President Pulaski presided. The reading of the minutes of the previous meeting was waived. 11 REPORT OF THE C0T@AITTEE OF THE WHOLE Nov. 23, 1942 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An ordinance declaring the making, continuing or cause. and aid to be made or continued, loud, or unnecessary, or unusual noises a public. nuisance, partially defining such noises, and imposing a penalty for violation." Respectfully report that they have examined the matter and that.in their opinion this ordinance shall be reported to the Council favorably. 70A. J. RICHARDSON, Chairman Pro Tem Councilman McCarthy made a motion to accept the report. Councilman Bishop seconded the motion. Motion carried. ORDINANCE NO. 3441 AN ORDINANTCE "DECLARING THE MAKING, CONTINUING, OR CATJSE AND AID TO BE MADt OR CONTINUED,- LOUD, OR UNNECESSARY; OR UNUSUAL NOISES A PUBLIC NUISANCE, PARTIALLY DEFINING SUCH - NOISES, AND IMPOSING A PENALTY FOR VIOLATION. The ordinance was given third reading and passed by a roll call vote of 7 ayes - O.nays - .2 absent (Jordan & B ORDINANCE AN .ORDINTANCE REDUCING IT3.1 Q17 OF THE BUDGET OF THE CITY OF SOUTH BEND, INDIANA, FOR THE YEAR 1943 BE THE AMOUNT OF $4500.00, TRANSFERRING THE LMOUNT OF $4500.00 FROM THE GENERAL FUND OF' THE CITY OF SOUTH BEND, INDIANA, TO THE BUDGETARY ITEM Q17 OF SAID CITY FOR THE YEAR 1942 AND APPROPRIATING SAID AMOUNT FOR THE PURCHASE OF FIRE.HOSE; APPROVING THE PURCHASE OF 3800 FEET OF FIRE HOSE FROM THE BI- LATERAL FIRE HOSE CCriPANY; DECLARING AN EMERGENCY. The ordinance was given first and second reading. Councilman Niezgodski made a motion to refer the ordinance to the Committee of the Whole for public hearing on December 14. Councilman Bishop seconded the motion. Motion carried. ORDINANCE NO. 3442 AN ORDINANCE k'Al -LADING ORDIN ?ANCE NO. 3324 (AS AMENDED) AND ENTITLED "All ORDINANCE DEFINING t'mILK" AND CERTAIN "MILK PRODUCTS ", "MILK PRODUCER ", "PASTEURIZATION, ETC., PROHIBITING THE SALE OF ADULTERATED ANTD MISBRANDED MILK AND IYaIILK PRO- UJCTS, REQUIRING PEMAITS FORT HE SALE OF MILK AND MILK PRODUCTS, R.EGUL.ATING THE INSPECTION OF DAIRY FARAS AND MILK PLANTS, THE EXAAMINATION, GRAD- ING, LABELING, PLACARDING, PASTEURIZATION, REGRADING, DISTRIBUTION, AND SALE OF MILK AND MILK PRODUCTS, PROVIDING FOR THE PUBLISHING OF MILK GRADES, THE CONST?UCTION OF FUTURE DAIRIES AND MILK PLANTS, PROVIDING FOR THE LICENSING OF DAIRIES -- RETAIL AND WHOLESALE DISTRIBUTORS, THE ENFORC34ENT OF THIS ORDINANCE, AND THE FIXING OF PENALTIES." The-ordinance was given first and second reading. Councilman Niezgodski made a motion to recommend that the Chair appoint a committee to investigate_ the shortage of milk. Councilman Bishop seconded the motion. Upon the request of Councilman Richardson, Council recessed for a five - minute period. Council reconvened at 8:37 P.M. Councilman Niezgodski withdrew him motion. Councilman Hull made a motion to suspend the rules. Councilman McCarthy seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 2 absent (Jordan and Brannan). The ordinance was given third reading and passed by a roll call vote. of 7 ayes - 0 nays - 2 absent (Brannan & Jordan) ORDINANCE AN ORDINANCE AUTHORIZING THE CHARGING OFF OF CERTAIN AMOUNTS FROM THE RECORDS OF THE PARK DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first and second reading. Councilman McCarthy made a motion that the ordinance be referred to the Committee of the Whole at the next meeting and.that a member of the Park Department be present to explain transaction. Councilman Bishop seconded the motion. Motion carried. ORDINANCE NO. 3443 AN ORDINANCE .AUTHORIZING THE APPRAISAL AND SALE OF CERTAIN BARRELTT LAW BONDS AND COUPONS AND THE INTEREST OF THE CITY WITH RESPECT THERETO ISSUED BY SAID CITY IN CONNECTION WITH IMPROVEMENT RE- SOLUTION N0. 2145. The ordinance was given first and second reading. Councilman Bishop made a motion to suspend the rubs. Councilman McCarthy seconded the motion. , Motion carried by a roll call vote of 7 ayes - 0 nayes - 2 absent (Jordan and Brannan) The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 2 absent (Jordan and Brannan). ORDINANCE NO.. 3444 AN ORDINANCE APPROVING THE LEASING OF CERTAIN LAND OWNED BY THE CITY OF SOUTH BEND, INDIANA, TO GEORGE A. ENRICH, DOING BUSINESS AS SOUTH BEND SCREW PRODUCTS COMPANY FOR WAR PURPOSES AND DECLARING AN EMERGENCY. The ordinance was given first and second reading. Councilman Bishop made a motion to suspend the rules. Councilman Heideman seconded the motion. Motion carried by a roll call vote of 7 ayes - 0 nays - 2 absent (Jordan and Brannan). The ordinance was given third reading and passed by a roll call vote of 7 ayes - 0 nays - 2 absent (Jordan and Branne here being no further business, Council adjourned at 8:50 P.M.
