President Niezgodski presided. By agreement_, the reading of the minutes was omitted. CWTUNICATION To the Common Council, City of South Bend March 13, 1944 The Board of Public Works and Safety has been advised that the Railroads involved in the Meade Street and Arnold Street crossings have filed new applications to obtain gates and flasher signals for those crossings. BOARD OF PUBLIC WORKS AND SAFETY Councilman Heideman made a motion to place the communication on file. Councilman Bishop seconded the motion. Moti carried. Report of the City Controller for the month of February, 1944 was read and accepted on motion of Councilman Hull, seconded by Councilman Bishop. ORDINANCE AN ORDINANCE DEFINING RESTAURANT, FOOD, ITINERANT RESTAURANT, EMPLOYEE, UTENSILS, HEALTH OFFICER, AND OTHER TERMS: REQUIRING PERMITS FOR THE OPERATION OF SUCH ESTABLISHMENTS: PROHIBITING THE SALE OF ADULTERATED, UNWHOLESOME, OR MISBRANDED FOOD OR DRINK: REGULATING THE INSPECTION, GRADING, RE- GRAIDING AND PLACARDING OF SUCH ESTABLISHMENTS: PROVIDING FOR THE ENFORCEMENT OF THIS ORDINANCE: FIXING PENALTIES. The ordinance was given second reading. Councilman Brannan made a motion that in Section 2, paragraph (A), the license fee be, ,set at $2.0 per year. Councilman Richardson seconded the motion. Motion carriedTby a roll call vote of 9 ayes 0 nays. Councilman.Hull made a motion that the license fee per day (as shown in Section 2 (paragraph 3) be set at $5.00, said fee not to exceed $20.00 in one continuous operation. Councilman Bishop seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. Councilman Richardson made a motion to amend Section 6, Item 7, to read as follows: - -2A sample of water from private wells must be sent to a recognized laboratory twice each month - - - ". Councilman Brannan seconded the motion. Motion carried by a roll call vote of 9 ayes - o nays. Councilman Brannan made a motion that the ordinance be set for public hearing on March 27. Councilman Korpal seconded the motion. Motion carried. ORDINANCE NO. 3480 AN ORDINANCE APPROVING A CONTRACT FOR THE APPP ISAL OF THE PROPERTY AND EQUIPMENT OF THE CITY WATER WORKS OF SOUTH BEND, INDIANA, MADE AND ENTERED INTO BY AND BETWEEN THE CITY WATER WORKS OF SAID CITY, AND THE LLOYD - THOMAS COMPANY, APPRAISERS. The ordinance was given first and second reading. Councilman Bishop made a motion for suspension of rules., Council- man Hull seconded t�e motion. Motion carried by roll call vote of 9 ayes - 0 nays. Ordinance given third reading and :passed by roll call vote of-9 .ayes - 0 nays. ORDINANCE AN ORDINANCE APPROPRIATING $810.00 FROM THE GENERAL FUND OF THE CITY OF SOUTH BEND TO BUDGETARY ACCOUNT NO, B -11 OF SAIDD CITY, COVERING SALARIES FOR THE POLICE DEPARTMENT: DECLARING AN EMERGENCY. The ordinance was given first and second reading. Councilman Bishop made a motion to have public - hearing on March 27th. Councilman Miro:cha seconded the motion. Motion carried.
