HomeMy WebLinkAbout07-22-46 Council Meeting MinutesBe it remembered that the Common Council of the City of South Bend, Indiana,,met in regular session in the Council Chambers, City Hall, on Monday, July 22nd, 1946, at 7:40 P.M., with all members present except Councilman Richardson and McCarthy. The reading of the Minutessof the previous meeting was waived. President Korpal presided. COMMUNICATIONS: The City Council, City Hall, South Bend, Indiana. Gentlemen: Holy Cross, Indiana. July 13, 1946 I am writing on behalf of the several hundred residents of Saint Mary's to register an objection to the proposed site of the treatment plant in the vicinity of Riverside drive across the river f rom.our grounds. In a recent investigation of the plant, now in operation at Marion, one -third of the visitors voted that such a plant at the proposed Riverside drive site would be undesirable. 7hile the plant itself was deemed by some to be "odorless" we cannot overlook the fact that the garbage wagons bringing refuse from the city of South bend and distributing the sludge to the consumers would not be free of odor and would be e.nything but desirable. It is true that installing the treatment at a more remote site would involve an additional expenditure of over a million dollars. However, when the great disadvantage to a large number of persons is weighed against the proportionately small per capita expense to a. very much larger group over a long period of years, it would seem that there should be no question as t6 the course to follow. Several years ago a tract of land at Pinhook was purchased by the City from Saint 'I..ary's for the installation of the sewage disposal system. It was a sacrifice on our part to give up that particular piece of land, but it was done unhesitatingly for the good of the community because the spot is isolated and the project would be detri- mental to no one. As the population of the City of South fend increases the residents are gradually moving to the outskirts of the city. As a civic project, the installation of a sewage and garbage disposal plant in the heart of what may soon become a popular residential section lacks farsightedness. Such a plant should be con- structed as far away from the city as possible and not along a constantly used river boulevard. Hawk, husband and wife, state "we are the owners of Lot .Number One Hundred Eighty -four (184) and Lot Number One hundred eighty -five (185), Second Plat of Park Place Addition to the City of South Bend, Indiana; and that said property* is located on the South east corner of Eddy Street and Chalfant Street in the City of South Bend, Indiana, and that said real estates are in "B" use District and "B" Height and Area District pursuant to Ordinance No. 2331, which is known as the "Zoning Ordinance of the City of South Bend." Petitioners herein are desirous that said ordinance be amended by changing the zoning classification of the above described lots from "B" residential district to "C.'..' July 15, 1946 TO ZiE HONORABLE C014UiON COUNCIL OF THE CITY OF SOUTH BZ0, INDIANA: Gentlemen: South Bend Band and Gravel Company respectfully represents and alleges: 1. It has long been and is now the owner in fee simple or in possession and control of a tract of real estate in the City of.South Bend, Indiana, bounded by a line running as follows: Beginning at the Northwest corner of Section 34, Township 38, North, Range 2-East; thence East a distance of 1,320 feet; thence South a disten ce of 2,415.6 feet; thence 71est a distance of 750.1 feet; thence South a distance of 824.4 feet to the Northeast corner of Lot 208 in Lincoln Terrace Addition] thence ;'hest to the Northwest corner of Lot 225 in said Addition; thence South to the Southwest corner of Lot 228 in mid Addition; thence Northwesterly along the Southwesterly line of Lots 228 and 234 in said addition to the intersection of such line and the center line of Bendix Drive; thence North to the place of beginning. 2. Although legal title to said three lots is vested in the Chicago, South Shore and South Bend Railroad, petitioner has long enjoyed and now enjoys the use and control thereof as incident to the conduct of its industrial operations on the land described in paragraph 1. 3. The land described in paragraph 1 is now zoned as "A" Residence District and "A" Height and Area District. Petitioner desires that said area be rezoned as "E" Heavy Industrial District and "a" Height and Area District. REPORT OF THE COMMITTEE OF THE 11HOLE TO THE COYMON COUNCIL OF THE CITY OF SOUTH BEND: July 22nd, 1946, Your Committee of the Mhole to was referred an Ordinance creating a position of Assistant Plumbing Inspector, Appropriate funds for'the salary of an Assistant Plumbing Inspector during the balance of the budgetary year of 1946; declaring an emergency. Respectfully report that they have examined the matter and that in their opinion this Ordinance should be reported to the Council favdrable. . Councilman Neezgodski made a motion that the report be accepted. Councilman Heideman seconded the motion. Motion carried. REPORT OF THE CITY PLAN COMMISSION , To The Common Council of the City of South Bend. Gentlemen: July 12, 1946 Petition of Stephen W. and Carrie M. Vavul, for change of zoning classification of Lot #189 of the Original Plat of South Bend was considered by the City Plan Commission at a special meeting July 11th. This lot is known as 519 and 521 No. Main Street. The City Plan Commission recommends the change as petitioned for and it further recommends that the change be extended to,include Lots #187 and 188. Lot 187 being now occupied by the South Bend Medical Laboratory at the corner of Main and Navarre Sts. Lot 188 lies next South of the Medical Laboratory property. Yours truly, D. MOOMAW, Secy. Councilman Bishop made a motion that the report be accepted. Motion carried. REPOIU OF THE CITY PLAN COMMISSION To the Common Council of the City of South Bend. Gentlemen: Councilman Brannan seconded the motion. July 12, 1946 Petition of-C. D. Smelser for change of zoning classification of 26 ft. of the East side of Lot #17, together with Lots J418 and X19, in Studebaker's Leeper Avenue Addition from "A" residence district to "B" residence district,was considered by the City Plan Commission at a special meeting July 11th. These lots lie on the South side of E. North Shore Drive immediately lest of the New York Central Railroad tracks at Niles Avenue. The City Plan Commission recommends this change as petitioned for. Attached hereto is a written remonstrance ow owners of proper on E. North Shore Drive Lnd by reason of this remonstrance a three- fourths vote of the Council will be necessary to make this chage. D. ORDINANCE NO. .3564 AN ORDINANCE CREATING A POSITION OF ASSISTANT PLUMBING INSPECTOR, APPROPRIATE FUNDS FOR THE SALARY OF AN ASSISTANT PLUMBING INSPECTOR DURING THE DALANCE OF THE BUDGETARY YEAR OF 1946: DECLARING AN EMERGENCY The Ordinance was given third reading and passed by a roll call vote of 7 ayes- 0 nays - 2 absent (Richardson and McCarthy) ORDINANCE AN ORDINANCE PROVIDING FOR THE S AFETY OF PERSONS AND PROPERTY AND PROVIDING FOR THE ISSUANCE OF PERMITS PROVIDING FOR INSPECTION 1-ND FOR RULFS AND REGULATION ?S GOVERNING ALL PLACES OF ASSEMBLY: PROVIDING PENALTIES FOR VIOLS ^.TIONS: AND REPEALING ALL ORDINANCES IN CONFLICT HEREWITH The Ordinance was given first reading. Councilman Brannan made a motion that this Ordinance be held up until the Fire Chief and the City Attorney are present to explain the Ordinance. Councilman Mirocha seconded the motion. Motion carried. Councilman Mirocha made a motion that the City Clerk ascertain whether there is a City Ordinance prohibiting the blowing of train whistles within-the City and if so, that a letter be sent to the Grand Trunk Railroad, calling their attention to this matter, especially the blowing of train whis*es at Arnold and Olive Street. Councilman Niezgodski seconded the motion. Motion carried. There being no furthar business, Council adjourned at 8 :10 P.M. ATTEST: CLERK
