President Richardson presided. City of South Bend, Indiana October 3, 1941 NOTICE OF THE HOLDING OF A SPECIAL MEETING OF THE SOUTH BEND CITY COMMON COUNCIL. TO: The Members of the Common Council of the City of South Bend: Notice is hereby given that a special meeting of the Couth Bend City Common Council is hereby called to meet in the Council Chambers of the South Bend City Hall at five o'clock P.M., Central Daylight Saving Time, on the 3rd day of October,, 1941. The purpose of calling said special meeting is for the consideration by the Common Council and the possible passage of an ordinance whereby the Mayor and the proper officials of the City of South Bend are authorized to purchase that real estate lying just South of the South B end city hall, the purchase of which real estate to be considered, being separated from the city hall by an alley which runs along the South side of the said city hall. Said strip of land is forty -four by one hundred and sixty feet. There will be further considered the manner in which thA -zproperty is to be purchased, if at all, and the source from which the money is to be obtained, if a purchase if finally authorized, J. I. ORDINANCE NO. 3398 AN ORDINANCE AUTHORIZING THE PURCHASE BY THE BOARD OF WATER WORKS TRUSTEES OF THE CITY OF SOUTH BEND, INDIANA, OF CERTAIN REAL ESTATE. WHEREAS, certain departments of the City of South Bend, Indiana, either now require or will soon require additional space for their efficient operation; and, WHEREAS, the Water Works of the City of South Bend will require additional space for its efficient operation; and WHEREAS, a certain piece of reat estate hereinafter described, is contiguous to property now owned by the City of South Bend and used by it as its City Hall; and, WHEREAS, it is possible for the Water Works of the City of South Bend to obtain such contiguous land at an advantag- eous prices NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, that: 1. The Board of Water Works Trustees of the City of South Bend, Indiana, is hereby authorized to purchase the real estate owned and described as - ALL OF LOT 8 OF THE ORIGINAL PLAT OF THE CITY OF SOUTH BEND, EXCEPTING THE NORTH 22 FEET THEREOF9 in accordance with the terms of a purchase agreement, a copy of which is attached hereto and made apart hereof. 2. .This ordinance -shall be in full force and effect from and after its passage by the Common Council and its a by the Mayor. The ordinance was given first and second reading. At this time the Mayor discussed the ordinance and rea$i the Contract. Councilman McCarthy made a motion for the suspension of the rules. Councilman N:Lezgodski seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a rolh1 call vote of 9 ayes - 0 nays. ATTEU�� CLERK � PRESIDENT , OCTOBER 2:75 1941 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session in the Council Chambers, City Hall, Monday, October-27, 1941, at 7::40 P.M. with all members present. President Richardson presided The reading of the minutes of the previous meeting was omitted by unanimous consent. The Clerk read a communication from Mrs. Lyla Maye Crosby Coffman suggesting the posting of bus schedules. The Communication was-ordered referred to the Board of Safety and Traffic Engineer on motion of Councilman Hull, se by Councilman Bishop. A Communication from the River Park Civic Association, Inc., expressing their thanks to the Council for their effo in correcting the dumping situation along the St. Joseph River, was ordered placed on file. PETITION South Bend, Indiana TO THE HONORABLE MEMBERS OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, GREETINGS: The undersigned, Northern Indiana Transit, Inc., respectfully petitions your honorable body pursuant to Section 25 of the Zoning Ordinances of the City of South Bend, Indiana the same being Ordinance No. 2331, and represents; That it is the owner of the following described real estate in the City of South Bend, St. Joseph County, Indiana: Beginning at a point on the south line of Lincoln Way East which point is 470.25 feet west of the intersection point of the south line of Lincoln Way East and the east line of Section 18 Township 37 North Range 2 East, thence westerly along the south line of Lincoln Way East 796.65 feet; thence south to the north line of the right -of -way of the New York Central Railroad Company; thence east along the north line of the right -of -way of said railroad company 790 feet, more or less, to a point directly south of the beginning pointk thence north 141.38 feet to the place of beginning. This petition represents that said land is now zoned by the provisions of the ordinance above referred to as and foz commercial use. That said -land is not now and has not been used for any purpose whatsoever for many years last past; that petitione: has the opportunity at the present time of selling a part of said land for use as a bottling plant which is classi- fied as light industrial. REPORT OF THE COMMITTEE OF THE THOLE To the Common Council.of the City of South.Bend: I Oct. 27, 1941 Your Committee of the Whole to whom was referred "An ordinance amending Ordinance +2331, adopted by the 'Common Council of the City of South Bend, Indiana, June 25th,'1923, and commonly known as the Zoning Ordinance. "'' Respectfully report that they have examined the matter and that in their opinion this ordinance shall be referred the Council favorably. LEO M. JORDAN, Chairman Councilman Brannan made a motion to accept the report. Councilman Pulaski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Oct. 27, 1941 Your Committee of the Whole to whom was referred "An ordinance for the emergency appropriation of $80.92 and for the transfer thereof from the general fund of the City of South Bend, Indiana to an account known as D -9, being the office equipment account of the City Treasurer of the City of South Bend, Indiana,; also, for the emergency approp- riation of $129.42 and for the transfer thereof from the general fund of the City of South Bend, Indiana to an account known as D -6, being the repair and rental of equipment account of the City Treasurer of the City of South Bend, Indiana. Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council favorably. LEO M. The ordinance was given third reading and passed by a roll call vote of 9 ayes - O'nays. The ordinance was given first and second reading and referred to the Committee of the Whole for public hearing on November 10th, on motion of Councilman Brannan, seconded by Councilman Pulaski. ORDINANCE AN ORDINANCE TRANSFERRING CERTAIN FUNDS FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND FOR EMERGENCY PURPOSES. The ordinance was given first and second reading. Motion carried' ORDINANCE 1 AN ORDINANCE TRANSFERRING CERTAIN FUNDS FROM THE GENERAL.FUND OF THE CITY OF SOUTH BEND FOR EMERGENCY PURPOSES. The ordinance was given first and second reading. ORDINANCE NO. 340.2• AN ORDINANCE AUTHORIZING THE SALE OF ALL OF THE RIGHT, TITLE, AND INTEREST OF THE CITY OF SOUTH BEND, INDIANA, IN AND TO ANY BONDS,-COUPONS, AND/oR ASSESSMENTS HERETOFORE ISSUED UNDER IMPROVEMENT RESOLUTION NO. 1544, APPROVED OCT. 6, 1925, COVERING ASSESSMENT ROLL'NO. 1952, THE FAIRVIEW -MAIN STREET TRUNK SEWER. The ordinance was given first and second reading. Councilman Bishop made a motion for the suspension of rules. Councilman McCarthy seconded the motion. Motion carried by a roll call vote of 9 ayes - 0 nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. RESOLUTION RESOLUTION ALLOCATING THE SUM OF TEN THOUSAND ($10,000.00) FROM TITS AMOUNT APPROPRIATED FOR WPA AND PWA IN THE 1941 BUDGET UNDER ACCOUNT H -27 FOR DEPARTMENT OF PUBLIC WORKS TO SPECIAL WPA A /C. BE IT RESOLVED by the Common Council of the City of South Bend,. Indiana. That. the sum of Ten Thousand Dollars ($10,000.00) be and the same is hereby allocated from Account H -27, Department of Public Works in the 1941 Budget to Special WPA account, and that this amount so allocated by the Common Council may be used 'during the year 1941, for the purchase of materials, labor and other items chargeable to the various City WPA projects subject to the approval of the Board of Works. The amount so allocated shall be deducted from the amount of One Hundred Fifty -Eight Thousand, Five Hundred Dollars ($158,500.00) appropriated in the 1941 Budget under Account H -27, Department of Public Works. RESOLUTION A RESOLUTION CONCERNING THE CARE OF CERTAIN LOTS IN THE CITY CEMETERY IN THE CITY OF SOUTH BEND, INDIANA. Whereas, there are certain lots in the City Cemetery in the City of South Bend, Indiana, for which no provision for perpetual care has been made; And, 290 Whereas, such lots contain the remains of certain important citizens of the said city; And, Whereas, a proper respect and gratitude for their services requires that the said lots be cared for, NOW, THEREFORE, be it resolved by the Common Council of the City of South Bend, Indiana; That, 1. That the Sexton of the City Cemetery of the City of South Bend is hereby authorized and directed to arrange for the care of the follovAng lots to -wit: Lot 4, block 1, range 1 west Lot 27, block 2; range 1 west Lot 35, block 6; range 1 east Lot C. block 10, range 1 east 2. This resolution shall be in full force and effect.from and after its passage by the Common Council and its approval by the Mayor. Councilman Hull made a motion for the adoption of the resolution. Motion carried. City Attorney Levy requested that a Council committee be assigned to work with him on a plan to govern the use of the sidewalks by the merchants. President Richardson appointed the Streets, Alleys and Bridges Committee to this assignment. Councilman.Bishop made a motion that the Council go on record as encouraging the movement of the Central High School student body to curb destructive Halloween activities. Councilman McCarthy seconded the motion. Motion carried. Councilman Hull made a motion that the City Attorney be instructed to amend the present ordinance to allow grocers, etc., to sell electric light bulbs without a license. Councilman Bishop seconded the motion. Motion carried. There being no further business, Councilman Pulaski made a motion to adjourn. Councilman Bishop seconded the motion. Motion carried.
