Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chambers, City Hall, on Monday, December 10th, 1945, at 8 P.M., with all members present except Councilman Mi.rocha. Councilman George Hull, Vice- President presided in the absence of President ,1irocha. The reading of the minutes of the previous meeting was waived. COT &ZUNI CATIONS: A letter from the Dairy Division of the South Bend Retail Credit Bureau, was read. A motion was made by Councilman Bishop that the communcation be placed on file. Councilman Neizgodski seconded the motion. Motion carried. was read, A letter from the Board of Public "Norks and Safety, in regard to a petition with four hundred and fifty -six (456) signatures that was presented to the Board of Public Works and Safety, at`their regular meeting on Monday, December 10th,, 1945, pertaining to bus service on the Fellows Street bus route in South Bend. A motion was made by Councilman Bishop that the communcation be placed on file. Councilman Neizgodski seconded the motion. Motion carried . PETITION: REMONSTRANCE:: TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AND THE CITY PLANNING COMMISSION OF THL CITY OF SOUTH BEND, INDIANA. Vve, the-undersigned residents, householders and freeholders in the immediate vicinity of the following described real estate in the City of south tend, County of St. Joseph, State of Indiana, "Beginning at a point that is 480 feet East of the 1`cest boundary line of Section No. 2, Township 37 North, Range No. 2 East and 400 feet South of the South line of Elwood Avenue; thence east on a line parallel with the South line of said Elwood Avenue in a distance of 495.feet; thence south on a line parallel with the 1"'est boundary line of said Section No. 2, Township 37 North, Range No. 2 East, a distance of 238.4 feet; thence West on a line parallel with the South line of said Elwood Avenue, a distance of 495 feet; thence North to the place of beginning, hereby respectfully object and disapprove of the re- zoning as a Class D, Light Industrial Listrict, and as Class F. REPORT OF THE COMMITTEE OF THE'MiOLE To the Common Council of the City of South Bend.: Your Committee of the Whole to whom was referred "An ordinance amending Ordinance No. 2331, commonly known as the Zoning Ordinance, Lot +12 and that part of Lot #13, Miami heights Addition ". Respectfully report that they have examined the matter and in their opinion this ordinance be reported favorably. 4 ayes (McCarthy, Brannap,Korp al and Niezgodski) 1 absent (Mirocha) 3 nays (Heideman, Bishop and Hull). Councilman McCarthy, made a motion that the report be accepted. Councilman Niezgodski "seconded the motion.. Motion carried. P.EPORT OF THE COMMITTEE OF THE Aq -iOLE To the Common Council of the City of South Bend: Your Committee of the thole to whom was referred "An ordinance amending Ordinance No. 3146 and entitled "An Ordinance regulating traffic upon the public streets of the City of South Bend, Indiana, and repealing all other ordinances and Sections of ordinances in conflict therewith ".(one way tr Respectfully report that they have examined the matter and in their opinion this ordinance be reported to the Grievance Committee for further study. Councilman Brannan made a motion that the report be accepted. Councilman Niezgodski seconded the motion, i,iotion carried. REPORT OF THE COMMITTEE OF THE 11ilIOLE To the Common Council of the City of South Lend: Your Committee of the IAVhole to whom was referred "An Ordinance transferring $13,,545.14 from the General Fund of the City of South trend, Indiana, and appropriating said amount for the uses and purposes of Budgetary Account #1261 - Contractual Services - in the Budget of the City of South Bend, for the calendar year 1946; Declaring an emergency ". Respectfully report that they have examined the matter and in their opinion this ordinance be reported favorably. Councilman Bishop, made a motion that the report be accepted. Councilman Heideman seconded the motion. Motion carried. Lc REPORT OF BOARD OF PUBLIC ITRKS AND SAFETY, Clyde E._7 illiams, Chairman: I ecember 10th, 1945 Members of the Common Council City of South Bend, Indiana. Gentlemen: The Board of Public 7 orks and safety was requested by the Council at its last regular meeting to provide the Council with street lighting information at its next regular meeting. The attached table and print is a record of street light installations in the River Park area, since January 1939. Part of the request was for action on the petiticn for a street light at 30th and Hastings Street. We were unable to find this petition, however, we did find a note signed by Mayor Pavey that reads as follows: "Councilman Brannon would like to have a street light located between Hastings and Grand Trunk moved to the Grand Trunk crossing and a new light placed at the intersecticn of Hastings and 30th Street. Since it is the policy for railroads to install the street lights at their crossings and at their expense, we notified the Grand Trunk officials of a request for a street light at this crossing. The Grand Trunk officials rejected the request stating that they were of the opinion that a street light at this crossing would not improve the condition especially with the new flasher type signals installed there ". No further action has been taken by the Board because it is felt that the one available light will serve a greater purpose in its present location than at the inter - section of 30th and Hastings Street. I 261 - CONTRACTURAL SERVICES - IN THE BUDGET OF THE CITY OF SOUTH BEND FOR THE CALENDAR YEAR 1946; DECLA.RING AN E14IERGEXY The Ordinance was given third reading and passed by a roll call vote of 8.ayes - 0 nays - 1 absent (Mirocha) RESOLUTION `�� .,{ ' tv, i- IiEREAS, a serious traffic hazard exists at iyIishawaka Avenue and Twyckenham Drive; And 17HEREAS, in the past several years at.least.two fatal accideiat have occurred at said inter - section; And, 1EEREAS, on numerous occasions residents: of the Community' have requested a traffic control signal light at this inter - section; And, ,HEREAS, some months ago a motion was unanimously passed by the Common Council of the City of South Bend, directing the Board of 't.lorks and Safety, through the Traffic Engineer, to proceed without furrth.er delay with the erection of said traffic control signal light at said inter - section; And, FulEREAS, for reasons best known to themsblves, the Board of Works abd Safety and Traffic, Engineer, Mr. Miller, ignored this directive by the Council. NOW THEREFORE, be it resolved by the Common Council of the'City of South Bend, Indiana, that the .11 oard of ,corks and Safety of the City of South =bend, Indiana, be directed to proceed at once and without further delay with the erection of a traffic control signal light of the automatic type similiar to the ones being used at other inter - sections over the City, at Mishawaka and Twyckenham Drive; And, NOW., THEREFORE, be it further resolved by the that the Board of Works and Safety be instructed to from the inter - 'section of Mishawaka Avenue and 30th Tirestern & Olive, 'and control lights be installed to rest of the City.
