in the Council Chambers, City Hall, January 13th, 1947, at 7:40 P.M., with all members present except
Councilman Hull. President Brannan presided. The reading of the Minutes of the previous meeting was waived.
COMMUNICATION
A communication was-read from J. P. Scofield, Division Engineer of the New York Central Systems, dated
December 28th, 1946, with regard to the repairs made to various street crossings in the City of South Bend,
during the summer and fall of 1946.
Councilman Niezgodski made a motion that the communication be placed on file. Councilman Bishop seconded
the motion. Motion carried.

and until his successor shall be elected and qualified, and

be performed by such County Treasurer.
THEREFOR,', the condition of the above obligation is to the effect following, to -wit: That the said 011ie Fries
duly, honestly and faithfully discharge and perform all and singular,his duties to the above named City of
South Bend, during his continuance in office in all things agreeable to law.
PROVIDED, That the Common Council be authorized to change, modify, or repeal any Yaws, Ordinances and By -Laws
in'foree at the time of executing such Bond, and to enact any and all Laws, Ordinances and By -Laws, during the
existence of such Bond, at the pleasure of the Common Council, without in any:.wgy or manner releasing such
Officer and his sureites on such Bond, Such Officer and his sureties shall, in all things, be governed by such
Laws, "rdinances, and By -Laws; and such Bond shall be equally binding upon such Officer and his sureties as if
such Laws, Ordinances and By -Laws, had been in force at the time -of executing and inserted in such Bond. Then a

Councilman Heideman made a motion that the above Bond in the sum of $75,000.00 be approved. Councilman
Niezgodski seconded the motion. Motion carried.
REPORT OF COMMITTEE OF THE 'WHOLE
To The Common Council of the City of South Bend: January 13, 1947.
Your Committee of The'Vhole, to -whom was referred and Ordinance Regulating the use by Vehicles of Property
owned by the City of South Bend, Indiana: Providing rules and regulations covering such use; providing penalties.
Respectfully report that they have examined the matter and that in their opinion this Ordinance be reported to
the Council-as afvorable.
Councilman Richardson made a motion that the report be accepted.
Motion carried.
REPORT OF THE CITY PLAN'COMMISSION
To The Common.Council of the City of South Bend, Indiana.

Councilman McCarthy seconded the motion.
January 10, 1947.
Gentlemen:
Petition for change of zoning classification of property on the Northwesterly side of Prairie Ave., between
Nash Street and Jackson St., except Lot #1, Walnut 4th Add., from "C" Use and "D" Height and area District to
"B" use and - "A" Height and Area District was considered by the City Plan Commission at a special meeting,
January 9th, 1947.
This change is recommended as petitioned for.
The attached sheet shows in red shading, the property described in the petition.

REPORT OF CITY PLAN COMMISSION
January 10th, 1947.
To The Common Council of the Cite of South Bend, Indiana.
Gentlemen:
Petition of Lawrence Billisitz, et al, for-change of zoning classification of certain property on Indiana
Ave., between Nash Street and Grant Street, was considered by the City Plan Commission at a special meeting
January 9th, 1947.
These changes are recommended as petitioned for. The attached sheet shows the property described in the
petition shaded in red.
These properties might be more briefly described as
The property fronting on the North Side of Indiana Ave., from the East Side of Lot #310 Oliver's 2nd Add.,
West to Grant Street from "E" Use and "F" Height and Area District to "B" Use and "A" Height and Area District.
Also the property fronting on the South Side of Indiana Avenue from Magnolia Street to Grant Street, from "D"
Use and "E" Height and Area District to "B" Use and "A" Height and Area District.
