President Niezgodski presided. The reading of the minutes of the previous meeting was waived PETITION . South Bend, Indiana To the Mayor and the City Council of the `City of South Bend, Indiana GREETINGS: November 19, 1948 We, the undersigned, as taxpayers and voters and as designated representatives of the occupants of Southmore and Beacon Heights, do hereby respectfully request: "That the City Council go on record, rescinding its action on the resolution, voted upon in the previous Council meeting, requesting the Federal Gover to release above named projects to the City of South Bend, Indiana, as low income housing projects, as we feel that most of our people still are and will be engaged in work for the Government". We respectively request, that for the good of all concerned, this petition be recognized as a sincere appeal, that a more sound solution may be found to this problem. (4 Signers) Southmore Respectfully, (6 Signers) Beacon Heights Councilman Korpal made a motion that the President appoint all members of the Council to study the petition and report back to the Council on December 13th. Motion carried* COMMUNICATION Honorable Common Council of the City of South Bend South Bend, Indiana Gentlemen: November 18, 1948 On august 99 1948, I filed a petition for the adoption of an ordinance amending Zoning Ordinance No. 2331 by making a tract 9.16 acres in area available for light industrial uses. An Ordinance for that purpose was Introduced and referred to the City Plans Commissions after public hearing thereon, the members of the Plan Commission reported and recommended against the adoption of such ordinance. Under these circumstances, I respectfully withdraw such petition so filed by me on behalf of William M. Hass on August 9, 1948. It is my, opinion that the withdrawal of the petition automatically withdraws the ordinance Itself* If, however, in the opinion of the City Attorney, further action on your part be required for the withdrawal of the ordinance itself, I request that such action be immediately taken. REPORT OF BOARD OF PUBLIC WORKS AID SAFETY Members of the Common Council City Hall South Bend, Indiana Gentlemen:. Respectfully„ VITUS G. 'JONES, as the :agent of and Attorney for William M. Hass granted to withdraw the petition. Councilman Korpal November 9, 1948 ft Attached hereto please find copies of reports submitted by Mr. William Qualls, Electrical Superintendent, on petitions for street lights at the following locations: Sorin and Arthur Streets; Olive and Calhoun Streets; where Bertrand dead -ends at Johnson Street; at Vassar and Olive Streets and eight lights in Bblle Village. The Board approved these installations and directed Mr. Qualls to order them in. Also one 1000 lumen light at the alley intersection on Elm Street between Colfax and Washington Avenues. Mr. Qualls also informed the Board that lights ordered in at Washington Avenue and Ellsworth Place; Hastings and 32nd Street; Brookfield Street and awing Avenue; 36th and Hastings Street; on Cherry Street between Washington and Jefferson; at Fellows and Bowman Street and at LaPorte and Blaine Avenues. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City'of South Bends November 22, 1948 Your Committee of the Whole to whom was referred "An ordinance appropriating from ghe General Fund of the City of South Bend of the following amount to the following indicated account of the 1948 budgets Fire Department, Q-7249 Motor Equipment, $30,000.00, and declaring an extraordinary emergen oy." Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable. STANLEY C. REPORT OF THE COMMITTEE OF THE MOLE To the Common Council of the City of South Bends November 22, 1948 Your Committee of the Whole to whom was referred *An ordinance transferring the sum of $5,000.00 from Account Number S-42, Ikges, to Account Number S -13, Extra and Over -Time, Street Department, and declaring an extra- ordinary emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable. STANLEY C. KORPAL, Chairman Councilman Tellson made a motion that the report be accepted. Councilman Kemper seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bends November 22, 1948 Your Committee of the Whole to Whom was referred "An ordinance appropriating from the General Rind of the City of South Bend, Indiana, of the following amount to the following indicated account of the 1947 budget, City Election Board, - $10,611.29, and declaring an extraordinary emergency". Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable. The ordinance was given third reading and passed by a roll cal vote of 8 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE F0. 3678 ORDINANCE AMENDING ORDINANCE NO. 2331 (AS AMENDED) - COMMONLY ICNm AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first reading by title and second reading in full. Councilman Erler made a motion s for uspension of rules. Councilman Glass seconded the motion. Motion carried by a roll call vote of 8 ayes 0 nays. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. RESOLUTION AUTHORIZING CERTAIN PAYMENTS TO BE MADE TO SALARIED CITY EMPLOYEES, WHEREAS, the City of South Bend, Indiana, is approaching the close of its fiscal year, and, WHEREAS, the office of the City Controller will be required to make numerous payments and close its numerous and complicated accounts; and, WHEREAS, it is desirable that the work of said office be simplified when possible; now, THEREFORE, be it resolved by the Common-Counoil of the City of South.Bend, Indiana: Section 1. That all salaried officers and employees of the City shall be paid their salaries for the month of ec b er, 1948, on the 20th day of said month. Section 2. The Controller of the City of South Bend is hereby authorized to make said salary payments upon said *date. Section 3. This resolution shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. RESOLUTION WHEREAS, on August 23rd, 1948, a petition has been submitted to the City Council and is now in the hands of the Planning Commission for consideration for rezoning a parcel of unplatted land Bast of Twyckenham Drive extending several hundred feet beyond Greenlawn Avenue and fronting on the St. Joseph River and adjacent to North Side Boulevard which extends from South Bend to Mishawaka; and, WHEREAS, this land was known as Island Park and used by many as a park although never dedicated as a park; and, WHEREAS. this land has a virgin stand of timber and is one of the last remaining beauty spots in the City fronting on the St. Joseph River; BE IT RESOLVED BY THE CITY PLAN COMMISSION THAT: Before rezoning this unplatted parcel of land for private use every, consideration be given this land for park purposes, and a copy of this resolution be presented to the Park Board, Mayor, and the City Council. Motion carried. RESOLUTION WHEREAS, in the Budget of the City of South Bend, Indiana, for the year 1948, it was anticipated that the amount of Twenty Thousand Dollars($20,000.00) would be transferred from the City Water Works of said City to the General Fund of said City, and WHEREAS, in the Budget, as finally passed and approved, such item was included and anticipated; NOW, THEREFORE, be it resolved by the Common Council of the City of South Bend, Indiana, that* NOVEMBER 22ND, 1948 1. The proper officers of the City Water Works of South Bend, Indiana, be, and the same are, hereby authorized and directed to transfer forthwith, the sum of Twenty - Thousand Dollars ($20,000900) from and out of the funds of said Tater Works to the General Fund of the City of South Bend. 2. This Resolution shall be in full force and effect from and after its adoption by the Common Council and its approval by the Mayor. W. C. ORDINANCE N0. 3679 AN ORDINANCE CONCERNING THE CONSTRUCTION OF EXTENSIONS AND ADDITIONS TO THE WATERWORKS OWNED AND OPERATED BY THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE ISSUANCE OF REVMWE BONDS TO PROVIDE FOR THE COST THEREOF, AND MATTERS CONNECTED THEREWITH. The Clerk presented and read to the Council the resolution adopted by the Board of Public Works and Safety requesting the Council to authorize the issuance of waterworks revenue bonds to provide funds for certain improvements to the waterworks, said resolution being as follows. to-wit: 'RESOLUTION OF THE BOARD OF PUBLIC WORKS AND SAFETY" WHEREAS,..The Board of Public Works and Safety, acting as Waterworks Commissioners, has heretofore determined that certain additions and extensions to the waterworks owned and operated by the City of South Bend are required in order to provide for additional water supply., water storage and to improve distribution, and has employed Charles W. Cole & Son, consulting engineers of South Bend, to assist in determining the exact additions and extensions needed and the estimated cost thereof; and WHEREAS, the additions and extensions recommended by said engineers included the construction and installation of a twenty-four inch South Side Main, two new wells, seven million gallon elevated ground storage tank, Coquillard Supply Main, Sample Street Supply Main, addition to booster station, and Northwest Supply Main, and the estimated cost thereof, including all incidental expenses necessary to be incurred in connection with said project and the issuance of revenue bonds on account thereof is in the amount of Nine Hundred Fifty Thousand Two Hundred Forty -six Dollars ($950,246.00); and WHEREAS, in order to obtain Rinds for application on said project it will be necessary to issue revenue bonds payable out -of the future - revenues of the waterworks, and a form of ordinance for that purpose ^.has.:been .pr.epar.ed. at the request of the Board of Public Works and Safety by Ross McCord.Ice & Miller, bond counsel of Indianapolis, which Form of- ordinance.is satisfactory to the Board of Public Works and Safety; now therefore# BE IT RESOLVED by the Board. of Public Works and Safety of the City of South Bend: 1. That the additions and extensions to the municipal waterworks of the City recommended by the consulting engineers be approved, and that, subject to proper action by the Common Council and the Poblic Service 'Commission of Indiana, this Board determine to proceed with the qon- struction and installation of the additions and extensions hereinabove referred to. 2. That, subject to proper action by the Common Council and the Public Service Commission of Indiana, the cost of said additions and extensions be financed by the issuance of revenue bonds in the amount of Nine Hundred Fifty Thousand Dollars ($950,000.00), which bonds and the interest thereon shall be payable solely out of future revenues of the municipal waterworks of the City, and that,said bonds be issued in-aocordance with the terms and conditions set out in the form of ordinance prepared by bond counsel employed by the Board of Public Works and Safety, and that said form of ordinance be approved. 3. That a copy of this resolution and said form of ordinance be presented to the Common Council for consideration and action as soon as may be done, in view of the fact that the proceeds of said bonds will be needed for application on said project on or about March 1, 1949, and such bonds cannot be issued until approved by the Public Service Commission of Indiana. 49 That in the event said ordinance shall be enacted by the Common Council, then a proper petition shall be filed with the Public Service Commission of Indiana requesting authority to proceed with the construction and installation of said additions and extensions and the issuance of said bonds. Dated this 22nd day of November, 19481 (Signed) " Board of Public Works and Safety Councilman Meg godski thereupon introduced Ordinance No. 3679 entitled "An Ordinance concerning the construction of extensions and additions to the Water Works owned and operated by the City of South Bend, Indiana, authorizing the issuance of revenue bonds to provide for the cost thereof, and matters connected therewith" and moved that the Clerk be instructed to read said Ordinance in full. This motion was seconded by Councilman Tellson and carried. The Clerk then read said ordinance in full. Councilman Tellson then moved that said ordinance be read a second time by title, and that an opportunity be given for the offering of amendments, which motion was seconded by Councilman Korpal and carried. The Clerk then read the said Ordinance No. 3679 the second time by title. No amendments were offered thereto. REGULAR MEETING NOV MBER_22ND 1948 Councilman Tellson then moved that said Ordinance No. 3679 be referred to the Committee of the Wholet with instructions to report to the regular meeting of the Council to be held on December 13, 19489 and that further action on the ordinance be deferred until said meeting. This motion was seconded by Councilman Korpal and on call of the roll the same was carried by the following vote: Ayes: Councilmen Stanley Korpal, Albert Tellson, Cloyd A. Beetle, Clem Niezgodski, Walter G. Glass, Alvin P. Kemper, Walter Co Erler and Chester E. Muszyneki.
