President Niezgodski presided at the meeting. the reading of the minutes of the previous meeting was waived. PETITION To the Common Council City of South Bend, Indiana Gentlemen: April 2, 1948 A petition of Mrs. Anne Phillips and others filed January 13, 1948, for change of zoning of a large area in LaSalle Park Addition has been amended by a petition of Guy Nesbit, et al. for the rezoning of a lesser area as described in the accompanying amendment to petition and as shown on the attached map. This amended petition was considered by the City Plan Commission at their regular meeting April 1st, 19480 The City Plan Commission recommended that the change be made for the area described in the amended petition and that the change be made to "C" Commercial and "D" Height and Area District. D. Moomaw, Seely. Councilman Erler made a motion that the petition be referred back to the City Plan Commission for publication. ,Councilman Kemper seconded the motion. Motion carried. PETITION To the Honorable City Council for 'the City of South Bend, Indiana The undersigned, being residents and free - holders, and residing on or near West Indiana Avenue, respectfully petition your Honorable Body, that Indiana Avenue, between Olive Street and Walnut Street be declared a boulevard, and that all trucks other than light delivery trucks, be prohibited from using such section of Indiana avenue.` (108 Signers) Councilman Erler made a motion that the petition be referred to the Streets and Alleys Committee. Councilman Kemper seconded the motion. Motion carried. PETITION To the Honorable Board of Public Works and Safety of the City of South Bend, Indiana Gentlemen: We the undersigned property owners, petition your honorable body to change the zoning from Residential to Commercial Mishawaka Avenue, 25th St. to 26th St., South side of Mishawaka Avenue, from "B" use and "A" Height and'Area District to "C" Commercial and "E" Height and Area District* (4 Signers) Councilman Glass made a motion that the petition be referred to the City Plan Commission. Councilman Korpal seconded the motion. Motion carried. PETITION A Series of Petition to the City Council of South Bend, Indiana April 26,-1948 These petitions protest a proposed change in the zoning of Lots 1, 2 and 3,.John Adams lst Addition, from their present "B" (Residential) classification to "D" (Light Industrial). Said lots being at the northeast corner of South Esther and Ruskin Streets in an area of fine homes. (270 Signers) Councilman Kemper made a motion that the petition be accepted and placed on file. REPORT OF THE COMMITTEE OF THE WHOLE To the Common `Council of the City of South Bend: April 26, 1948 Your Committee of the Whole to whom was referred an Ordinance amending Ordinance No. 2331 (as amended) commonly knosrn as the zoning ordinance of the City of South Bend, Indiana. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported favorable as amended. STANLEY C. REGULAR MEETING APRIL 26th, 1948 , REPORT OF THE COMMITTEE, OF THE WHOLE To the Common Council of the City of South Bend: April 26, 1948 Your Committee of the Whole to whom was referred this Ordinance amendatory of Ordinance No. 2331 adopted by the Common Council of the City of South Bend, Indiana, on June 25, 1923, commonly !mown as the toning ordinance. Respectfully report that.they have examined the matter and that in their opinion this ordinance shall be reported favorable as amended. STANLEY C. KORPAL, Chairman Councilman Erler made a motion that the report be accepted. Councilman Niezgodski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: April 26, 1948 Your Committee of the Whole to whom was referred an Ordinance appropriating from the General Fund of the City of South Bend, Indiana, of the following amount to the following indicated account of the 1948 budget: Fire Department, Q -724, Motor Equipment, $3,375.00, and declaring an extraordinary emergeneyr Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported favorable. Whole to whom was referred an Ordinance to amend Sections 1, 9, 11 and 12 of Ordinance No. 3377, adopted July 14, 1941, commonly known as rubbish hauling ordinance, and adding a new section thereto to be known as Section No. 11 -1/2. Respectfully report that they have examined the matter and. that in their opinion this ordinance shall be reported favorable as amended. STANLEY . REPORT OF THE COMMITTEE OF THE YMOLE To the Common Council of the City of South Bend: April 26, 1948 Your Committee of the Whole to whom was referred an Ordinance amending Ordinance No. 2331. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported unfavorable. STANLEY C. ORDINANCE AN ORDINANCE ORDERING ARID PROVIDING FOR THE CONVEYANCE OF THE FOLLOWING DESCRIBED PARCELS OF REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA, TO -WIT: Lots One Hundred Fifty -nine (159) and One Hundred Sixty (160) in Coquilla rd Woods Addition,.Section A, to the City of South Bend, St. Joseph County, Indiana. which real estate is owned by the City of South Bend, Indiana, by virtue of a conveyance made pursuant to order of the St. Joseph Superior Court # 2, in the matter of the administration of Coquillard Woods Addition Consolidated Barrett Law Trust, made and entered on the 19th day of December, 19449 IN EXCHANGE FOR THE FOLLOWING DESCRIBED PARCEL OF REAL ESTATE IN ST. Councilman Kemper seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 2331 This ordinance was given third reading and lost by a roll call vote of 8 nays - 0 ayes. This ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays, ORDINANCE NO. 3637 THIS ORDINANCE IS AMENDATORY OF ORDINANCE N0, 2331 ADOPTED BY THE C011 MON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, ON JUNE 25TH, 1923, COMMOFLY KNOWN AS THE ZONING ORDINANCE. this ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays.
