Home My WebLink About06-09-41 Council Meeting MinutesBe it remembered that the Common Council met in regular session in the Council Chambers, City Hall, South Bend, Monday, June 9, 1941, at 9 :30 P.M. with all members present except Councilman Brannan. President Richardson pre- sided. It was agreed to waive the reading of the minutes of the previous meeting. The Clerk read a communication from Rev. Loran Irby, Pastor of the Wesleyan Methodist Church, which communication, on motion, was referred to the City Plan Commission. A Communication from the Sliver Park Business & Professional Men's Association was read and on motion of Councilman Pulaski, seconded by Councilman Jordan, was referred to the Board of Works. A Communication from the National Milk Company regarding a dumping situation was read and referred to the Board of Safety with instructions to correct and report to the Council at the next meeting. PETITION: To the Common Council of the City of South Bend, Indiana 1. Gentlemen: We, the undersigned, being the owners of one hundred (100) per cent of the frontage involved, hereby petition your body to change the zoning of the following tract of land in the City of South Bend, to -wit: Beginning a t a point Eight Hundred and forty -eight and seven tenths feet (848.71) East and Five Hundred and fourteen feet (514) South of the Northwest corner of the Northeast Quarter (1/4) of Section Eighteen (18), Township Thirty -seven (37) North, Range Three (3) East; said point bedng on the East line.of John Adams First Addition at the North line of Ruskin Street; thence South Sixty feet (600; thence West Thirty feet (301); thence South Two hundred and ninety -seven feet (2971) to the Southeast corner of John Adams First Addition; thence East Three hundred and thirty- two and forty -five hundredths feet (332.451) to the West line of S.W. REPORT OF THE COMMITTEE OF THE MOLE To the Common Council of the City of South Bend: June 9, 1941 Your Committee of the Whole to whom was referred "An ordinance amending "an Ordinance entitled "An ordinance to regu- late and restrict the location of t rades,callings, industries, commercial enterprises, and the location of buildings designed for specified uses; to regulate and limit the height of buildings hereafter erectedror altered; to regulate and determine the area of yards and other open spaces about buildings, etc. Respectfully report that they have examined the matter and that in their opinion this ordinance shall go to the Council favorably. REPORT OF THE COMMITTEE OF THE V1HOLE June 9, 1941 To the Common Council of the City of South Bend:: Your Committee of the Whole to whom was referred "An ordinance approving and authorizing the execution of a coopera- tion agreement between the City of South Bend and the Housing Authority of the City of South Bend, Indiana *" Respectfully report that they have examined the matter and that in their opinion this ordinance shall be referred to the Council favorably. REPORT OF THE COMMITTEE OF THE WROLE June 9, 1941 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An ordinance providing for the regulation and control of fumigatio with poisonous gas and the use of insecticide for elimination and control of insects_;vermin, rodents and other pests providing licenses therefor and providing for a penalty for the violation of said ordinance. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be held in Committee for further investigation. LEO M. A report from the special Dumping Committee was read and accepted on motion of Councilman Pulaski and second by Councilman Niezgodski, REPORT OF CITY PLAN COMMISSION June 6, 1941 To the Common Council - City of South Bend, Ind. Gentlemen: Paragraph 6 of the proposed cooperation agreement between the City of South Bend and the Housing Authority was con- sidered by the City Plan Commission at their regular meeting June 5th. 267 CITY PLAN COMMISSION REPORT (Cont'd) By the action of the Commission it agrees to lend its cooperation in the opening and closing of alleys and streets and in the zoning and rezoning of land areas affecting the development of such projects insofar as such action shall not be in conflict with the best interests of the city and of neighboring property owners. ORDINANCE NO. 3370 AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A COOPERATION AGREEMENT BETWEEN THE CITY OF SOUTH BEND, AND THE HOUSING AUTHORITY OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given third reading and passed by a roll call vote of five ayes (Richardson, Jordan, Niezgodski, McCarthy and Pulaski) - three nays (Hull, Bishop and Heideman) - one absent (Brannan). ORDINANCE NO. 3371 AN ORDINANCE AMENDING AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION OF TRADES, CALLINGS, INDUSTRIES, COMMERCIAL ENTERPRISES, AND THE LOCATION OF BUILDINGS DESIGNED FOR SPECIFIED USES: TO REGULATE AND LIMIT THE HEIGHT OF BUILDINGS HEREAFTER ERECTED OR ALTERED-. TO REGULATE AND DETERMINE.THE AREA OF "'YARDS AND OTHER OPEN SPACES ABOUT BUILDINGS: TO REGULATE AND DETERMINE THE DENSITY OF USE OF LAND AND LOT AREAS, AND FOR SAID PURPOSES TO DIVIDE THE CITY INTO DISTRICTS AND PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT AND A BOARD OF ZONING APPEALS" BY CHANGING THE ZONING CLASSIFICATION OF CERTAIN DESCRIBED REAL ESTATE. The ordinance was given third reading and passed by a vote of 8 ayes - 0 nays - 1 absent. ORDINANCE AN ORDINANCE FOR THE EMERGENCY APPROPRIATION OF $1, 600.00 AND FOR THE TRANSFER THEREOF FROM THE GENERAL FUND OF THE CITY OF SOUTH BEND TO AN ACCOUNT KNOWN AS P22`, BEING THE MOTOR EQUIPMENT ACCOUNT OF THE POLICE DEPARTMENT OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given first and second reading. Councilman Bishop made a motion to have the ordinance referred to the Committee of the Whole for a public hearing on June 23. Councilman Pulaski seconded the motion. Motion carried. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 2331. (Weidler's Addition & L.W.W. ) This ordinance was given first and second reading. Councilman Hull made a motion that the ordinance be referred to the Committee of -the. Whole for public hearing June 23. Councilman Pulaski seconded the motion. Motion mrried. RESOLUTION RESOLUTION TRANSFERRING THE SUM OF $50.00 FROM THE CONTINGENCY FUND IN THE APPRO* • PRIATION OF THE CITY CONTROLLERtS OFFICE TO AN ACCOUNT KNOWN AS NUMBER R3, FOR THE 'REPAIR OF EQUIPMENT OF THE DEPARTMENT OF WEIGHTS AND MEASURES. (WHEREAS, it is found desirable and necessary to repair certain automotive equipment used by the Department of Weights and Measures. NOW, THEREFORE, BE IT'RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, that there is hereby set aside and transferred, out of the contingency fund in the appropriation of the City Controller's office, the amount of fifty (50.00); dollars to be credited to the account known as R3 and to be used for the repair of equipment of the Department of Weights and Measures.
