The reading of the minutes of the Previous meeting was waived. COMMUNICATION Hembers of the City Council of South Bend Greetings July 13, 100 We take this means of thanking the committee that investigated the dust bo7l in the sixth district and the council as a whole for your splendid efforts in relieving us of this nuisance. COMMUNICATION To the Common Council of the City of South Bend Gentlemen: July 17, 1940 A delegation from the International Union, Trited Automobile ?'porkers of America, Studebaker Local A appeared before the Board of Public Works and Safety at its re jula.r meeting July 8th, regarding busses loading and unloading passen- gers in the inner lane of traffic. They had pre7iously sent the Board a copy of a resolution adopted at a recent meeting. The matter was discussed and Mr. Beamer informed the delegation that the Traffic Engineer had been work- ing on this matter for some time and they would be advised of any action to be taken. At the regular' meeting of the Board of Public Norks and Safety July 15th, 1940, her. Miller, Traffic Engineer, report- ed that the matter was being investigated. He has written to various Cities throughout the country and to the Burent of Traffic Research at Yale University for information and experience regarding near and far bus loading a)nes. REPORT OF THE C01,21TITTEE OF THE ?sIiOLE To the Common Council of the City of South Bend: Your Committee of the Whole to whomva.s referred an ordinance prohibiting the keeping of bees within the City of South Bend, Indiana. Respectfully report that they have examined the mattter and that in their opinion this ordinance shall be held in the Committee of the ? +thole and be given legal publication of public hearing to be held on August 12th. Councilman Hull made a motion that the report be accepted. Councilman Pulaski seconded the motion. Motion carried. II REPORT OT THE COMMITTEE OF THE %OLE [To the Common Council of the City of South Bend: Your Committee of the Whole to whom was referred an ordinance establishing a firemen's pension fund and firemen's pensions in accordance with Chap. 31 of the Acts of the General Assembly of Indiana 80th sessions, 1937. Respectfully report that they have examined the matter and that in their opinion this ordinance shall be reported to Council favorably. Councilman Pulaski made a motion that the report be accepted. Councilman Brannon seconded the motion. Motion carri- ed. REPORT OF C011MITTEI, ON MINUTES To the Common Council of the City of South Bend: Your Committee on the inspection and supervision of the minutes, would respectfully report that they have inspected the minutes of the previous meeting of the Council and found them correct. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Ind. Gentlemen: July 12, 1940 Because of the number of bad fires that have occurred in recent years in plants storing rags, paper, etc., and be- cause of the complaints arising in the vicinity of such storage and the storage of junk and salvaged materials, the City Plan Commission at their meeting July llth, recommended the following change be made by amendment to Ordinance. 23319 the Zoning Ordinance of the city. That Ordinance No. 2331 be amended by adding Item No. 10 to Section 7, reading: "Junk Yards, Yards for wrecking automobiles, collection and storing of rags, paper, metals and sundry reclaimed materials." This provision would require these establishments to be approved by the Board of Zoning Appeals, after a hearing, before they can occupy any new location. Yours truly, D. MOOMAW, Sect. President McCarthy suggested that the Clerk be instructed to draw an ordinance to comply with the suggestion of the City Plan Commission and present the ordinance at the next Council meeting. REPORT OF CITY PLAN COMMISSION To the Common Council City of South Bend, Ind. Gentlemen: July 12, 1940 Petition of the School City of South Bend, Ind., for the change of zoning classification of property at the N.E. corner of Colfax Ave. and Notre Dame Ave., known as the Coquillard School property, from residence to commercial district, was considered by the City Plan Commission at their meeting July 11th. The City Plan Commission does not recommend this change. Yours truly, D. MOOMAW, Sect. Councilman Niezgodski made a motion that the report be accepted. Councilman Bishop seconded the motion. Motion carried. ORDINANCE NO. 3327 AN ORDINANCE ESTABLISHING A FIREMEN'S PENSION FUND AND FIREMEN'S ASSEMBLY OF INDIANA, 80TH 6ESS10119 1937. This ordinance was given third reading and was passed by a roll call vote of 9 ayes - 0 nays. ORDINANCE #332 8 AN ORDINANCE TRANSFERRING CERTAIN FUNDS FROM THE GENERAL FUND OF THE CIVIL CITY OF SOUTH BEND, INDIANA, TO THE FIRE DEPARTMENT REPAIR OF EQUIPMENT FUND FOR EMERGENCY PURPOSES. This ordinance was given first reading by title and second reading in full. Councilman Hull made a motion for the suspension of the rules. Councilman Bishop seconded the motion. Rules suspended by roll call 'vote of 9 ayes - 0 nays. The ordinance was given third reading by title. Councilman Jordan made a motion that the ordinance be re- ferred to the Committee of the Whole for public hearing at the next meeting of the Committee of the Whole on August 12th. Councilman Brannon seconded the motion. Motion carried 9 ayes - 0 nays. This ordinance was given first reading by title. President McCarthy suggested in lieu of the second reading of the ordinance the Clerk be instructed to furnish each Council member a copy of the ordinance and that the ordin be referred to the Committee of the Whole for public hearing on August 12th. RESOLUTION BE IT RESOLVED By the Common Council of the City of South Bend, that the Judge of the St. Joseph Circuit Court is hereby requested to appoint three disinterested freeholders of this City for the appraisement of the follows ng described personal property owned by this City situated in the County of St. Joseph, State of Indiana, to -brit: Barrett Law bonds and coupons for the year 1931 owned by the City of South Bend, and issued pursuant to Resolution No. 1863, providing for McKinley Avenue pave- ment from Sunnyside to Greenlawn, Roll No. 2144; and Barrett Law bonds and coupons for the year 1931 owned by the City of South Bend, and issued pursuant to Resolution No. 1923, providing for McKinlly Avenue pave- ment from Greenlawn to Twenty- Second Street, Roll No. 2235; and All of the right, title and interest of said City in and to any assessments levied on account of said conds owned by said City, with the view of selling the same. Councilman Hull made a motion for the adoption of the Resolution. Councilman seconded the motion. Motion adopted 2o6 RESOLUTION WHEREAS, the City Council of the City of South Bend, Indiana, is informed that the price of milk to consumers in the City of South Bend is as high as in any city in the State of Indiana, and higher than the average price to ci sumers in this State, and WHEREAS, the. price of milk to consumers in South Bend was fixed by the Milk Control Board after hearings were held at which producers and distributors of milk were principally represented, and at which the consuming public, or its representatives,.had little part, NOW, THEREFORE, BE IT.RESOLVED that the Milk Control Board of the State of Indiana be asked to review the price of milk to consumers in the City of South Bend for the purpose of determining if the price cannot be lowered, that when a hearing, or hearings, are held that the Milk Control Board send a notice thereof to the City Clerk of the City of South Bend, in order that members of this Council may attend and be heard in t he interest of the consumers, The City Clerk is hereby directed to s end a copy of this Resolution to the Milk Control Board of Indiana.
