President Niezgodski presided. The reading of the minutes of the previous meeting was waived. COMMICATION To the Mayor and the City Council of the 'City of South Bend, Indiana Greetings: November 29, 1948 South Bend, Indiana We, the undersigned, as designated representatives of the occupants of Southmore and Beacon Heights, do hereby respectfully requests "That the City Council let their original resolution, designed to acquire these projects from the Federal Government, stand as is. "That the City Council pit in writing, a copy thereof to be forwarded to above named Committees, that the City Council, when the Federal Government concedes to the City of South Bend to buy said projects, will waive this right in favor of Tenant organizations". For Southmore Heights., (3 Signers) For Beacon Heights: (4 Signers) Councilman Erler made a motion that the =aommanication be accepted as read and placed on file. Councilman Tellson seconded the motion. Motion carried. PET IT,.. ION To the Common Council City of South Bend, Indiana November 23, 1948 The undersigned owners of property herein described respectfully petition your honorable body to amend the zoning law of South Bend as it applies to: A parcel of unplatted land at the Southeast corner of East Colfax Ave. and Eddy Street, being 158.6 feet frontage on Colfax Ave. and 18769 feet South from Colfax Ave. on Eddy Street and being rectangular in shape. This land now lies partly in the "B" residence district and partly in the "A" residence district. The height and area district is also part "A" and part "B" on an irregular pattern f or which there is no apparent reason. The undersigned petitioners pray that this entire parcel be made "B" residence and "B" height and area district JOHN L. WORDEN SADIE D. WORDEN November 229 1948. PETITION The Honorable Mayor and :Common Council of the City of South Bends November 5, 1948 We, the undersigned citizens of South Bend, living and residing within reasonable distance of the railroad trains passing through our city, are greatly annoyed at all hours of the night by sounding whistles and ringing bells on such locomotive engines at highway crossings and would request you to pass an ordinance providing that it would be unlawful to sound the whistle and ring the bell at such crossings as are protected by a watchman or automatic signal device, except in cases where it is apparent that a pedestrian or vehicle is in a place of danger. Respectfully submitted, (26 Signers- Residents of Sunnymede and the area South of Sunnymede) The Honorable Mayor and Common Council of the City of South Bend: November 1, 1948 We, the undersigned citizens of South Bend, living and residing within reasonable distance of the railroad trains passing through our city, are greatly annoyed at all hours of the night by the noises from the skrieking whistles on the trains and would request you to pass an ordinance in the interests of our health and nervous systems to at least partially relieve us of this disturbance. Respectfully submitted, (84 Signers- Residents of Sunnymede and the area South of Sunnymede and residents in the vicinity of the Test side of the city) Councilman Nrler made a motion that the petitions be referred to a joint committee of City officials and Railroad officials, and copies of same be given to Ernest Miller, Traffic Engineer, to refer to the Railroad Committee for discussion. Motion carried. 532 11 REGULAR MEETING DECEMBER 13TH, 1948 REPORT OF TAE .COMMITTEE OF THE WHOLE To the Common Council of the City of South Bends- December 13, 1948 Your Committee of the Whole to whom was referred "An Ordinance concerning the construction of extensions and additions to the waterworks owned and operated by the City of South Bend, Indiana, authorizing the issuance of revenue bonds to provide for the cost thereof, and matters connected therewith". Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Glass made a motion that the report be accepted, Councilman Bestle seconded the motion. Motion carried. REPORT OF CITY` PLAN COMMISSION To the Common Council City of South Bend, Ind. Gentlemens December 3, 1948 The City Plan- Commission held a public hearing on the petition of Paul A. Heierman and Forest G. Hay for change of zoning of Lot #25 in Leeper's 2nd Addition on December 2, 1948. This change is not .recommended. This lot is on the north side of West Pokagon St. next but one to the railroad. Attached hereto is a remonstrance signed by property owners in that vicinity, CITY PLAN COMMISSION Dr Moomaw, Sec'y. Councilman Kemper made a motion that the report from the City Plan Commission be accepted.- Councilman Irler seconded the motion. Motion carried. ORDINANCE NO. 3679 AN ORDINANCE CONCERNING THE CONSTRUCTION OF EXTENSIONS AND ADDITIONS TO THE WATERWORKS OWNED AND OPERATED BY THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE OF REVENUE BONDS TO PROVIDE FOR THE COST THEREOF, AND MATTERS CONNECTED THE MWITH. 533 The Presiding Officer stated that the Committee of the Whole had considered Ordinance No. 3679, entitled "An Ordinance concerning the construction of extensions and additions to the waterworks owned and operated by the City of South Bend, Indiana, authorizing the issuance of revenue bonds to provide for the cost thereof, and matters connected therewith", and recommended the adoption of said ordinance as introduced, Councilman Kemper moved that Ordinance No. 3679 be read in full and be placed on final passage. This motion was seconded by-Councilman Erler and adopted by the following votes Ayes: Councilmen Stanley Korpal, Albert Tellson, C1oyd A. Bestle, Clem Niezgodski, Walter G. Glass, Alvin P. Kemper, Walter C. Erler and Chester E. Muszynski. Nays: None The ordinance having been read, Councilman Glass moved that Ordinance No. 3679 be passed and adopted as read. This motion was seconded by Councilman Bestle, and on call of the roll was carried by the following votes Ayes: Councilmen Stanley Korpal, Albert Tellson, Cloyd A. Bestle, Clem Niezgodski, Walter G. Glass, Alvin P. Kemper, Walter C. Erler and Chester E. Muszynski. The .Presiding Officer announced that said ordinance had been duly passed and adopted.
