HomeMy WebLinkAbout04-08-46 Council Meeting MinutesII REGULAR MEETING APRIL 8th, 1946 Be it remembered that the Common Council of the City of South Bend, Indiana,-met in regular session in the Council Chambers, City Hall, on Monday, April 8th, 1946, at 7 :45 P.M., with all members present except Councilman Hull. The reading of the Minutes of the previous meeting was waived. COMMUNICATION: A communication from Mrs. L.M. Coffman, 415 Victoria Street, South tend, in reference to the Bus Company and the City acquiring the Old Grand Trunk Depot for a centralized bus terminal, was read. Councilman Richardson made a motion that the communication be referred to the Transportation Committee. Councilman Bishop seconded the motion. Motion carried. COMMUNICATION: A letter from C. _.R. Steck, Secretary of the St. Joseph - County Building Trades Council, dated April 3rd, 1946, with regard to firemen of the City of South Bend, doing painters work upon the City Fire Stations, was read. Councilman Richardson made a motion that the communication be turned over to the Board of i Public Works and Safety, and that the Council concurs *th::thi6 a:etter. Councilman Niezgodski seconded the motion. Motion carried. COMMUNICATION: A letter from Raymond E. McCloud, Secretary of the Trinity Methodist Church, dated March 29th, 1946, with regard to a speaker provided by the Isaac Walton League, whb spoke on the sawage disposal, was read. Councilman Niezgodski made a motion that the communcation be placed on file. Councilman McCarthy seconded the. motion. Motion carried. COMMUNICATION: A letter from "The Happy Unfortunates of Southmore Heights "'dated March 29th, 1946, relative to change of management at Southmore Heights, was read. Councilman Heideman made a motion that the communication be turned over to the City Housing Authority for their attention. Councilman Bishop seconded the motion. Motion carried. PETITION: South Bend, Indiana. To the Honorable Board of-Public Works and Safety April 1, 1946. of the City of South Bend, Indiana. Gentlemen: We, the undersigned property owners, petition your honorable body to install a street light on the corner of Donald and Scott Streets. (24 Signers) Councilman Bishop made a motion that the petition be referred to the Board of Public Works and Safety. Councilmen Heideman seconded the motion. Motion carried. (Councilman Mirocha made a suggestion that Mr. Qualls, Supt. of the City Electrical Department, be contacted and see what is holding up'these petitions ;. that there are several petitions on which nothing has been done.) This was not in the form of a motion. PETITION: March 10th, 1946. We, the undersigned respectfully request the South Bend City Council to authorize the installation of four (4) additional street lights beginning with the corner light on East Fairview at Clyde Street and extending two (2) blocks west to Marine Street. The concrete light posts are already installed and all that would be required would be the top fixtures and bulb in each light. (6 Signers) Councilman Heideman made a motion that the petition be referred to the Board of Public Works and Safety. Councilman Bishop seconded the motion. Motion carried. PETITION: A petition for mutual home ownership of Southmore Heights War Housing Project. (105 Signers) Councilman McCarthy made a motion that the communication from Mr. Reid, which accompanied the petition, and the petition be accepted and placed on file. Councilman Bishop seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE 1EOLE TD MIE COMMON COUNCIL-OF-THE CITY OF SOUTH BEND: Your Committee of the Whole, to whom was referred an Ordinance amending Ordinance No. 2331, which is known as the "Zoning Ordinance of the City of South Bend ", be amended by changing the zoning classification of the following lots in the City of South Bend described as follows, to -wit: Lots numbered thirteen (13), sixteen (16), seventeen (17), twenty (20), twenty -one (21) and twenty -four (24) as shown on the recorded plat of Parry's Second Addition to the City of South Bend, St. Joseph County,•Indiana, from "B" Residential District to "C" Commercial.District and from "B" Height and Area District to "D"; Height and Area District. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported to the Council favorably. Councilman Bishop made a motion that the report be accepted. Councilman Niezgodski seconded the motion. Motion carried. REPORT OF THE CITY PLAN COMMISSION: April 5th, 1946. To The Common Council, City of South Bend, Indiana. Gentlemen: The City Plan commission considered the proposed ordinance for change of zoning classification of property fronting on E. Hefferson Blvd., from 29th St., East 2 mile. This is unplatted land extending 1800 ft. north from its frontage on Jefferson Blvd., It is the recommendation of the City Plan Commission that no change be made in the zoning classification of property on E. Jefferson Blvd. D. MOOMAW, Secy Councilman Bishop made a motion that the report be accepted. Councilman Heideman seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To The Common Council, City of South Bend, Indiana. Gentlemen; April 5th, 1946. At.their_.regulde= meeting April 4th, 1946, The City Plan Commission considered the petition of the Walnut Grove Mutual Housing Corporation for change of zoning classification of the property of the Project. This property fronts on E. Jefferson Blvd., from 26th St., to 29th St. It is the recommendation of the City Plan:Commission that no change be made in the zoning classification of property on E. Jefferson Blvd. Councilman Bishop made a motion that the report be accepted. Motion carried. ORDINANCE NO: 3555 AN ORDINANCE AMENDING ORDINANCE NO. 2331 Parry's Second Addition to the City o South Bend) (Eddy Street across from Jefferson School) D. MOOMAW, Secy Councilman Brannan seconded the motion. The Ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays - one absent (HU11) ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 2331 COMJ0 4Y KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. (Bercliff Estate) The Ordinance was given first and second reading. Councilman Richardson made a motion that the Ordinance be set for Public Hearing'on April 22nd, 1946, but later change to April 29th, 1946. Councilman Brannan seconded the motion. Motion carried. ORDINANCE AN ORDINANCE TRANSFERRING $600.00 FROM THE STREET AND TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIAPyA, TO AN INSURANCE ACCOUNT IN THE BUDGET OF THE STREET DEPARTMENT OF SAID CITY FOR THE MENDER YEAR 1946 AND APPROPRIATING SAID $600.00 FOR THE USE OF SAID FUND: DECLARING AND EMERGENCY. The Ordinance was given first and second reading. Councilman Bishop made a motion that the Ordinance be set for Public Hearing on April 22nd, 1946, but later changed to April 29th, 1946. Councilman Brannan seconded the motion. Motion carried. ORDINANCE AN ORDINANCE REGULATING METHODS OF DESIGN AND INSTALLATION OF WARM AIR WINTER AIR CONDITIONING SYSTEMS, AND OF GRAVITY WARM AIR HEATING SYSTEMS AND REGULATING THE ALTERATION, REPAIR, REMODELING AND REPLACEMENT OF SUCH SYSTEMS OR PARTS OF SYSTEMS IN BUILDINGS OF THE CITY OF SOUTH BEND, INDIANA, AND REPEALING ANY AND ALL ORDINANCES IN CONFLICT THEREWITH. The Ordinance was given first and second reading. Councilman Richardson made a motion that the Ordinance be held up until each of the Councilmen is furnished with a copy of the Ordinance. Councilman Brannan seconded the motion. Motion carried. Mile) 1 ( 51 Signers) DMI REMONSTRANCE PROTEST AND REMONSTRANCE WITH RESPECT TO THE REZONING OF REAL ESTATE 'WITHIN THE WALNUT GROVE MUTUAL HOUSING CORPORATION (26th to 29th Streets on.East.Jefferson Blvd.) ( 2. Signers) POSTPONED MEETING: Councilman Mirocha made a motion that the regular meeting of April 22nd, 1946, be postponed until April 29th, 1946'and that all business scheduled for the April 22nd, 1946 regular meeting be postponed until April 29th, 1946. Councilman McCarthy seconded the motion. Motion carried. RESOLUTION: YYHEREAS, representatives of the Southmore Mutual Housing Corporation have requested the Common Council of the City of South �end,•Indiana, to indicate its official approval of their plan for operating the Southmore Heights housing project under a non - profit mutual ownership plan, and WHEREAS, the Common Council has examined into the plan of said mutual ownership corporation, and WHEREAS, the Common Council has examined a statement of policy of the Federal Public Housing Authority for sales to such corporations. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that: 1. This Council go on record as officially approving the mutual ownership plan of the Southmore Mutual housing Corporation, and that this Council recommends that the Southmore Heights Housing project be sold to the said Southmore Mutual Housing Corporation, and BE IT FURTHER RESOLVED that a copy of this resolution be sent by the City Clerk, together with an appropriate letter of trangmittal to Mr. Philip M. Klutzniek, Commissioner, Federal Public Housing Authority, Washington, D.0 Clem Nie;godski Member of the Common Council Councilman Richardson made a motion that this Resolution be held in obeyance until some future date during the emergency. Councilman Heideman seconded the motion. Motion carried. Attorney George Beemer, was present at the meeting, representing property owners in the vicinity of Southmore Heights, who are apposed to this housing project being sold to a private corporation. Two petitions with 37 signers on one and 8 on the other opposing private ownership of the projects was handed too the Clerk after the reading of the Resolution. Wm Voor, Attorney for the City Housing Authority was present and read a letter from Orvil R. Olmsted, Director, Region III, Federal Public Housing Authority, Chicago, with regard to the Southmore Heights project. Hubert M. Weaver, representing the South Bend - Mishawaka Board of Realtors, was also present and stated they were opposed to private ownership of the Southmore Heights project.
