HomeMy WebLinkAbout09-08-41 Council Meeting Minutes1284 Be it remembered that the Common Council of the City of South Bend, Indiana, met in regular session, Monday, Septembe 7 + 8, 1941, in the Council Chambers, City Hall, at 7:32 P.M. with all members present. President Richardson presided. The reading of the minutes of the previous meeting was waived. A communication signed by Ernest H. Miller, City Traffic Engineer, explained the parking situation on Portage Avenue. Councilman Hull made a motion that the communication be filed. Councilman Bishop seconded the motion. Motion carrie . REPORT OF CITY PLAN COIRAISSION Sept. 5 1941 To the Common Council City of South Bend, .Ind. Gentlemen: Petition of Helen Pawlowski et al, for change of zoning of property on both sidesof North Michigan Street from Bartlett Street to the first alley south from residence to commercial district was considered by the City Plan Comm- ission at their meeting Sept. 4th. This change is recommended. The proposed change of the middle portion of this block was recommended for the same change at a previous meeting. These changes together will include Lots #10,11, 12, 13, 14 and 15 of Bartlett's 1st Addition and Lots #51 69 71 8, 9, 10, 11 and 12 of Rockstroh Bros. Addition. D. Moomaw, Sect. Councilman McCarthy made a motion that the report be accepted. Councilman Niezgodski seconded the motion. Motion carried.— REPORT OF CITY`PLAN CCWIISSION September 5, 1941 To the Common Council City of South Mend, Ind. Gentlemen: Petition of John M. Stier of the Federal Deposit Insurance Corporation for change of zoning classification of Lots #1 2 & 3 Logan Heights proposed addition was considered by the City Plan Commission at their meeting Sept. 4th.. Inasmuch as this requested change is intended to accommodate no commercial enterprise other than a signboard, the City Plan Commission voted to defer their action on this change and recommend that the petitioner seek relief thro the Board of Zoning Appeals. D. Moomaw Councilman Hull made a motion that the report be filed. Councilman Bishop seconded the motion. The ordinance was given first and second reading. Councilman Pulaski made a motion that the ordinance be referred to the Committee of the 'Whole for public hearing September 22nd. Councilman Heideman seconded the motion. Motion carried. After further discussion of the above ordinance, Councilman McCarthy made a motion that the motion to refer the ord- inance to the Committee of the Whole a nd the ordinance itself be withdrawn. Councilman Hull seconded the motion . Motion carried unanimously. ORDINANCE AN ORDINANCE TRANSFERRING CERTAIN FUNDS FROM THE GENERAL FUND'OF THE DEPARTMENT OF PUBLIC PARKS OF THE CIVIL CITY OF SOUTH BEND, INDIANA, FOR EMERGENCY PURPOSES. The ordinance was given first and second reading. Councilman Pulaski made a motion that the ordinance as corrected be referred to the Committee of the Whole for public hearing September 22. Councilman McCarthy seconded the motion. Motion carried. ORDINANCE AN ORDINANCE FOR THE EMERGENCY .APPROPRIATION OF $10,600.00, AND FOR THE TRANSFER THEREOF FROM THE GENERAL FUND OF THE CITY OF SOUTH BEND TO AN ACCOUNT KNOWN AS B15, BEING THE INTEREST ACCOUNT OF THE CONTROLLER OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first and second reading. Councilman McCarthy made a motion that the ordinance be referred to, the Committee of the whole for public hearing September 22. Councilman Niezgodski seconded the motion. Motion carried. )RDINANCE NO. 3393 AN ORDINANCE AUTHORIZING THE ACCEPTANCE OF CERTAIN PAYMENTS IN LIEU OF TAXES FROM THE UNITED STATES OF MJERICA, APPROVING A FORM OF CONTRACT AUTH THE UNITED STATES OF AMERICA WITH RESPECT THERETO, AND AUTHORIZING THE EXECUTION OF SAID CONTRACT. The ordinance was given first and second reading. Upon motion of Councilman Jordan, seconded by Councilman McCarthy, a roll call vote was taken for suspension of the rules and carried by a vote of 9 ayes - O nays. The ordinance was given third reading and passed by a roll call vote of 9 ayes - 0 nays. Councilman Jordan made a motion that the'City Attorney be instructed to draw an anti - noise ordinance. Councilman Heideman seconded the motion. Motion carried. Councilman Heideman requested that the City Attorney draw an ordinance making it necessary for all trucks to carry the name and address df the owner. Councilman Jordan asked to be relieved of the duties as a member of the City Plan Committee. President Riphardson accepted his resignation with regret and stated a successor would be appointed at the next Council meeting. President Richardson pre- sided. The reading of the minutes of the previous meeting was omitted by unanimous consent. COMMUNICATION TO THE COMMON COUNCIL: September 9, 1941 Attached hereto is a copy of a letter which was sent to the attorney of the Grand Trunk Railway, concerning the matter of crossings at 30th and 32nd Streets. We feel this letter is self - explanatory. (attached letter Mr. Arthur L. May 811 J.M.S. Bldg. South Bend, Ind. Dear Sir: Respectfully submitted, JAMES P. CONBOY, Clerk September 9, 1941 The City is interested in opening 30th and 32nd Streets, and is therefore requesting that the Grand Trunk Railway give the City rights -of -way at these two points so that proper crossings can be installed. The residents .in this vicinity.are anxious that this be done at the earliest possible instance, and it is my under- standing that you have already taken the matter up in an informal way. Please advise as soon as possible concerning the attitude of the railway company towards this matter. Very truly yours, BOARD OF PUBLIC WORKS & SAFETY James P. PETITION, South Bend, Ind., Sept. 18, 1941 TO THE HONORABLE BOARD OF PUBLIC WORKS AND SAFETY & CChFION COUNCIL of the City of South Bend, Indiana. Gentlemen: We the undersigned property owners, petition your honorable body to improve intersection of No. Side Blvd. & 26th street from - by installing street light on the southwest corner of intersection. Paul Raber - 1219 S. 26th and 15 other signers Councilman Brannan made a motion that the petition be referred to the Board of Works. Councilman Bishop seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the City of South Bend: Sept. 22, 1941 Your Committee of the Whole to whom was referred "An ordinance transferring certain funds from the general fund of the Park Department of Public Parks of the Civil City of So. Bend, Ind., for emergency purposes." Respectfully report that they have examined the matter and,that in their opinion this ordinance shall be reported to the Council favorably. Leo M. Jordan, Chairman Councilman McCarthy made a motion to accept the report. Councilman Pulaski seconded the motion. Motion carried.. REPORT OF THE COMMITTEE OF THE WHOLE Sept. 22, 1941 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An ordinance for the emergency appropriation of $10,600.00 and for the transfer thereof from the General Fund of the City of South Bend to an account known as B15, being the interest account - of the controller of the City of So. Bend, Ind." Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council favorably. Leo. M.
