HomeMy WebLinkAbout11-09-42 Council Meeting Minutes326 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chambers, City Hall, Monday, November 9, 1942. Councilmen Bishop, McCarthy, Pulaski and Jordan absent. Vice- Presi- dent Hull presided. The reading of the Minutes of the previous meeting was waived. REPORT OF THE COIPAITTEE OF THE WHOLE To the Common Council of the City of South Bend: Nov. 9, 1942 Your Committee.of the Whole to whom was referred "An ordinance requiring the New York Central R.R. Co. to install and maintain the latest improved automatic flashlight signals anal automatic shortarm gates at Olive and Meads Stre crossings with its right -of -way in the City of South Bend, Indiana ". Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council favorably. Wm. J. Richardson, Chairman Pro Tem Councilman Brannan made a motion to accept the report. Councilman Niezgodski seconded the motion. Motion carried. ORDINANCE NO. 3440 (as amended). V, AN ORDINANCE REQUIRING THE NER YORK CENTRAL RAILROAD COMPANY TO INSTALL AND MAINTAIN THE LATEST IMPROVED AUTOMATIC FLASHLIGHT SIGNALS AND .AUTOMATIC SHORTAml GATES AT OLIVE ANDMEADE STREETS CROSSINGS WITH ITS RIGHT -OF -WAY IN THE CITY OF SOUTH BEND, INDIANA. The ordinance was given third reading - Councilman Richardson made a motion that the ordinance be amended to read so as to include Section 3 as presented. Councilman Brannan seconded the motion. Motion carried.by 5 ayes - 0 nays - 4 absent. The ordinance was passed by by a roll call vote of 5 ayes - 0 nays - 4 absent. ORDINANCE AN Offl)INANCE DECLA_R_ING THE MAKING, CONTINUING,. OR CAUSE AID AID TO BE MADE OR CONTINUED, LOUD, OR UNNECESSARY, OR UNUSUAL NOISES A PUBLIC NUISANCE, PARTIALLY DEFINING SUCH NOISES, AND IMPOSING A PENALTY FOR VIOIATION. The ordinance was given first and second reading. Councilman Brannan -made a motion that the ordinance be referred to the Committee of the Whole for public hearing on November 23.
