REGULAR MEETING OCTOBER 8th, 1945
Be it remembered that the Common Council of the City cf South bend, Indiana, met in regular session
in the Council Cambers, City Hall, on 14onday, October 8th, 1945, at 8 :40 P.M., with all members
present except Councilman Hull. President Tirocha presided. The reading of the minutes of the previous
meeting was waived.
C0181UNI CAT IONS :
A communication from Nrs. A. Hansen, 1007 X. Allen Street, South bend, with regard to the proposed
change of time for the City of South Lend, was read and upon the motion of Councilman Bishop,
seconded by Councilman Neizgodski, it was ordered placed on file. Motion carried.
A communication from C. R. Steck, Secretary of the St.Joseph County Building Trades Council,
with regard to securing a local engineering firm to oversee the sewage disposal project coming up
in the near future, was read and upon the motion of Councilman Brannan, seconded by Councilman
Heideman, the communication was ordered placed on file. Motion carried.
A communication from Nathan Levy, City attorney, with regard to his conversation with the Corporation
Counsel of the City of Chicago, Mr. Barnet Hodes, concerning the continuation of Day Light Saving
Time or Central 7,7ar Time, was read and upon the motion of Councilman Richardson, seconded by Ccuncilman
Bishop, the communication was ordered placed on file. illotion carried.
A communication from F. Kenneth uempsey, Mlayor of the City of South Fend, in regard toOrdinance No. 3537,

made e motion that the Mayor and the City Attorney get together and bring before the Council such
amendments to the Ordinance as are necessary. Councilman Heideman seconded the motion. Motion carried.
A communication from James P. Conboy, Clerk of the Board of V'r`orks and Safety, together with the minutes
of two special meetin7s of the Board at which time the general subject matter of employment in
connection with the sewage disposal project was involved, were read and upon the motion of Councilmai
Heideman, seconded by Councilman. Bishop, the communication and minutes, were ordered placed on file.
Motion carried.
PETITION:
TO THE HONORABLE AIENB128 OF THE CO -151ON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA.
Ye, the undersigned owners in fee of the real estate situated on the North vest corner of Prairie
;Avenue, and Magnolia Street, comprising of lot number 19, Swygart's Third addition to the City of
South Bend, respectfully petition your Honorable Body for an amendment to the existing zoning code
of the said City, to provide for a change of said code as follows:
Wh`hereas, said area designated is now half "C" Commercial district, "D" Height and ,Area, and "B"
Residential, "A" Height and Area, it is the desire'of the undersigned comprising more than 501.
of the adjacent owners of the said block to change the said Residential and Height area district
as it affects the said Lot No. L9 to all "C" Commerical and "D" :eight and Area. •

;Notion was made by Council Neizgodski, seconded by Councilman Bishop, that the petition be referred to
the City Plan Commission. Motion carried.
REPORT OF THE COMMITTEE OF THE TOLE
To the Common Council of the City of South Send:
Your Committee of the thole to whom was referred "AN ORDINANCE AMENDING ORDINANCE #2331, AS AMENDED, OF
THE CITY OF SOUTH BEND, STATE OF INDIANA ".
Respectfully report that they have examined the matter and that in their opinion the ordinance shall
be reported to the Council as favorable.

Councilman Neizgodski made a motion that the report be accepted as read.. Councilman Korpal seconded the
motion. Motion carried.

Councilman Brannan, made a motion that the Ordinance be rejected as of second reading. Councilman Brannan
made another motion to withdraw his first motion and allow the Ordinance to go to third reading.
The Ordinance i1ras given third reading and -:as not passed by a roll tail vote of five nays and 3 ayes, one
absent (Councilman Lull)
There being no further business, Council adjourned at 8 :40 P.M.
