M. with all members present. President Richardson presided. The reading of the evu o s meeting was waived. REPORT OF THE COMMITTEE OF THE WHOLE To the Common council of the City of aouth Bend; July 14, 1941 Your committee of the `'hole to whom was referred "An ordinance for the emergency appropriation of 410,000.00 and for the transfer thereof from the General Fund of the City of South Bend out of Gasoline Tax Refunds to an account known as I -i6A, being the "other equipment" account of the Street Department of the City of South Bend, Indiana." Respectfully report that they have examined the matter and that in their opinion this ordinance as amended shallgo to the Conueil favorably.. Leo. M. Jordan, hairman Councilman McCarthy made a motion to accept the report. Councilman Neizgodski seconded the motion. Motion carried, REPORT OF CITY PLAN COMMISSION July 11,1941 To the Common ('ouncil - City of youth Bend, Ind. Gentlemen: Petition of John M. Stier for the Federal Deposit Insurance Corptn, for change mf zoning classification of property at the southrwest corner of Jefferson and Logan Streets was not acted upon at their meeting July 10th. Action was deferred to their.August meeting. D. Moomaw,:.,< Secretary. A motion by Councilman Heideman and seconded by Councilman Pulaski that the report be placed on file. Motion carri REPORT OF CITY PLAN COMMISSION July 11, 1941 To the L'ommon Council - City of South Bend, Ind. Gentlemen: Petition of J. J. Kohen for change of zoning classification of property between Ruskin St. and Harriet Place, immediately east of John Adams Add. from Light Industrial district and E height and area district to B residence and A height and area district was considered by the L'ity Plan Commission at their meeting July 10th. This change is recommended by them. D. Moomaw, Secretary. Councilman Heideman moved the report be placed on file,. Oouncilman Neizgodski second motion. Motion carried. REPORT OF CITY PLAN COMMISSION July 11, 1941 To the vommon 6vuupil - City of South Bend, Ind. Gentlemen: The City Plan Commission at their regular meeting on July 10th recommended the change of zoning on N. )Uchigan St. as petitioned for by Geo. E. Frederick, et al. The owners of property on the balance of the block north to Bartlett St. brought to this meeting an informal petition asking to be included in this change. !heir petition is t=sm tted herewith. The City Plan �'ommission took no action on this informal petition- because it did not come to`them in the regular fashion and because of its proximity to Leeper Park, the matter should be brought to the attention of the -Park Board. This ordinance was given third reading and passed by roll call vote of 9 ayes - 0 naves. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 2331 (immediately east of John Adams Add.) 2'71 This ordinance was given first and second reading. Councilman McCarthy made a motion that the ordinance be ref to the Committee of the Whole for public hearing on July 28th. Councilman Jordan second the motion. Motion carried. ORDINANCE AN ORDINANCE TO REGULATE, AND LICENSE THE SALE, AND:DISTRIBUTION OF FOODS; TO REGULATE THE HEALTH OF THOSE ENGAGED THEREIN; THE ISSUANCE OF PERMITS THEREFORE; DEFINING CERTAIN TERMS; XND PROVIDING PENALITIES FOR VIOLATION THEREOF; This ordinance was given first reading by title. A motion by Gouncilman McCarthy that the second reading be given by title only wqs seconded by Councilman Jordan. Motion carried. Following the second reading of this ordinance a motion by Mr. Hull and seconded by Mr. Bishop that the ordinance by referred to the `'ommittee of the :,'Whole for public hearing on July 28th. MOTIONS A motion made Councilman McCarthy and seconded by Councilman Brannan that the City Clerk refuse to accept any ordinances resolutions unless they are signed by Ae councilman. NEW BUSINESS Councilman Jordan referred to filling station at the corner of Miami Street and Ewing Avenue as being a nusiance. "It was decided to refer-.• this matter to the Board of Safety.
