HomeMy WebLinkAbout10-11-48 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chanber,- October 11th, 19480 at 8305 P.1[* with all members present. President Niezgodski presided. The reading of the minutes of the previous meeting was waived. COMMUNICATION A letter was received from Mrs, Kathryn Anderson, 5104 W, Edison Road., South Bend, Indiana, dated October 7th, 1948,- relative to the housing problem in South Bend* Councilman Korpal made a motion that the communication be placed on file. Councilman Kemper seconded the motion. Motion carried* REPORT OF THE C09MMITTEE OF THE WHOLE To the Common Council of the City of South Bend: October 11, 1948 Your Committee of the Whole to whom -was referred '"An ordinance appropriating from the General Street and Traffic Fund of the City of South Bend- Indiana, of the following amount to the following indicated account of the 1948 budget: Street Department, 5 -711., Properties, $70,000.000 and declaring an extraordinary emergency.e Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable• STANLEY Co KORPAL, Chairman Councilman Kemper made a motion to accept the report. Councilman Tellson seconded the motion. Motion carried. REPORT OF THE C09 9ITTEE OF THE WHOLE To the Common Council of the City of South Bendr October 11, 1948 Your Committee of the Whole to whom was referred "An ordinance amending Sections 4 and 9 of Ordinance No. 1781, adopted February-22, 1.9154 the same being entitled "An ordinance providing for the maintenance of lights and: guards at places where streets are being excavated or obstructed" and amending the title thereof.* Respectfully report that they have examined the matter and that in.their opinion this ordinance shall go to the Council as favorable. October 11, 1948 Your Committee of the 'Whole to whom was referred "An ordinance amending Ordinance No. 3571 entitled an ordinance regulating methods of design and installation of warm air, winter air conditioning systems and of gravity warm air heating systems and regulating the alteration, repair, remodelling and replacement of such systems or parts of systems in buildings of the City of South Bend, Indiana: providing penalties for the violation hereoft repealing any.; nd all ordinances in conflict therewith." Respectfully report that they have examined the matter and that in their opinion this ordinance be referred to the Building Code 'Committee and Plan commission. Councilman Erler made a motion to accept the report. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Ind. Gentlemen: STANLEY Co KORPAL, Chairman Councilman Kemper seconded the motionf Motion carried. October 8, 1948 Petition of Mort Be Marpbyj at al for change of zoning classification of Lots #219, 220, 221 in Berner Grove 1st Add* was considered by the City Plan Commission after an advertised hearing Oct. 7, 1948. This change is recommended as petitioned for. The property being on the north side of Mishawaka Ave. from 29th Street to the first alley east. The remainder of this block is now commercial. Motion carried• REPORT OF CITY PLAN COMMISSION To the Common Council October S. 1948 City of South Bend, Ind. Gentlemmen s Petition of Oliver J. and Marie Scott for change of zoning classification of Lots #1 and 2 in Lederer.a.nd Longley's Add. was considered by the City Plan Commission after an advertised hearing on October 7, 1948. This change is recommended as petitioned for. The property is on North Eddy Street, west side immediately south of Sorin St. THE CITY PLAN COMMISSION Ds MOOMAW, SEC'Y. Councilman Erler made a motion that the report be placed on file. Councilman Beetle seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING THE SUM OF $350.00 FROM ACCOUNT NO. N -120 REGULAR AND TEMPORARY LABOR, CEMETERY DEPARTMENT, TO ACCOUNT NO. N -261- TREE TRIMMING, CEMETERY DEPARTMENT, AND DECLARING AN EXTRA- ORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full, Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for Public Hearing on October 25th, 1948, at 8:00 P.M. Councilman Bestle seconded the motion. Motion carried, ORDINANCE AN ORDINANCE TRANSFERRING THE SUM OF $68900 FROM ACCOUNT NUMBER R -38, GENERAL SUPPLIES, WEIGHTS AND MEASURES, TO ACCOUNT NUMBER R -252, REPAIRS OF EQUIPMENT, WEIGHTS AND MEASURES; AND TRANSFERRING THE SUM OF $41.00 FROM ACCOUNT NUMBER R -333, TIRES AND TUBES, WEIGHTS Alai MEASURES, TO ACCOUNT NUMBER R "252, REPAIRS OF EQUIPMENT, WEIGHTS AND MEASURES, AND DECLARING AN EXTRAORDINARY EMERGENCY. The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for Public Hearing on October 25th, 19480 at 8sOO P,M. Councilman Kemper seconded the motion. ORD IN NICE AN ORDINANCE REGULATING THE WEIGHT OF VEHICLES TRAVELLING ON INDIANA AVENUE BETWEEN OLVE AND ,WALNUT STREETS, MAGNOLIA STREET BETWEEN PRAIRIE AVENUE AND INDIANA AVENUE, NASH STREET BETWEEN PRAIRIE AVENUE AND INDIANA AVENUE, AND PULASKI STREET BETWEEN CALVERT STREET AND INDIANA AVENUE. The ordinance was given first reading by title and second reading in full. Councilman Erler made a motion that the ordinance be referred to the Ordinance Committee. Councilman Glass seconded the motion. Motion carried. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays* MOTION Councilman Muszynski made a motion that the Board of Public Works take immediate action against the Olive and Meade Street hazards. Councilman Korpal seconded the motion. Motion oarried. Councilman Erler made a motion to amend the motion made by Councilman Muszynaki that the Northern Indiana Public Service Commission also be notified. Councilman Kemper seconded the -motimi Motion carried. Schock, wife of the Cityts Chief Executive, and WHEREAS, her untimely death has brought much grief and sorrow to her husband, her family and her many friends,. and WHEREAS, this community has been deprived of an able, intelligent, inspirational and gifted woman and citizen, NOW, THEREFORE, BE IT RESOLVED, That we, the Common Council of the City of South Bend do hereby extend to the Mayor, the Honorable George A.. Schock, and to his entire family, our sincere sympathy in this, their hour of deepest sorrow; and BE IT FURTHER RESOLVED, That a page in the records of the City be set aside and this Resolution be copied therein and that a copy duly certified by the Clerk be sent to the bereaved.
