MEET
AUGUST 23RD, 1948
Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the
Council Chambers, August 23rd, 1948, at 8:00 P.M., with all members present except Councilman Muszynski.
President Niezgodski presided. The reading of the minutes of the previous meeting was waived.
PETITION
TO THE HONORABLE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA
The undersigned, owners of the real estate herein described by virtue of a certain contract of purchase, hereby
respectfully petition the honorable Common Council of the City of South Bend, Indiana to rezone certain real
estate situated in the City of South Bend, Indiana, herein described, from its present zoning of "B" Residence
Use li.strict and "A" Height and Area District to "C" Commercial Use District and "E" Height and Area District.
Said real estate being more particularly described as follows, to -wits
A part of the North East Quarter (Na) of Section Eighteen (18), Township
Thirty -four (34) North, Range Three (3) East, and more particularly described
as follows: Beginning at a point which is 1359 feet South of the Northwest
corner of the North East Quarter (NE-41) of said Section Eighteen (18), thence
East 670 feet, thence North 770 24' East 459 feet, thence East 177.60 feet
to the West line of the North East Quarter (NED of the North East Quarter
(NE!,) of said Section 18, thence North 157.1 feet more or'less, to the center
line of Hildreth St. produced East,. thence East 259.4 feet, thence North
162.6 feet to the Southwest corner of a traet*of land owned by Frederick H.
Coppsl thence East 288.3 feet more or less, to the East line of the grantor
herein, thence South 480.6 feet to the water's edge of the St. Joseph River,
thence in a Westerly and Southwesterly direction along the water's edge to
a point which is 108.55 feet East of the North and South half Section line,
thence North 305.44 feet, thence West 55 feet, thence North 402.36 feet to
a point which is 50 feet East of the place of beginning, thence West 50
feet to the place of beginning, and containing 23.4 acres more or less.
Excepting from said 23.4 acres the area dedicated to street and boulevard
purposes for Greenlawn Avenue, Twypkenham Drive and North Shore Boulevard.
The purpose of said rezoning herein petitioned for is to use said above described real estate as a site on
which to erect a building to be used as a fraternal club.

Councilman Erler made a motion that the petition be referred to the City Plan Commis.sion._ Councilman Korpal
seconded the motion. Motion carried.
REPORT OF THE COMMITTEE OF THE WHOLE
To the Common :Council of the !City of South Bend: August 23, 1948
Your Committee of the Whole to whom was referred "An ordinance transferring the sum of Two Hundred and Fifty
($250.00) Dollars, from Account Number Q -11, Salaries, Fire Department to Account Number Q -222, Gas,'Fire
Department; and the sum of One Hundred ($100.00) Dollars from Account Number Q -11, Salaries, Fire Department
to Account Number Q -214, Telegraph and Telephone, Fire Department, and declaring an extraordinary emergency.
Respectfully report that they have examined the matter and that in their opinion this ordinance shall be
reported to the Council as favorable.

carried.
REPORT OF THE COMMITTEE OF TIM WHOLE
To the Common Council of the City of South Bend: August 23,1948
Your Committee of the Whole to whom was referred "An ordinance mending Sections % 16 and 21 of Ordinance No.
2979 of the Ordinances of the City of South Bend, Indiana, and Section 1 of Ordinance No. 3309 of the Ordinances
of said city, and Section 1 of Ordinance No. 3359 of the Ordinances of said City which amendments provide for
an application form for licenses; provide for the duties of the City Controller and Chief of Police; Provide
for hearing upon such taxicab and taxi driver licenses; provide the stapdards upon which such licenses may be
granted; provide for an appeal of applicants for taxicab licenses; provide for the revocation and reinstatement
of such licenses, and all licenses relating to the driving of taxicabs; provide for bonds or insurance policies
protecting the public; provide for taxi stands and for payment for the use of taxi stands; and repealing all
ordinances, or parts of ordinances in conflict herewith.
Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported
to the Council as favorable.

CALENDAR YEAR 1948; APPROPRIATING SAID SUM OF MONEY FOR THE USES AND PURPOSES OF
BUDGETARY ACCOUNT 12, SERVICES PERSONAL, LABOR, CAPE AND UPKEEP OF BUILDINGS,
EQUIPMENT AYD GROUNDS, OF THE PARK DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA;

The ordinance was given first reading by title and second reading in full. Councilman Glass made a motion
that the ordinance be referred to the Committee of the Whole for Public Hearing on September 13th, 1948 at
8 00 P.M. Councilman Tellson seconded the motion. Motion carried.
President Niezgodski, directed the Clerk to notify the Board of Park Commissioners to attend the next regular
meeting of the Council on September 13th for further explanation of the transfer of funds requested by the
Park Department.
ORDINANCE NO. 3655
AN ORDINANCE TRANSFERRING THE SUM OF TWO HUNDRED AND FIFTY ($250.00) DOLLARS,
FROM ACCOUNT NUMBER Q -11, SALARIES, FIRE DEPARTMENT TO ACCOUNT NUMBER Q -222,
GAS, FIRE DEPARTMENT; AND THE SUM OF ONE HUNDRED ($100.00) DOLLARS FROM ACCOUNT
NUMBER Q -11, SALARIES, FIRE DEPARTMENT TO ACCOUNT NUMBER Q -214, TELEGRAPH AND
TELEPHONE, FIRE DEPA RTULNT, AND DECLARING AN RXTRAORDINARY EMERGENCY.

AN ORDINANCE AMENDING SECTIONS 39 16 AND 21 OF ORDINANCE N0. 2979 OF THE ORDINANCES
OF THE CITY OF SOUTH BEND, "INDIANA, AND SECTION 1 OF ORDINANCE NO. 3309 OF THE
ORDINANCES OF SAID CITY, AND SECTION 1 OF ORDINANCE NO. 3359 OF THE ORDINANCES OF
SAID CITY WHICH AIENDMENTS PROVIDE FOR AN APPLICATION FORM FOR LICENSES; PROVIDE
FOR THE DUTIES OF THE CITY CONTROLLER AND CHIEF OF POLICE; PROVIDE FOR HEARING
LION SUCH TAXICAB AND TAXI DRIVER LICEITSES; PROVIDE THE STANDARDS UPON VEICH SUCH
LICENSES MAY BE GRANTED; PROVIDE FOR AN APPEAL OF APPLICANTS FOR TAXICAB LICENSES;
PROVIDE FOR THE REVOCATION AND REINSTATEMENT OF SUCH LICENSES, AND ALT, LICENSES

The ordinance was -given third reading and passed by a roll call vote of 7 ayes - 0 nays - 1 absent (Muszynski).
MOTION
Councilman Korpal made a motion that the rrommitteets investigation pertaining to hazardous railroad crossings
be postponed for 90 days in order to give the railroad companies more time to make said repairs.
Upon motion of Councilman Korpal, seconded by Councilman Erler, Council adjourned at 9:00 P.M.
