M. All members were present except Councilman Bishop. President McCarthy presided. The reading of the minutes of the previous meeting was waived. REPORT OF THE COMIITTEE OF THE WHOLE To the Common Council of the City of South Bend: 9/9/40 Your Committee of the Whole to whom was referred a petition for an ordinance to prohibit parking in certain sections of the city during working hours - Respectfully report that they have examined the matter and that in their opinion this petition shall be kept in the Committee of the Whole for further consideration until the next meeting. Leo M. Jordan, Chairman Councilman Hull made a motion for the adoption of the report. Councilman Richardson seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE Sept.. 9, 1940 To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred "An ordinance appropriating the sum of $1000.00 from the General Fund of the City of South Bend for electric current for the Board of Works and appropriating the sum of $1500.00 for coal and heat for the Board of Public Works and also appropriating the sum of $2500.00 for special Barrett Law liquidation fund. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be referred to the Council favorably. Leo M. Jordan, Chairman Councilman Brannon made a motion for the adoption of the report. Councilman Pulaski seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF STREETS, ALLEYS & BRIDGES 9/9/40 To the Common Council of the City of South Bend: Your Committee on Streets, Alleys & Bridges to whom-was referred a Resolution requesting a change in the stops made by the bussess of the Northern Indiana Railway Corporation - Respectfully report that they have examined the matter and that.in their opinion the Board of Safety and the Traffic Engineer shall be given full cooperation in their newly initiated Pedestrian Safety drive for at least a year before my other steps are taken in regard to the changing of bus stops from the near to the far side of the streets. This decision was reached in a recent meeting with the representatives of the Studebaker Local No. 5, the Northern Indiana Railway Corporation, the Board of Safety, and the Traffic Engineer. Brannan, Chairman Councilman Pulaski seconded the motion. Motion carried. Sept. 6, 1940 . Petition of the Grand Trunk Western Railway Co. for the zoning of a tract of land running from Western Ave. at Laurel St. southwesterly to the New York Central Railway, formerly a portion of the right of way of the petitioner, was considered by 'the City Plan Commission at their regular meeting Sept. 5, 1940. The City Plan Commission recommends classifying this tract as petitioned for - i.e. D use and F height and area districts. D. Moomaw, Sect. Councilman Niezgodski made a motion for the acceptance of the report. Councilman Brannan seconded the motion. Motion carried. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Ind. Gentlemen: Sept. 6, 1940 The proposed ordinance for change of zoning classification from A use and A height and area district to D use and F height and area district, of a tract of land 95 ft. x 270 ft. adjacent to the Drewry's U.S.A. Ltd. plant has been considered by the Uity Plan Commission at their meeting Sept. 5th. This change is recommended. Yours truly, D. MOOMAW, Sect. Councilman Hull made a motion to accept the report. Councilman Niezgodski seconded the motion: dotion carried. 218 ORDINANCE THIS ORDINANCE IS AMENDATORY OF ORDINANCE NO. 2331, ADOPTED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA ON JUNE 25, 1923, COMMONLY KNOWN AS THE ZONING ORDINANCE. The ordinance was given third reading by title and passed by roll call vote of 8 ayes - 0 nays - 1 absent. (see minutes of Council meeting of 9/23/40) ORDINANCE NO. 3343 AN ORDINANCE APPROPRIATING THE SUM OF $1000.00 FROM THE GENERAL FUND OF THE CITY OF SOUTH BEND FOR ELECTRIC CURRENT FOR THE BOARD OF WORKS AND APPROPRIATING THE SUM OF $1500.00 FOR COAL AND HEAT FOR THE BOARD OF PUBLIC WORKS AND DECLARING AN EMERGENCY AND ALSO APPROPRIATING THE SUM OF $2500.00 FOR SPECIAL BARRETT LAW LIQUIDATION FUND. ORDINANCE AN ORDINANCE AMENDING ORDINANCE NO. 2243 COMMONLY KNOWN AS BUILDING CODE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED BY SUBSEQUENT ORDINANCES The ordinance was given first and second reading. Councilman Pulaski made a motion to have the ordinance referred to the Committee of the Whole on September 23. Councilman Brannon seconded the motion. Motion carried.: ORDINANCE N0. '3344 AN ORDINANCE APPROVING THE CONTRACT ENTERED INTO ON THE 9th DAY OF SEPTEMBER, 1940, BETWEEN THE BOARD OF PUBLIC WORKS AND SAFETY, CITY OF SOUTH BEND, INDIANA, AND THE INDEPENDENT CONCRETE PIPE CORPORATION, INCORPORATED. The ordinance was given first reading by title and second reading in full. Councilman Richardson made a motion for the suspension of rules. Councilman Brannon seconded the motion. Motion carried by a roll call vote of 8 ayes - 0 nays - 1 absent. The ordinance was given third reading and passed by roll call vote of 8 ayes - 0 nays - 1 absent RESOLUTION RESOLUTION ALLOCATING THE SUM OF TWENTY-FIVE THOUSAND ($25,000.00) FROM THE AMOUNT APPROPRIATED FOR WPA AND PWA IN THE 1940 BUDGET UNDER ACCOUNT NO. H -27, DEPARTMENT OF PUBLIC WORKS TO SPECIAL WPA ACCOUNT. BE IT RESOLVED by the Common Council of the City of South Bend, Indiana. That the sum of Twenty -five Thousand Dollars ($25,000.00) be and the same is hereby allocated from Account H -27, Department of Publit Works in the 1940 Budget to Special WPA Account, and that this amount so allocated by the - Common Council may be used during, the year 1940, for the purchase of materials,labor and other items chargeable to the various City WPA projects subject to the Approval of the Board of Works. The amount so allocated shall be deducted from the amount of One Hundred Seventy -Seven Thousand, One Hundred Ninety Dollars ($177,190.00), appropriat in the 1940 Budget under Account H -27, department of Public Works. Councilman Pulaski made a motion for the adoption of the Resolution. Councilman Niezgodski seconded the motion. Motion carried. After a general discussion on the matter of dumping within the city limits, Councilman Richardson made a motion that the Board of Health be advised to use their authority to stop such dumping within the city limits.
