331 as it applies to the part of said property described as foll.owss All of the recorded plat of Pinhook Manor except lots numbered 1 to 22 inclusive., changing the same from A residence district to B residence district. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: January 24, 1949 Your Committee of the Whole to whom was referred "An Ordinance providing for the appointment of an additional Barrett Law Clerk; fixing the salary thereof, and appropriating from the General Fund of the City of South Bend, Indiana, the sum of Two Thousand Two Hundred (#2,200.00) Dollars to the following account of 1949 budget: Office of City Treasurer, D -11, Salaries, and declaring an extraordinary emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Niezgodski made a motion that the report be accepted. Councilman Glass seconded the motion. Motion carried. REPORT OF THE.COMMITTEE OF THE-WHOLE To the Common Council of the City of South Bends January 24, 1949 Your Committee of the Whole to whom wa$ referred "An Ordinance appropriating from the General Street and Traffic Fund of the City of South Bend, Indiana, the sum of Four Thousand ($4,000.00) DOLLARS t6 the following account of the 1949 budget: Street Department, S -711, Properties, and declaring an extraordinary emergency. Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. REPORT FROM TRAFFIC DEPARTMENT The Honorable Common Council January 15, 1949 City of South Bend South Bend 1, Indiana Ret Petitions in regard to the sounding of train whistles referred to Mayor Schock's railroad Gentlemens committee on December 15, 1949. The committee discussed this matter with the proper railroad officials at a meeting on January 11, 1949 and asked that any unecessary sounding of train whistles and bells be stopped. The committee asked that Ordinance Number 966, Article 1, Section 273, be strictly adhered to. This ordinance reads as follows Sec. 273. Whistles on Loasoiao tve. It shall be unlawful for any person running or controlling any locomoative in this City to sound the whistle thereof, or allow the same to be sounded within the corporate limits of this City except to prevent accident that cannot be otherwise avoided and except in giving signals for the target. Any person violating this provision shall be fined in any sum not exceeding one hundred dollars. EHMscmp Very truly yours, ERNEST H. ORDINANCE NO. 3686 AN ORDINANCE APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIANA, THE SUM OF FOUR THOUSAND ($4,000.00) DOLLARS TO THE FOLLOWING ACCOUNT OF THE 1949 BUDGET: STREET DEPARTMENT, S -711, PROPERTIES, AND DECLARING AN EXTRA- ORDINARY EMERGENCY. The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Bestle). R E S O L U T I O N BE IT RESOLVED by the Common Council of the City of South Bend, Indiana: That it is with profound sorrow and deepest regret that the Mayor, the City Administration, and the Common Council learned of the death of City Controller Albert E. Troeger. From January 1, 1948 to the present day.., City Controller Albert E. Troeger had at all times devoted himself energetically and faithfully to the welfare and best interests of his community, thereby exemplifying the highest traditions of public service. The members of his family have the deepest condolence of the Common Council, the Mayor, and the City Administration. BE IT FURTHER RESOLVED, that this Resolution be spread upon the records of the Common Council, and that a copy thereof be mailed to the family of City Controller Albert E. Troeger, deceased. MEMBERS OF THE COMMON COUNCIL Councilman Niezgodski made a motion to adopt the Resolution. Councilman Muszynski seconded the motion. Motion carried. . . . . . . . . . . . . . . . . . . . . . . Resolution-meftorializing• the Congress of the United States to pass, and the President of the United States to approve, if pass, the "GENERAL PULASKI'S MEMORIAL DAY" Resolution now pending in Congress Whereas, A Resolution providing for the President of the United States of America to proclaim October 11th of each year as "General Pulaski's Memorial Day" for the observance and commemoration of the death of Brigadier General Casimir Pulaski, is now pending in the present session of the United States Congress; and Whereas, the 11th day of October, 1779, is the date in American history of the heroic death of Brigadier General-Casimir Pulaski, who died from wounds received on October 9th, 1779, at the siege of Savannah, Georgia; and 'Whereas, the States of Arkansas, California, Connecticut, Delaware, Illinois, Indiana, Kentucky, Louisiana, Maryland, Kansas, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, New Hampshire, New Jersey, New York, Nevada., Ohio, Pennsylvania, South Carolina, Tennessee, Texas, West Virginia, Wisconsin, and other States of the Union, through legislative enactment designated October 11th of each year as "General Pulaski's Memorial Day; and Whereas, it is fitting that the recurring anniversary of this day be commemorated with suitable patriotic " and publio exeroises'.in observing and commemorating the heroic death of this great American hero of the Revolutionary War; and Whe reas,o the Congress of the United States of America has by legislative enactment designated October 11, 1929, October 11, 1931, October 11, 1932, to October 11, 1946 to be "General Pulaski's Memorial Day ", in the United States of .America; Now therefore be it RESOLVED BY THE COMMON COUNCIL OF THE CITY OF South Bend and the STATE OF Indiana IN SESSION ASSEMBLED - -- Section 1. That we hereby memorialize and petition the Congress of the United States, to pass, and the President of the United States to approve, if passed, the General Pulaski's Memorial Day Resolution now pending in the United States Congress. Section 2. That certified copies of this Resolution, proper% authenticated, be sent forthwith to the President of the United States, the Vice - president of the United States, the Speaker of the House of Representatives of the United States, and each of the United States Senators and Representatives from Indiana. Councilman Korpal *Wade a motion to adopt the Resolution, and that the instructions forthwith be carried out. Councilman Kemper seconded the motion. Motion carried. 540 JANUARY 24TH, 1949 There being no further business before the Council, Councilman Glass made a motion to adjourn, which motion was seconded by Councilman gorpal.
