HomeMy WebLinkAbout01-13-41 Council Meeting MinutesBe it remembered that the members of the Common Council met in regular session in the Council Chambers, Monday, January 13, 1941, at 7 :39 P.M. All members were present except Councilman McCarthy. President Richardson presided. There was a discussion as to whether or not the minutes of the previous meetings should be read in each Council meeting. It was agreed that this was unneceesary unless some particular matter was in question, and in such case, the minutes -would be read by the Clerk. Therefore, Councilman Hull made a motion that the reading of the minutes be deferred. Councilman Bishop seconded the motion. Motion carried by a vote of 8 ayes - 0 nays - 1 absent. COMMUNICATION To the Honorable Common Council of the City of South Bend Gentlemen: CITY OF SOUTH BEND, INDIANA DEPARTMENT OF LAW January 6, 1941 At the last Council meeting, Mr. T. Earl Kuntz addressed the Council, calling attention to a situation which exi in front of his place of business on South Lafayette Street, south of Indiana Avenue, where a truck is parked in the street in front of his manufacturing establishment for long periods at a time, thereby causing annoyance and inconvenience to Mr. Kuntz. At that time you instructed me to investigate the situation for the purpose of determining whether we had any ordinance that would solve it, and if not, to draft an ordinance which would take care of the oomplaint: Section 33 of Ordinance No. 3146, which is the Traffic Ordinance, provides as follows: "That the parking of vehicles on public streets or places of the city of South Bend, Indiana, in front of any building oocupied or used for business or professional purposes and not regulated by existing ordinances is hereby prohibited for ,& period exceeding three hours at a time, between eight o'clock, a.m. and six o'clock, p.m* on any day of the week, excepting Saturday, and on Saturday, between the hours of eight a.m. and nine p.m., and .holidays." I believe that this section of the :ordinance can be used to prohibit parking in front of Mr. Kuntz's place of business, for•.periods in . excess of three hours at a time. I am asking the police department to enforce this sec- tion of the ordinance in attempting to relieve the situation of which Mr. Kuntz complaintsq Very truly, GEO. N. REPORT OF THE CITY COU33T January 13, 1941 TO THE HONORABLE PRESIDENT AND MEMBERS OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA Gentlemen: Attached hereto is the annual report of the City Court of the City of South Bend, Indiana, for the year 1940. In view of the fact that the statistical charts are more complete than were those submitted for the year 1989, the Court has given only the highlights in the resume attached* _'17'F- Reiterating part of the comments of the previous year: I want to thank all of you for the courtesies extended to me during the past year and want all of you to know that I shall be very glad to cooperate with you individually and as a body whenever you feel that my interest in matters that may arise may be of assistance to you and your constituencies. ORDINANCE NO.,3 3,57 AN ORDINANCE CHANGING THE NAME OF CENTER STREET TO COLUMBUS COURT (This ordinance was given third reading and was adopted by a roll call vote of 7 ayes - 1 nay (Heideman) - 1 absent. ORDINANCE NO. 3-5-6-J' AN ORDINANCE AMENDING SECTION SEVEN OF ORDINANCE NO., 3351 ENTITLED "AN ORDINANCE LICENSING AND REGULATING PARKING STATIONS IN THE CITY OF SOUTH BEND, INDIANA, AND LICENSING AND REGULATING PARKING STATION OPERATORS. - The ordinance was given first and second reading. Councilman Hull made a motion for suspension of rules. The motion was carried by a roll call vote of 8 ayes - 0 nays - 1 absent. The ordinance was given third reading and was passed by a vote of 8 ayes - 0 nays -Y1 absent. ( ORDINANCE "? RESOLUTION RESOLUTION ALLOCATING THE SUM OF TWENTY -FIVE THOUSAND ($25,000.00) FROM THE AMOUNT APPROPRIATED FOR WPA AND PWA IN THE 1941 BUDGET UNDER ACCOUNT NO. H -27, DEPARTMENT OF PUBLIC WORKS TO SPECIAL WPA ACCOUNT.- BE IT RESOLVED by the Common Council of the City of South Bend, Indiana. That the sum of Twenty -Five Thousand Dollars ($25,000.00)be and the same is hereby allocated from Account H -27, Department of Public Works in the 1941 Budget to Special WPA Account, and that this amount so allocated by the Comm Council may be used during the year 1941, for the purchase of materials, labor and other items chargeable to the various City WPA projects subject to the Approval of the Board of Works. The amount so allocated shall be deducted from the amount of One Hundred Fifty -Eight Thousand Five Hundred Dollars ($158,500.00), appropriated in the 1941 Budget under Account H -27, Department of Public Works. Councilman Hull made a motion for the adoption of the resolution.Councilman Bishop seconded the motion. Motion carried by a vote of 7 ayes - 1 nay (Niezgodski) - 1 absent. Councilman Jordan brought to the attention of the Council certain conditions existing in the vicinity,of Emerson Ave. where dumping is being done on private property. Councilman Bishop made a motion that the Board of Health and the Board of Safety take action against the user of the property to see that it is cleaned and kept in an sanitary condi- tion. After investigation, a report is to be made to the Council. Councilman Pulaski seconded the motion. Motion carried by a vote of 8 ayes - 0 nays - 1 absent.
