President Niezgodski presided, The reading of the minutes of the previous meeting was waived. PETITION To the Common Council of the City of South Bend and City Clerk July 80 1948 Gentlemen: We the undersigned property owners of Lots 94 and 95, Hartman do Miller Addition, South Bend Ave., petition your honorable body to rezone from Class B, Res. PETITION To the Honorable Board of Public Works and Safety of the City of South Bend, Indiana Gentlemen: We the undersigned property owners, petition your honorable body to eliminate the smoke nuisance and traffic hazard caused by the South Bend Smelting & Refining Co., 1610 Circle Ave. (44 Signers) Councilman Korpal made a motion that the petition be referred to the Board of Public Works and Safety. Councilman Kemper seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE VE OLE To the Common Council of the City of South Bend: July 26, 1948 Your Committee of the Whole to whom was referred "An ordinance appropriating from the General Street an.d Traffic Fund of the City of South Bend, Indiana, of the following amount to the following indicated account of the 1948 budget: Street Department, S -53, Refunds, Awards and Indemnities, $2,000.00, and declaring an extraordinary emergency. Respectfully report that they have examined the matter and that-in their opinion this ordinance shall be referred to the Council as favorable. REPORT OF THE COMMITTEE OF THE WUOLE To the Common Council of the City of South Bend: July 26, 1948 Your Committee of the Thole to whom was referred "An ordinance amending Ordinance No. 2331, commonly known as the Zoning Ordinance of the City of South Bend, Indiana. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be referred to the Council favorably as amended. STANLEY C. REGULAR ING REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: July 26, 1948 a Your Committee of the Whole to whom was referred "An ordinance providing for the annexation of certain territory to the City of South Bend, Indiana (Belleville Unit A Proposed). Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported favorable. STANLEY C. REPORT OF THE CITY CONTROLLER OF THE CITY OF SOUTH BEND, INDIANA, FOR THE MONTH OF JUNE, 1948. Balance first of month $ 1,158,116.62 Receipts during month 329,183.94 Disbursements 316,623.60 Balance June 30, 1948 Councilman Kemper made a motion that the report be accepted and placed on file. Councilman Glass seconded the motion. Motion carried. ORDINANCE AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA (BELLEVILLE UNIT A PROPOSED) The ordinance was given third reading. A roll call was ordered and immediately there4m a motion was made by Councilman Tellson to lay the ordinance on the table until the next meeting on August 9th >fof1 third reading: 0eunaf.1A W -- Glass' seconded the motion. ORDINANCE AN ORDINANCE APPROPRIATING THE SUM OF FIVE HUNDRED ($500.00) DOLLARS FROM THE GENERAL FUND OF THE CITY OF SOUTH BEND, INDIANA, TO THE FOLLOWING INDICATED BUDGETARY ACCOUNT C -36, OFFICE SUPPLIES, OF THE 1948 BUDGET IN THE OFFICE OF THE CITY CLERK, AND DECLARING AN EXTRAORDINARY EMERGENCY. This ordinance was given first and second reading. Councilman Korpal made a motion that the ordinance be referred to the Committee of the Whole for Public Hearing on August 9th, 1948, at 8:00 P.M. Councilman-Bestle seconded the motion. Motion carried. ORDINANCE 1700. 3651 AN ORDINANCE APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIANA, OF THE FOLLOWING AMOUNT TO THE FOLLOWING INDICATED ACCOUNT OF THE 1948 BUDGETS STREET DEPARTMENT, S -53, REFUND$, .AWARDS AND INDEMNITIES, $2,000.00, AND DECLARING AN EXTRAORDINARY EMERGENCY. This ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. ORDINANCE NO. 3652 AN ORDINANCE AMENDING ORDINANCE NO. 2331, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH. BEND, INDIANA. This ordinance was given third reading and passed by a roll call vote of 7 ayes - 1 nay (Bestle). RESOLUTION WHEREAS, on the 19th day of December,. 1945, the City of South Bend leased from the Bendix Avation Corporation, a tract of unimproved land within the City Limits, known as Lots numbered ninety -one (91) to one hundred sixty -one (161) both inclusive in Westchester Second Unit, a sub - division within the City of South Bend, Indiana, for a term ending December 31, 1947, for the purpose of providing tempoikary housing for returning veterans and their families, and WHEREAS, on January 21, 1948, the said lease was extended, by a supplemental agreement with the City of South Bend, to September 30, 1948, with the understanding that no further extension would be made, other than for liquidation after complete vacation of the -project, and WHEREAS, the units now occupying said lots are of such type as not to permit same to be moved to any other site and there being no site available, and WHEREAS, tenants now occupying units are now in reality; residents by sufferance, and continued rentals of units until liquidation would create a hardship at the last moment of occupancy: NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THAT FOR THE PURPOSE OF FULFILLING THE TERMS OF THE AFORESAID LEASE, FROM AND AFTER AUGUST 1, 1948, ANY AND ALL VACANCIES ARISING WITHIN THE BENDIX SITE OF PROJECT IND -V -12223 WHICH PROJECT IS SITUATED ON LOTS DESCRIBED HEREIN ABOVE, BE AND THE SAME ARE HEREBY ORDERED TO REMAIN VACANT AND NOT SUBJECT TO RMITAL DURING THE PERIOD BETWEEN SAID DATE AND ACTUAL LIQUIDATION. Motion carried. 4 + � REGULAR MEETING JULY 26TH, 1948 Councilman Glass made a motion that the Clerk be instructed to notify the railroad companies (New York Central, Grand Trunk, Pennsylvania and New Jersey) that the meeting scheduledfor August 30th will be held on August 23rdq at 8:00 P.M. Councilman Korpal seconded -the motion. Motion carried. Councilman Erler made a motion that the Committee on Miscellaneous Business drag up a resolution regarding the use of diesel engines in South Bend, and report to the Council on August 23rd. Councilman Glass seconded the motion. Motion carried. There being no further business before the Council, Councilman Kemper made a motion to adjourn, which was seconded by Councilman Glass.
