HomeMy WebLinkAbout05-24-48 Council Meeting MinutesMAY 24TH, 1948 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chambers, City Hall, May 24th, 1948, at 8:00 P.M., with all members present. President Niezgodski presided at the meeting. The reading of the minutes of the previous meeting was waived. COMMUNICATION Gentlemen: May 8, 1948 A bill is being formulated for the state legislature entitled "Abatement of Smoke in Indiana ". The nature of this bill is not to discourage the use of any particular fuels, but to regulate and encourage the rp oper operation of fuel burning devices in order to keep the pollution of the atmosphere at a mindmum. Realizing that the larger cities of Indiana are most severely affected by this nuisance, letters of inquiry, as to their favorability of such a public measure, are being sent to all of the cities on that basis. Upon receipt of letter will you express your feelings on such legislation or kindly forward to an organization or interest group in your city that will inform the writer at the earliest possible date. Since Indiana has no state legislation on this subject and the apparent need for such is to great, I intend to have the subject bill introduced at the next session of the state legislature. REPORT OF BOARD OF PUBLIC WORKS AND SAFETY Members of the Common Council City Hall South Bend, Indiana Gentlemen: May 21, 1948 Attached herewith please find copies of reports made by Mr. Qualls to the Board of Public Works and Safety recommending the installation of a street light at the intersection of Queen and Allen Streets and also a street light at the intersection of Hawthorne Drive and Washington Street. The Board approved these recommendations and authorized Mr. Qualls to order them installed. Councilman Tellson made a motion that the report be accepted. carried. Motion May 20, 1948 Attached hereto please find reports on petitions for street lights at Dunham and Olive Street, McKinley Avenue and Sylven Glen; 35th and Washington Streets; Oakerest :Drive and Sylven Glen; Sylven Glen and Colfax Avenue; Windingwood and Devonshire Drive; On Mishawaka Avenue between Eddy Street and Beyer Avenue; on Mishawaka Avenue at Beyer Avenue; At Mishawaka - ;Avenue and Oakland Street; at Mishawaka Avenue and Twyckenham Drive; at Mishawaka Avenue and Bellevue; on the North side of Mishawaka Avenue between Twyckenham Drive and Greenlawn Avenue, four lights; on the North side of Mishawaka Avenue between Greenlawn Avenue and 20th Street, two lights; on the South side of Mishawaka Avenue between Greenlawn and 20th Street; on Twyckenham Drive between Mishawaka Avenue and Wall Street, two lights; on Twyckenham Drive between Mall and Hoover Streets;- and two lights which had been turned off on Victoria Street between Clyde Street and Twyckenham Drive. These were all ordered installed by the Board. Mr. Qualls also informed the Board that lights ordered in at the alley intersection between Main and?:LaEayette North of Navarre Street; at Ewing Avenue and Gertrude Street; Prairie Avenue and Swygart Street; Prairie Avenue and Olive Street; Clyde Street and Calvert Street; on Wilbur Street between 'Elwood and Humboldt; and seven lights in the new addition bounded by Riverside Drive and Inglewood Place and Woodlawn Boulevard and Culver Place. REPORT OF COW.4ITTEE OF THE NHOLE To the Common Council of the City of South Bend: May 24, 1948 Your Committee of the Whole to whom was referred "An ordinance appropriating from the General Street and Traffic Fundof the City of South Bend, Indiana, the following amounts to the indicated accounts of the 1948 budget: Street Department, S -12, Wages, $34,535.10; Street Department, S -36, Office Supplies, $250.00; Street Department, S -38, General Supplies, $1000.00; Street Department, S -331, Gasoline and Oil,.$3,500.00; Street Department, S -333, Tires and Tubes, 01,000.00; Street Department, S -334, Other Garage and Motor Supplies, $500.00; Street Department, S -451, Parts and Equipment, $2,000.00; and declaring an extraordinary emergency. Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council as favorable. STANLEY C. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana Gentlemen: May 22, 1948 Petition of Earl C. Hollis, et al for change of zoning classification of property on the south side of Mishawaka Avenue between 25th and 26th Streets from "B" Residence and "A" Height and Area Districts to "C" Commercial and "E" Height and Area District was acted upon by the City Plan.Commission at a Special Meeting on May 21st for which public hearing was advertised. The City Plan Commission recommends this change as petitioned for. D. Moomaw, Seely. Councilman Erler made a motion that the !City Attorney be instructed to draw up an ordinance according to recommendations of the (City Plan Commission. Councilman Tellson seconded the motion. Motion carried. REPORT -OF CITY PLAT? COMMISSION To the-Common Council City of South Bend, Indiana Gentlemen: May 22, 1948 The original petition for change of zoning classification of a large area in LaSalle Park Addition has been amended to include only the south 120 feet of Lots 1034, 1037, and the north 120 feet'of Lots 1033, 1048, 1053 together with Lots 1, 2 and 3 in Russell Subdivision of Lot 1068 of LaSalle Park Addition. The City Plan Commission considered this amendecpetition at a special meeting May 21, 1948 at which this matter was advertised for public hearing. This change is recommended as asked in the amended petition. D. Moomaw, Seely. The location of this property is shown on accompanying plat. Councilman Erler. made a motel on.that the City Attorney be instructed to draw up an ordinance according to recommendations of the City -Plan Commission. Councilman Tellson seconded the motion. Motion carried. P.EPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Indiana May 22, 1948 ft Gentlemen: Ordinance for change of zoning classification for Lots 18 and 19 in Elias Rupels Addition from "E" Height and Area .District was considered at a special meeting of the City Plan Commission on May 21, 1948. Public Hearing on this matter was held at that time as required by state law. This change is recommended by the City Plan Commission. D. Moomaw, Seely. Councilman Korpal made a motion that the report be accepted. ;Councilman Kemper seconded the motion. Motion carried. This ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays. Councilman Korpal made a motion for suspension of rules. Councilman T'ellson seconded the motion. Motion carried. The ordinance was given third reading and passed by a roll call vote of 8 ayes - nays. RESOLUTION WHEREAS, the City of South Bend now pays into the State General Fund $243,000.00 through the imposition and collection of a State property tax of 15,d per hundred dollars of assessed valuation, and WHEREAS, it is claimed that the State of Indiana has a cash surplus of over sixty million dollars, and the City of South Bend does not have sufficient money or tax resources from which to meet its necessary expenses, and WHEREAS, over twenty States have eliminated the general property tax rate and released this tax base to the local communities of their States, and WHEREAS, organizations of citizens throughout the State of Indiana are advocating the abolition of the State property tax rate, NOW, THEREFORE, BE IT RESOLVED: The 'Common Council of the City of South Bend, in regular meeting convened this 24 day of May, 1948, does hereby respectfully request the State Board of Finance to eliminate the State property tax under the provisions of Chapter 27, Section 10 of the Acts of 1941 by determining that the revenues of the State which will be received during the current fiscal year are sufficient to meet the demands against such revenues and thereby release the State property tax rate of 15/ to help finance local government needs. BE IT FURTHER RESOLVED: That we respectfully petition the 1949 General Assembly of the State of Indiana to enact the necessary legislation to provide for the elimination of the State property tax rate and to direct the financing of State government from otter sources of revenue. AND BE IT FURTHER RESOLVED: That copies of this resolution shall be forwarded to the State Board of Finance, to the Governor, State Auditor, State Treasurer and to the local press. WALTER C.
