HomeMy WebLinkAbout05-10-48 Council Meeting MinutesREGULAR MEETING Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chambers, City Hall, May 10th, 1948, at 8:00 P.M., with all members present. President Niezgodski presided at the meeting. The reading of the minutes of the previous meeting was waived. CONMUNICATI ON Mr. Clem Niezgodski Council Chambers City Hall South Bend, Indiana My dear Mr. Niezgodski: May 10, 1946 May I suggest to you and-the Honorable Members of the Common Council that an investigation be made of potential sites for the dumping and depositing of refuse ordinarily accumulated on private property and City streets. The Executive and Administrative officers of the City have come to the conclusion that numerous unsightly spots within the =City limits can be eliminated if we can locate one or two new locations for the dumping of trash and other debris. We believe that this is a logical conclusion or at least a step forward in the progress attempted in making South Bend a cleaner municipality. The personnel of your committee, individually and collectively, will have the cooperation of the proper depart- ments within the Administration. Trusting that this may have the support of the Common Council and assuring you of my cooperation in all things that may work for the common good of the citizens of this corr=nity, I remain GAS�em, Respectfully, GEORGE A. PETITION STATE OF INDIANA ) SS PETITION TO CHANGE ZONING ST. JOSEPH COUNTY ) TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND: The undersigned, SOUTH BEND CURRENT CONTROLLER COMPANY, by its duly authorized officer, hereby and by these presents petitions your Honorable Body and respectfully shows that it is the owner, in fee simple, of Lots 46 and 47, Baker & McHenry's Addition to the City of South Bend that are now zoned as "B" Use District and "A" Height and Area District. That said'Company is also the owner of Lots 48, 49, 50 and 51 of Baker & McHenry's Addition to the City of South Bend that are zoned for "D" Use District and "E" Height and Area District, and that they have heretofore constructed on Lots 48, 49, 50 and 51 a one -story brick and glass building, which building fronts on North Side Boulevard, and your petitioners now petition your Honorable Body to change the zoning of Lots 46 and 47, Baker & McHenry's Addition to the -City of South Bend from "B" Use .District and "A" Height and frea District, to "D" Use District and "E" Height and Area District, and thereby to conform to Lots 48, 49, 50 and, 51 which are contiguous to and joins Lots 46 and 47. Your petitioners further show that Lots 46 and 47, Balker & McHenry's Addition front on Roberts Avenue, each Forty (40) feet, a total of eighty (80) feet, with a depth of 119.95 feet, and the south corner of Lot 46 is 284.7 feet from the North Side Boulevard. Your petition®rs further request that this petition be referred to proper officials and be placed in the appropriate channel for consideration of this petition. REPORT OF THE COb1aITTEE OF THE WHOLE To the Common Council of the City of South Bend: May 10, 1948 Your Committee of the Whole to whom was referred an Ordinance amending Ordinance No. 966, adopted May 13, 1895, entitled as a general codifying ordinance, by adding a new section thereon in reference to blocking of street crossings by railroad train or cars to be known as Section 273 -1/2, and prescribing penalties. Respectfully report that they have examined the matter and that in their opinion this ordinance go back to the Committee of the Whole for public. hearing on July 12th, 19489 STANLEY C. KORPAL, Chairman Councilman Erler made a motion that the report be accepted. Councilman Kemper seconded the motion. Motion carried. REGULAR TJlEET REPORT OF THE CCT21ITTEE OF THE 1'FiOLE To the Common Council of the 'City of South Bend: May 10, 1948 Your Committee of the Whole to whom was referred an ordinance ordering and protiding for the conveyance of the following described parcels of real estate in the City of South Bend, St. Joseph County, Indiana, to -wit: Lots One Hundred Fifty -nine (159) and one Hundred Sixty (160) in Coquillard 'goods Addition, Section A, to the City of South Bend, St. Joseph County, Indiana, which real estate is owned by the City of South Bend, Indiana, by virtue of a conveyance made pursuant to order of the St. Joseph Superior Court # 2, in the matter of the administration of Coquillard Woods Addition Consolidated Barrett Law Trust, made and entered on the 19th day of December, 1944. IN EXCHANGE FOR THE FOLLOWING DESCRIBED PARCEL OF REAL ESTATE IN ST. ORDINANCE AN ORDINANCE APPROPRIATING FROM THE GENERAL STREET AND TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIANk. THE FOLLOWING AMOUNTS TO THE INDICATED ACCOUNTS OF THE 1948 BUDGET: STREET DEPARTMENT, S -12, WAGES, $34,535.10; STREET DEPARTMENT, S -36, OFFICE SUPPLIES, $250.00; STREET DEPARTMENT, S -38, GENERAL SUPPLIES, $1,000.00; STREET DEPARTMENT, S -331, GASOLINE AND OIL, $3,500.00; STREET DEPARTMENT, S -333, TIRES AND TUBES, $1,000.00; STREET DEPARTMENT, S -334, OTHER GARAGE AND MOTOR SUPPLIES, .._- .$500.00; STREET DEPARTMENT, S -451, PARTS AND EQUIPMENT, $29000.00; AND DECLARING AN EXTRAORDINARY EMERGENCY. This ordinance�waz given first and second reading. Councilman Tellson made a motion that the ordinance be set for Public Hearing on May 24th, 1948, at 8 :00 P.M. Councilman Kemper seconded the motion. Notion carried. ORDINANCE NO. 3638 AN ORDINANCE ORDERING AND PROVIDING FOR THE CONVEYANCE OF THE FOLLOWING DESCRIBED PARCELS OF REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, TO -WIT: . Lots One Hundred Fifty -nine (159) and One Hundred Sixty (160) in Coquillard Woods Addition, Section A, to the City of South Bend, St. Joseph County, Indiana. which real estate is owned by the 'City of South Bend, Indiana, by virtue of a conveyance made-pursuant to order of the St, Joseph Superior Court 2, in the matter of the administration of Coquillard Woods :Addition Consolidated Barrett Law Trust, made and entered on the 19th day of December, 1944. This ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nayes. The :Clerk was instructed to notify Mr. Ernest Miller, Traffic Engineer, ­to appear at the next.regular meeting of the Council on May 24th, 1948, at 8:00 P.M.
