HomeMy WebLinkAbout05-26-47 Council Meeting Minutes1947 Be it remembered that the Common Council of - the City of South Bend, Indiana, met in Regular Session in the Council Chambers, City Hall, May 26th, 1947, at 7 :40 P.M.,-,with all members present except Councilmen Hull and McCarthy. The reading of the Minutes of the previous meeting was waived. Pne-siddfft Brannan presided. COMMUNICATION A Communication was read from 1.7. J. Bachus, of the Collection Department of the Gross Ineome'Tax Division, Ind ianapolis, concerning outstanding Gross Income Tax liability for the years of 1937, 1938, 1939, 1940 and 1941. Councilman Richardson made'a motion that the communication be referred to the Legal Department. Councilmea Bishop seconded the motion. Motion carried. COMMUNICATION A Communication was read from C. S. Haffner, Ex. Seely of the Izaak Walton League of America, with regard to opening the lagoon at Pinhook for swimming, Councilman Richardson made a motion that this communication be referred to the Park Board. Councilman Niezgodski seconded the motion. Motion carried. PETITION To the Comanon Council City of South Bend, Indiana. May 24th, 1947. Gentlemen: The undersigned owners of more than 50% of the property herein described respectfully petition your honorable body to amend Ordinance Number 2331 , as it applieas to the property described as: Lot 1 -2 Wenger and Kreighbaum Vistula Avenue Addition Changing the same from its present classification as B residence abd A height and area district to C Commerical and E height and area district. ( 4 Signers) Councilman Bishop made a motion that the petition be referred to the City Plan Commission. Councilman Niezgodski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE UCHOLE To The Common Council of the City of South.Bend: May 26, 1947. Your Committee of the 'Whole, to whom was referred an Ordinance amending Ordinance No. 2331, commonly known as the "Zoning Ordinance" (Drewerys:.;) Respectfully report that they have examined the matter and that in their opinion this Ordinance shall) be reported to the Council as favorable. Wm J. Richardson,, Chairman Councilman Bishop made a motion that the report be accepted. Councilman Korpal seconded the motion. Motion carried. REPORT OF THE CITY PLAN COMMISSION: To The Common Council of the City of South Bend. May 26th, 1947. Gentlemen: Petition for change of zoning classification of Lots 117 and 118 and a part of #116 in the origin4l plat of South Bend together with a portion of a vacated street, from B residence district to C commercial was considered by the City Plan Commission at a spegial meeting May 22, 1947. The City Plan. Commission recommends that this change be made as petitioned for. D. MOOMAW, Seely Councilman Niezgodski made a motion that the report be accepted. ORDINANCE NO. 3599 AN ORDINANCE AMENDATORY OF ORDINANCE NO. 2331, ADOPTED BY THE COMMON COUNCIL, OF THE CITY OF SOUTH BEND, INDIANA, ON JULY 25, 1923, COMMONLY KNOWS AS THE "ZONING ORDINANCE ". (DREWRYS LIMITED, U.S.A.,INC.) The Ordinance was given third reading and passed by a roll call- vote of 7 ayes - 0 nays - 2 absent (Hull and McCarthy) ORDINANCE AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN T=ERRITORY TO THE CITY OF SOUTH BEND, INDIANA. (EDISON PARK) The Ordinance was given first and second reading. Councilman Bishop made a motion that the Ordinance be referred to the Committee of the 'Whole for Public Hearing on June 9th, 1947, at 7 :30 P.M. Councilman Korpal seconded the motion. Motion carried. 467 REGULAR MEETING- contd ORDINANCE MAY 26th, 1947. AN ORDINANCE PROVIDING FOR THE ANNEXATION OF CERTAIN TERRITORY TO THE CITY OF SOUTH BEND, INDIANA. (HOODED ESTATES) The Ordinance was given first and second reading. Councilman Bishop made a motion thatthe Ordinance be referred to the Committee of the 'Whole for Public Hearing on June 9th, 1947, at 7 :30 P.M. Councilman Korpal seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING MONIES FBDM THE GENERAL FUND OF THE CITY OF SOUTH BEND AND APPROPRIATING SAID SUMS FOR THE USES AND PURPOSES OF THE FOLL0WING BUDGETARY ITEMS, TO -WIT: TO H251, REPAIR OF BUILDING: TO H51, INSURANCE, DECLARING AN URGENCY The Ordinance was given first and second reading. Councilman Bishop made a motion that the Ordinance be referred to the Committee of the 'Whole for Public Hearing on June 9th, 1947, at 7 :30 P.M. Councilman Korp al seconded the motion. Motion carried. RESOLUTION WHEREAS, The Housing Authority of the City of South Bend, Indiana, is now administering Housing . Projects Numbered 12197 and 12188 pursuant to the provisions of an agreement with the Federal Public Housing Authority; and, M- EREAS, the Local Housing Authority has been notified by the Regional Office of the Federal Public Housing. Authority that it must make application not later than May 31, 1947, for the reservation of these projects for low rent use; and, WHEREAS, Six Hundred Fifty (650) families presently'oecupy the units comprising said projects and no other accommodations are available to them in this community; and, WHEREAS, it appears to be in the best interests of the people in this community that these projects be continued under the management.of The Housing Authority of The City of South Bend; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section 1. That The Housing Authority of The City of South Bend, Indiana, be and it is hereby authorized and instructed to take such steps as may be necessary or desirable for reserving Projects Numbered 12197 and 12:188 for low rent use.. Section,2. That the application made by The Housing Authority of The City of South Bend, Indiana,# shall be made, on the express condition that the City of South Bend shall not be liable for the payment of any part of the purchase price for the acquisition of said projects but this condition shall not in any manner prevent the Housing Authority from issuing its bonds or other obligations in payment for said projects. Section 3. That the Mayor of the City of South Bend be requested.to assist and co- operate with tie Local Housing Authority in its effort to reserve said projects for low rent use. ,f IM J RI CHARDSON Member of the Common Counci Councilman Bishop made a motion that the Resolution be held in the Committee of the %ale for further study.
